Sean handled estate property probate and transfer in a professional and time effective manner for us. The process was very smooth even given we are not Florida residents and needed this to be handled without our presence.

In my view Attorney Sean D. K. Scott is a gentleman and a compassionate counselor, who is very well informed in the matters relative to estate planning. Upon the recommendation of an old and dear friend of ours, my wife and I sought Sean's services to help us develop our estate plans, which included the design and drafting of trusts, wills, living wills, powers of attorney, etc. From the beginning of the process to the finalization of all documentations, we found working with Sean to be a pleasurable experience. He did a great job for us, and we would highly recommend him to others seeking similar help.

I had Attorney Sean Scott as a Business Law professor in school and knew he practiced what he taught. Some business partners and I started a company and I knew that we would be moving headquarters from the DC beltway area to Florida. I immediately contacted Sean and he was eager to help and come on board as our legal counsel. Instead of "going through the motions" he wanted to know as much about the company as possible. When someone asks me for information in the amount of a glass of water, I tend to open up a fire hose worth of information. He never rushed me and asked more questions to better establish the structure, organization, vision, and strategy of the company, so he could best identify how to set-up our company structure in Florida. He has incorporated our company, and created/drafted documents in our record book (articles, minutes, membership units, changes to our registrations and ownership, operating agreements, buy-sell agreements, special meetings, dissociations, power of attorneys, certificates of incumbency, purchase agreements, security agreements, etc.). He has also reviewed contracts, NDAs, teaming agreements, and non-compete/non-circumvent agreements. I hired Mr. Scott originally to re-incorporate our company in Florida, but as our business model solidified it was apparent we would be needing an on-call legal counsel. Sean transitioned with ease and took on the added workload. He has always communicated promptly and thoroughly, and has never rushed off the phone during a call. He prioritizes efficiently and if something is going to take a little bit longer, he calls or emails with the reason for any delay and when the expected time of completion would be. We are a small business and nothing we have had to address is "urgent" so we told Mr. Scott from the beginning that if other more important work comes up, just let us know and we will be more than happy to take a back seat. We understand we are not his only client and are understanding of the dynamic legal practice environment. I would highly recommend Sean Scott for any business law questions, concerns, or legal services. He is honest (rare in the business), detailed, and diligent. I loathe not being kept in communications, and Sean has been in constant contact throughout our business relationship. I have worked with other firms and they stand by the "no news is good news" motto which to me causes concern and anxiety when dealing with legal matters. I am glad for once I hit the jackpot for our legal representation needs.

Attorney Sean Scott represented me in a contract dispute that I had with a contractor who was performing some repair work on my home. Without going into great detail, and to make a long, long story short, all monies were paid to the contractor but the work was never completed. I contacted Mr. Scott and asked for his help. He was responsive and returned my call in a timely manner. He listened well as I described the problem, and he allowed me to vent my anger over the situation (more than once). He contacted the owner of the company on more than one occasion, and each time, he kept me well-informed of the conversation and the facts at hand. The bottom line is that through his negotiation skills and sense of reasonableness, he was able to settle the dispute (completely to my satisfaction) without any litigation. I was entirely please with my experience using the legal services of Sean Scott, and I would highly recommend him to anyone who needs legal help.

Jim Geiger has 40 years of wisdom and experience. He is a straight shooter, no nonsense and lets get down to business. He does NOT milk the clock, he gives reference points in relation to advice on what has worked and what has not worked in the past. He is respectful and listened to our concerns, questions and has a great way of communicating legal jargon in a layman's terms. Mr Geiger came highly recommended as a top notch lawyer from the President of the Maui Chamber of Commerce. He was more than fair on his pricing and becuase he is so good, skilled and experienced at what he does the "clock" on time charged was even less time. We highly recommend this lawyer for any type of business needs. We used him for a security agreement, promissory note, funding agreement and we will continue to use him for strategy was not listed as his speciality he nailed it.

I had the pleasure of working with Joanne Hicks on a TRO case. This could have potentially damaged my professional reputation and resulted in termination from my job. She made me feel at ease and came up with a strategy for my case. The TRO was dissolved thanks to her. She handled negotiations with the other side with skill and showed compassion to the other side which ultimately lead to a favorable outcome for me. I recommend her highly for any legal issue

Each and every employee at this firm is comprised of nothing but the utmost professionals who consistently exercised precision, genuine care, and diligence throughout my entire engagement. Samuel August, my attorney, and Lilli Lane, my paralegal, couldn't have performed their respective roles and responsibilities throughout my case any better than what was displayed; I would recommend anyone to Lowenthal & Lowenthal.

Jake was the utmost professional in all of our dealings as well as compassionate and caring during the past two and a half years. My wife suffered a slip and fall while on vacation in Maui and we were blessed to find him. He was always our advocate and trusted advisor in all matters relating to our lawsuit. You will not find a better firm to represent you or a more able and caring lawyer. Mahalo Jake and staff for all you did for us!

Can a Lawyer Represent Me in Courts Outside of Kahului, Hawaii?

Whether a lawyer can represent you in courts outside of your city or state depends on their licensure and the jurisdiction of the court:

  • Within the Same State:
Lawyers licensed in a particular state can typically practice anywhere within that state, including all cities and counties. They can represent you in both state and federal courts located in that state.
  • Outside of Their Licensed State:
If your case is in a different state, the lawyer must be licensed in that state to represent you. However, there are exceptions:
    • Pro Hac Vice Admission: An out-of-state lawyer can request special permission to represent a client in a specific case in another state. This requires filing a motion with the court and often working in conjunction with a local attorney.
    • Federal Courts: If your case is in federal court, a lawyer licensed in any state may be able to represent you, provided they are admitted to practice in that particular federal court.
  • International Representation:
For cases outside the United States, different rules apply, and the lawyer may need to comply with the foreign country's legal requirements or collaborate with local counsel.

It's important to discuss your specific situation with the lawyer to determine if they can represent you in the desired jurisdiction and what steps may be necessary to do so.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  • Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing. Most state bar websites have an online directory for this purpose.
  • Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case. Review their website, professional profiles, and case history.
  • Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association's records.
  • Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, Google, or Yelp to gauge client satisfaction and experiences.
  • Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field and adherence to high ethical standards.
  • Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation in the legal community.
  • Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  • Ask for References:
A credible lawyer should be willing to provide references from past clients who can speak to their abilities and professionalism.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  • Relevant Documents:
Bring all documents related to your case, such as:
    • Contracts or agreements
    • Correspondence (emails, letters, texts)
    • Legal notices or court papers
    • Financial records (if applicable)
    • Evidence (photos, videos, receipts)
  • Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and parties involved. This helps the lawyer quickly understand the context.
  • List of Questions:
Write down any questions you have about your case, the legal process, fees, or the lawyer's experience.
  • Financial Information:
If your case involves financial matters, bring relevant documents like pay stubs, tax returns, bank statements, or invoices.
  • Contact Information:
Provide details of any witnesses or other parties relevant to your case, including their names and contact information.
  • Personal Identification:
Bring a valid photo ID for verification purposes.
  • Pen and Notebook:
Take notes during the consultation to remember important points discussed.
  • Budget Constraints:
Be ready to discuss your budget and any financial limitations so the lawyer can provide appropriate guidance on fees and payment options.
  • Openness and Honesty:
Be prepared to discuss your case candidly. Full disclosure allows the lawyer to give accurate advice and anticipate potential challenges.
