As a father, I had an uphill battle getting my kids out of a toxic environment where my ex-wife was actively alienating my children to the point where I was losing communication with them. Brandy was appointed to be the Guardian ad Litem to investigate my case. When I was searching for the right legal representation, every attorney knew Brandy and had high praise for her. One lawyer told me that if Brandy is involved, you better be in the right. She comes to trial prepared, documented, and fully investigated. I found this to be true. Throughout the two year investigation, it was clear that she was focused on the best interest of the children. I don’t know if anyone else could have sorted through the complexity of my case. Brandy thoroughly investigated the evidence to separate information from misinformation. She interviewed school teachers, family, friends, doctors, and my children. My case was very complicated. Even though the alienated children signed affidavits to live with their mom, the courts recommended a change of custody. Brandy handed down a very comprehensive and detailed report to the court. Even though the evidence spoke for itself in the end, I wasn’t sure where Brandy would stand in her recommendation until she was called to testify in the temporary emergency custody hearing. She doesn’t show her cards and did not take sides until she finished her investigation. My children were found to be in a mental health crisis, and as an alienated father, I felt hopeless to save my kids or our relationship. Because of the care and hard work of Ms. Daswani, I was able to see an amazing turn around that I didn’t think was possible. I will always be grateful for the dedication she showed to my children.

Brandy Daswani was the most professional, thorough, responsive, involved advocate for my case that I could possibly ask for. Her expertise and compassion made all the difference for my case and my family. I would hire here again and recommend her to anyone who needs a family practice attorney or Guardian Ad Litem. No one better.

Some years ago, my wife and I made the difficult and painful decision to end our marriage after 15 years with two minor children. Although we were unable to maintain the marriage, we were in complete agreement about continuing to raise our children with joint custody for the both of us in separate households. We initially tried some self-help software to draft a settlement agreement (A good basis to begin the discussion but not really sufficient without being reviewed by an attorney when there are children involved.). We then initially hired Brandy to review and revise the settlement agreement so it would pass legal muster in Georgia courts. To our mutual shock, The judge in our case did not want us to have a joint custody (What?!) because in the judge's opinion that never works out really that people will cooperate through the remainder of the child rearing years. We both protested and insisted that both of us were in agreement and we both want to joint custody for the children and that's also with the children desired. The judge informed us that it was "not our decision" and proceeded to conduct a hearing to decide which of us was going to get full custody against both of our wishes. During a recess, I made an emergency phone call to Brandy and informed her of the situation. She suggested that we immediately dismiss the case and come to her office to consult how to achieve what we were both trying to accomplish. We did so and she suggested that we both waive venue and re-file in another jurisdiction where the judges reward cooperation and respect joint custody when it is in the best interest of the children and both parents and with full cooperation. We did so and after languishing for eight months in the original court without satisfactory resolution for anyone, we sailed through a friendlier jurisdiction of her suggestion in less than two months and got some closure on the legal issues. That has been nearly 10 years at this point and I am glad to report that not only are both of our children healthy and successful college students, but my ex-wife and I have remained friends to this day. This is largely attributable to Brandy's innovative and quick thinking solution to avoid an irreparable situation that would have doubtless tarnished the relationship with my ex-wife and I, and between each of us and our children. If there is anyway you can salvage your marriage especially with children, I counsel everyone I know to try that first. If you cannot come to mutual resolution I definitely recommend using an attorney for divorces with children in Georgia. If you find yourself in this unfortunate situation, there is no attorney I can personally recommend more highly than Brandy Daswani.

I was desperately seeking an attorney once I was served with divorce papers. After consulting with many attorneys I met with Mrs. Daswani. She was recommended to me by several legal professionals. She is held in high regard by her colleagues. My initial consultation lasted three hours. It was clear that she was taking my case seriously and had my best interest in mind. She took the time to address any concerns I had. Over the course of my case (which was complex to say the least), Mrs. Daswani stayed on top of every single issue. She was quick to respond anytime I had a question. This was very comforting as I had never needed representation and didn't know what to expect. She is tenacious, and thorough. I have referred other to Mrs. Daswani and they have been pleased with her as well.

Brandy was an amazing advocate, while also being compassionate and patient. From the beginning to the process to delivering the final order, Brandy and her staff made the process smooth and as painless as humanely possible! As a fellow attorney, I appreciated her professionalism more than words can say.

"I had the pleasure of having Nicole Westmoreland representing me on a gun-related case in miami Florida, and I couldn’t be happier with the outcome—she got the case dismissed! Nicole was extremely professional throughout the entire process and delivered exceptional results. Her communication was always clear, and she kept me informed every step of the way. While her services were on the expensive side, I truly believe you get what you pay for, and Nicole was worth every penny. I highly recommend her to anyone in need of a top-tier attorney."

Ms Westmoreland is special compared to most lawyers. What separates her most is the fact she actually cares. Most lawyers separate emotion which makes them just do work and go home and forget it about it. Mrs Westmoreland has passion and uses it to fight for you. Dealing with her taught me that if a lawyer doesn't actually care they are not the right lawyer!!

In Dealing with Nicole I realized I had the wrong lawyers all along. Nicole Westmoreland won my case for me. Whenever I called her she answered. I asked her how was she always available to answer my calls and give me so much attention and she replied she doesn't take every case that comes her way. She said if she is flooded with cases how could she effectively represent anyone. She just wouldn't have the time. She just makes sense !! Thank you for everything attorney Westmoreland !!

Mr. Welch was assigned to me though Cobb County Courts years ago. After helping me with that case, I hired him for several more. From a divorce to a DUI. He is the ONLY attorney I would ever use and have since recommended him to others.

Having Eric Welch represent me in my DUI case was a godsend. I was facing a 3rd DUI and I was very concerned about my future. I have never felt like previous lawyers I spoke to listened to my struggles nor cared until now. He was always readily available to answer all me questions. He took my case extremely seriously and seemingly personal. Eric Welch was able to get the courts to reduce my charge to a Reckless Driving and I couldn’t have been happier with his services. Had I retained any other attorney, I do not think I would have obtained the result that I did. I highly recommend him.

Mr. Welch represented me on a case which most others considered unwinnable. His knowledge and willingness to delve into the subject matter, research it, and ultimately win a victory for his client was gratifying. Add to that a good sense of humor, and you've got excellent representation.

Can a Lawyer Represent Me in Courts Outside of Marietta, Georgia?

Whether a lawyer can represent you in courts outside of your city or state depends on their licensure and the jurisdiction of the court:

  • Within the Same State:
Lawyers licensed in a particular state can typically practice anywhere within that state, including all cities and counties. They can represent you in both state and federal courts located in that state.
  • Outside of Their Licensed State:
If your case is in a different state, the lawyer must be licensed in that state to represent you. However, there are exceptions:
    • Pro Hac Vice Admission: An out-of-state lawyer can request special permission to represent a client in a specific case in another state. This requires filing a motion with the court and often working in conjunction with a local attorney.
    • Federal Courts: If your case is in federal court, a lawyer licensed in any state may be able to represent you, provided they are admitted to practice in that particular federal court.
  • International Representation:
For cases outside the United States, different rules apply, and the lawyer may need to comply with the foreign country's legal requirements or collaborate with local counsel.

It's important to discuss your specific situation with the lawyer to determine if they can represent you in the desired jurisdiction and what steps may be necessary to do so.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  • Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing. Most state bar websites have an online directory for this purpose.
  • Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case. Review their website, professional profiles, and case history.
  • Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association's records.
  • Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, Google, or Yelp to gauge client satisfaction and experiences.
  • Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field and adherence to high ethical standards.
  • Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation in the legal community.
  • Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  • Ask for References:
A credible lawyer should be willing to provide references from past clients who can speak to their abilities and professionalism.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  • Relevant Documents:
Bring all documents related to your case, such as:
    • Contracts or agreements
    • Correspondence (emails, letters, texts)
    • Legal notices or court papers
    • Financial records (if applicable)
    • Evidence (photos, videos, receipts)
  • Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and parties involved. This helps the lawyer quickly understand the context.
  • List of Questions:
Write down any questions you have about your case, the legal process, fees, or the lawyer's experience.
  • Financial Information:
If your case involves financial matters, bring relevant documents like pay stubs, tax returns, bank statements, or invoices.
  • Contact Information:
Provide details of any witnesses or other parties relevant to your case, including their names and contact information.
  • Personal Identification:
Bring a valid photo ID for verification purposes.
  • Pen and Notebook:
Take notes during the consultation to remember important points discussed.
  • Budget Constraints:
Be ready to discuss your budget and any financial limitations so the lawyer can provide appropriate guidance on fees and payment options.
  • Openness and Honesty:
Be prepared to discuss your case candidly. Full disclosure allows the lawyer to give accurate advice and anticipate potential challenges.
