My husband and I knew right from the start that our case was a difficult battle. Attorney Ben Novotny took the time to educate us on the process of a malpractice wrongful death case. We felt confident throughout this process on how the case was handled. Ben's open communication, with us, in keeping us abreast of matters was greatly appreciated. He made us feel very comfortable concerning any questions or concerns we had through out. Attorney Novotny helped us through every step in a very difficult time of our lives. Attorney Novotny was, without question, instrumental in seeing my wife’s malpractice case through to its success. Attorney Novotny will be the first to tell you that malpractice cases are an uphill battle from the outset and, to be successful, attention to detail, among many other things, matters. Fortunately, for our family, having an attorney in your corner who prides himself on this very quality is pivotal. Attorney Novotny’s attention to detail was no more apparent than during trial preparations. Countless hours were spent meticulously covering all areas of the case to ensure we were comfortable with the plan put forth. It didn’t matter if this meant revisiting topics multiple times, Attorney Novotny was always there to support us every step of the way. Looking back over our two-week trial, Attorney Novotny demonstrated great poise, confidence, preparedness, attention to detail, and ability to connect with jurors, all which were contributing factors to our family’s case being decided favorably. Additionally, his previous experiences involving negotiations also proved beneficial both during trial as well as at the Appellate level. While I’ll be the first to admit the process of enduring a malpractice case can seem overwhelming, oftentimes resulting in families revisiting emotional life-changing events, having an attorney on your side who truly cares for the families he represents and someone who is vested in their advocacy can make all the difference in the world. In all honesty, being represented by Attorney Novotny was the best thing that ever happened to my family, given the circumstances involved, and if it wasn’t for his tireless efforts we wouldn’t be where we are today. I filed a complaint with the Iowa medical board in reference to a plastic surgeon who left me severely disfigured. Additionally the complications from the surgery left me required to see a wound care specialist for many many months with daily wound care, and will require another surgery related to the complications. The medical board did open an investigation and found the surgeon to be negligent. I had exactly 72 hours to file a malpractice lawsuit and Ben flew to me within 24 hours after he was contacted. He wasn’t concerned about the time frame just helping me!!!!! I was hesitant to hire an attorney and honestly very scared. After meeting Ben I knew I was in safe hands and that his sincerity towards my fears and overall situation was real. I completely trust Ben and being a nurse I must say I was impressed by his incredible knowledge in the medical field. Ben is smart, kind, sincere and he is dedicated to his clients. Wonderful experience; even better results. Attorney Novotny was very professional, personable and did an exceptional job representing me and my family. I spoke with another attorney prior to deciding to go with Ben. He told me that my case should settle, and spit balled a number. It just didn’t feel right. Then, I read up on Ben and his accomplishments. I thought it was amazing how much he has accomplished for his age and he is an unbelievably talented trial attorney. I decided to meet with him. Ben was very honest and great at managing my and my family's expectations. The fact that he wasn't jumping to settle our claim off the bat and was willing to work the case up as if it were to go to trial set him above the other lawyer. I know this extra effort plus his trial record only increased the value of my case. I'm sure he has many cases and we only had one, but he treated us and the story of what happened to me/what my family went through as if it was the only case he was managing. His attention to detail, compassion, and willingness to take the time to get to know us shined through in front of the jurors. My family and I were very nervous to go to trial, but with him, we felt at ease. We wouldn't change our decision to fight on in the courtroom for the world - justice was served. This attorney's firm accepted my medical mal case for failure to diagnose rectal cancer. They sent it to two malpractice experts, who both recommended it go forward. I and another family member was told that the case had already been filed in Superior Court. I became suspicious when after several months I did not get requested copy of pleadings. In response, Atty Novotny, lead trial counsel, called me--for 1st time ever. He said that he had reservations about the case. He essentially blamed me for not following up with a specific GI doctor. Clearly Atty Novotny did not read the file because the same docs he stated I blew off were the ones that had refused the referral from my primary care doctor. They would not accept a new referral & would not book a referral appt. This was IN WRITING and faxed in response to referral by my primary care doctor. Every time I personally tried to make an appt I was told that I was released back to my primary care MDs care. So how was I negligent when they stated I did not need a specialist? I wasn't. In reality, Novotny changed his mind after 16 months for another reason. Novotny hadn't yet contacted their co-counsel in NH. When he did, they informed him they had a conflict because one of their expert witnesses was one of the docs I was suing. (The NH firm told me about conflict when I tried to hire them) He also said that NH has mandatory medical malpractice tribunals & attys end up trying the case twice, & he was" not up for all that." He could have worked around conflict by getting other NH counsel but stated it was too expensive. Most of all, I am shocked that Atty Novotny never allowed me the courtesy of a face to face meeting. This man had no empathy and tried to blame the victim. I would accept blame if I did not have a fax from same docs saying my primary care could handle it & refusing to make appt (Novotny blamed me for not getting a colonoscopy yet docs denied referral & further stated that since I had one in 2005, I did not need another in 2010.) Atty Novotny either did not know the facts or did not care to straighten them out. He also stated my case was too small in $ value for him to deal with a NH tribunal. Again, I would have had no problem with this had he told me 16 months earlier & not had told me that the case was actually filed when it was not. There is a clause in their retainer agreement that allows the client to pay going forward--they did not honor that. I was simply given the bum's rush and told not to contact them further. I suggest Atty Novotny learn the golden rule. They retained a law firm to hide behind (other former clients report same treatment -- Avvo contact me for sites if any question as to integrity of this claim pls) Atty Novotny caused me a lot of emotional distress by blaming me & having facts wrong, yet not allowing me to ask why they lied about case being filed for many months. Had Atty Novotny expressed any willingness to sit down and explain things to me, or refer me to other counsel before the SOL ran out, I would not feel this way. Mistakes happen but this was calculated to twist the facts around on their own clients & make me feel responsible for life threatening illness. He prejudiced the ability of a Stage 3B cancer patient to successfully bring a case and get compensation because it was not worth his time, and "tribunals are a pain". He failed to acknowledge the refusal of the doctors to see me & twisted it into it being my fault ( docs told me he is wrong). Atty Novotny did not keep his commitments, misrepresented the status of a case, and failed to keep me informed. Rather, he blindsided me with factual inaccuracies & arrogant refusal to deal with NH's tribunals. This 16 months has forever prejudiced my ability file case in timely fashion. If there was a conflict he should have helped refer case to another firm. Cruel, misleading and arrogant. I would swear to the accuracy of these allegations in a court of law.

This lawyer was rude, incompetent, and each time he called me about my case he did not even bother to have my file in front of him. He twisted the facts of my case and after two medical experts in his firm gave it two thumbs up to go forward, he refused because he was reading facts wrong. Would not sit down & talk to me. Not enough damages for him because I was not dead yet. Firm told me that he was filing case numerous times since June & were lying about it. He did not give me respect, empathy or honesty. Ruined my case. Goes for big money, said I have case but not worth his while after telling me it wwas filed???
