A couple that I know recently used this firm for estate planning. In Section 2.02 the will specifies that the man’s life insurance goes to the wife unless her death proceeds his. They thought they were all set. He died and the life insurance went to two of his three children. Come to find out a will only controls probate assets. Beneficiary driven assets do not pass through probate unless beneficiary designation fails. This was a complete shock to the entire family. Will or not make sure your beneficiary designation is correct. I do not think this fact was made clear to this family.
