“Dave was very compassionate and understanding getting us through a personal hardship of our lives.”
2
Excellent at explaining the legal process and setting realistic expectations
“In every step along the way, Dave was excellent about educating us in what to realistically expect at each stage, average timelines (understanding that each case is different).”
3
Highly effective advocate in court, respected by peers and judges
“He was an amazing advocate in court, fighting hard to get us the information and evidence we needed that we felt a third party did not want us to have. I literally had the best possible experience with a lawyer one could ever hope for or ask for in dealing with Mr Farnbauch. His honesty and candor were incredible. Most of us are conditioned to think "lawyers = money-hungry crooks" based on previous experiences with them and society's view of them by-and-large. David is the polar opposite of this philosophy/view! Without getting into the specifics of my case, he gave me advice that benefitted ME, not him. All his dealings with me and advice through my case was for my benefit and not his. He very clearly approached my case in a way that maximized my standing above all else, and was less concerned with getting money from me than he was concerned with making sure I came out of my case in the best possible way. In short, I highly highly recommend Dave as an attorney. He restored my faith in the legal profession and humanity in general to be honest!

We found David to be knowledgeable about the legal process and good at educating us as to what to expect. He was compassionate and supportive throughout this difficult time. We will be forever grateful to David Farnbauch and the Sweeney Law Firm.

Our son had been hurt badly - not just once - but three times by the same agency. Dave came highly recommended to us by a friend of ours who worked in the legal field. Initially, we went to Dave simply to get legal advice on what we needed to consider about our options. To be honest, we really didn't want to be part of a lawsuit. We struggled with the idea of a lawsuit because we knew it could be a long, drawn out process and there was part of us that didn't want to be "those people" who sued others. After meeting with Dave the first time, we decided not to pursue a lawsuit; however, Dave convinced us to file some vital paperwork to preserve our son's rights - and we are so glad that we listened to him. Several months later, when it became clear that our son's injuries were much worse than we first suspected and that we would be faced with years of insurmountable medical bills, we decided to move forward with the lawsuit. In every step along the way, Dave was excellent about educating us in what to realistically expect at each stage, average timelines (understanding that each case is different), and how to document and handle situations that arose that were relevant to our suit. For the first time since our son's initial injury, we felt empowered and hopeful about trying to make the situation "right." As expected, our lawsuit took a few years to resolve and throughout that time Dave and his staff were always communicating and accessible to us for our questions and concerns. He was an amazing advocate in court, fighting hard to get us the information and evidence we needed that we felt a third party did not want us to have. Interestingly, (we didn't necessarily expect this) he had a very good working relationship and rapport with the other side's attorney, so it made for a very respectful tone and environment to negotiate in during the mediation process. That speaks volumes to Dave's professionalism and the respect that his peers and judges have for him and the cases that he represents. Ultimately, we decided to accept a settlement offered to us during the mediation process and we avoided going to trial. We were extremely pleased with the end result and did not feel pressured at all - either to settle in mediation or go to the court for potentially more money. Dave was forthright in the strengths and weaknesses of our case and we felt that he was the exact guidance we needed to make the decision that was right for our family. There's no pretty way to say it. Going through something like this is awful, traumatic, and devastating. We still have years of healing ahead of us - and nothing can take that away or reverse time and undo what has happened. However, working with Dave Farnbauch was the best way for our family to make the best of a bad situation and to recover the resources we needed for our son to give him the best future we can. Without hesitation, I would highly recommend Dave to anyone else that finds themselves in a similar situation.

  4. What is your approach to resolving cases like mine?
Learn about their strategy, whether they prefer negotiation, mediation, or litigation.
  5. What potential outcomes can I expect?

Can a Lawyer Represent Me in Courts Outside of Fort Wayne, Indiana?

Whether a lawyer can represent you in courts outside of your city or state depends on their licensure and the jurisdiction of the court:

  • Within the Same State:
Lawyers licensed in a particular state can typically practice anywhere within that state, including all cities and counties. They can represent you in both state and federal courts located in that state.
  • Outside of Their Licensed State:
If your case is in a different state, the lawyer must be licensed in that state to represent you. However, there are exceptions:
    • Pro Hac Vice Admission: An out-of-state lawyer can request special permission to represent a client in a specific case in another state. This requires filing a motion with the court and often working in conjunction with a local attorney.
    • Federal Courts: If your case is in federal court, a lawyer licensed in any state may be able to represent you, provided they are admitted to practice in that particular federal court.
  • International Representation:
For cases outside the United States, different rules apply, and the lawyer may need to comply with the foreign country's legal requirements or collaborate with local counsel.

It's important to discuss your specific situation with the lawyer to determine if they can represent you in the desired jurisdiction and what steps may be necessary to do so.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  • Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing. Most state bar websites have an online directory for this purpose.
  • Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case. Review their website, professional profiles, and case history.
  • Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association's records.
  • Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, Google, or Yelp to gauge client satisfaction and experiences.
  • Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field and adherence to high ethical standards.
  • Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation in the legal community.
  • Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  • Ask for References:
A credible lawyer should be willing to provide references from past clients who can speak to their abilities and professionalism.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  • Relevant Documents:
Bring all documents related to your case, such as:
    • Contracts or agreements
    • Correspondence (emails, letters, texts)
    • Legal notices or court papers
    • Financial records (if applicable)
    • Evidence (photos, videos, receipts)
  • Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and parties involved. This helps the lawyer quickly understand the context.
  • List of Questions:
Write down any questions you have about your case, the legal process, fees, or the lawyer's experience.
  • Financial Information:
If your case involves financial matters, bring relevant documents like pay stubs, tax returns, bank statements, or invoices.
  • Contact Information:
Provide details of any witnesses or other parties relevant to your case, including their names and contact information.
  • Personal Identification:
Bring a valid photo ID for verification purposes.
  • Pen and Notebook:
Take notes during the consultation to remember important points discussed.
  • Budget Constraints:
Be ready to discuss your budget and any financial limitations so the lawyer can provide appropriate guidance on fees and payment options.
  • Openness and Honesty:
Be prepared to discuss your case candidly. Full disclosure allows the lawyer to give accurate advice and anticipate potential challenges.
