Had he done that he would have clearly recognized she was not mentally aware of what she was signing and did not request the legal papers to be drawn up on her behalf. Mr. Nessmann drew up papers for that same client to convey property she owned when she was in a Nursing Facility with dementia three years after the POA papers she had signed.
