2nd marriage, 3 children on one side 1 on the other, a business and real estate - Kirk made the entire estate planning process REAL, EASY, and leaving us feeling confident. He understood our particular needs, he was knowledgeable and full of genuine ideas to manage our estate. I heard him as a speaker which finally hit me on what needed to be done for us as a couple and our children. If you work hard and want to protect what is yours and your family's I highly suggest you contact Kirk.

I first met Kirk through a client. She was getting help revising an existing trust. I found his advice very practical, and was fairly priced. He was recommending what was best for her. So I had lunch with Kirk to learn more about him. Since then he's helped a number of my clients, and has done some work personally for my family. Kirk has been an excellent resource. When I come across an interesting estate problem Kirk has always been there, willing to lend professional guidance. As a Financial Advisor, one of the risks in recommending others is that they might do something wrong. Financially there is no direct upside for me, but there could be significant client relationship downside if the other professional makes mistakes or treats my client poorly. If all goes well however, then the bonds I have with clients are strengthened. They know I’m going beyond my job and making sure their estate is in order. And they see me as a resource to help them find the best people. They appreciate that I take the effort, and am looking out for their best interest. I’m very comfortable recommending Kirk. Not only is his attitude positive (greeting with a big smile and pleasant handshake), but also he is very good at his job. I know he’s living up to his reputation when I consistently receive ‘Thank You’ notes from my happy clients.

We are very pleased for the opportunity to write this review. Mr. Falvay has been our main attorney for 16 years. With all of our needs including inheritance issues and trusts he has been fair, honest, creative, innovative and prompt. We own a small corporation and he has taken care of our business needs as well. We have had some experience with other law firms both huge and small. Most have been competent but none have ever come close to Mr. Falvay's performance in all areas. Thank you again Mr. Falvay.

Kirk has assisted me on a number of different legal matters such as real estate transactions and setting up a will and trust. Kirk is excellent to work with. He is very good at explaining the complexities of the law. Kirk is very trustworthy, and you feel that he genuinely has your best interest at heart. I would recommend him to anyone.

Kirk did a great job explaining estate planning to us and was also very helpful in guiding us through the various decisions that needed to be made. From his vast experience and his up to date document management system, he is able to stay on top of the latest strategies while avoiding tax planning pitfalls they may otherwise occur. I have referred several people to Kirk and will continue to do so as my feedback has been very positive from everyone that I have referred.

I've worked with Jim on a few different different issues, and couldn't have been happier to have him on my side. When planning for a trust, he was straightforward and easy to understand, making the normally daunting process simple for us to breakdown and get our paperwork together to begin. I've also had him advise me on a few legal matters and appreciate his honesty and attention to look at the whole picture and explain it from all sides before jumping in. Nobody wants to be in the situation of needing legal advice or services, and I felt assured that Jim advised me in the direction that was best for my needs, not what was best for his pocketbook. His honesty and integrity stand out amongst other lawyers I have used in the past.

We didn’t know we were being scammed as it was all so confusing. Brian returned my call and said don’t follow their instructions regarding a new “Failure to show up in court scam” He then called the sheriff impersonator who would not give his badge number and hung up confirming the scam. What a relief we felt and Brian was so kind and helpful, and didn’t charge us anything. Thank you for being a true friend and supportive citizen.

Ensure the lawyer has relevant experience in the specific area of law pertaining to your case.
  2. How do you charge for your services, and what are the estimated costs?
Understand the fee structure, including hourly rates, flat fees, retainer fees, and any additional expenses.
  3. Who will be handling my case?
Find out if the lawyer will handle your case personally or delegate tasks to other attorneys or paralegals.
  4. What is your approach to resolving cases like mine?
Learn about their strategy, whether they prefer negotiation, mediation, or litigation.
  5. What potential outcomes can I expect?
While no lawyer can guarantee results, they can provide an assessment of possible scenarios based on their experience.

Can a Lawyer Represent Me in Courts Outside of Bloomfield Hills, Michigan?

Whether a lawyer can represent you in courts outside of your city or state depends on their licensure and the jurisdiction of the court:

  • Within the Same State:
Lawyers licensed in a particular state can typically practice anywhere within that state, including all cities and counties. They can represent you in both state and federal courts located in that state.
  • Outside of Their Licensed State:
If your case is in a different state, the lawyer must be licensed in that state to represent you. However, there are exceptions:
    • Pro Hac Vice Admission: An out-of-state lawyer can request special permission to represent a client in a specific case in another state. This requires filing a motion with the court and often working in conjunction with a local attorney.
    • Federal Courts: If your case is in federal court, a lawyer licensed in any state may be able to represent you, provided they are admitted to practice in that particular federal court.
  • International Representation:
For cases outside the United States, different rules apply, and the lawyer may need to comply with the foreign country's legal requirements or collaborate with local counsel.

It's important to discuss your specific situation with the lawyer to determine if they can represent you in the desired jurisdiction and what steps may be necessary to do so.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  • Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing. Most state bar websites have an online directory for this purpose.
  • Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case. Review their website, professional profiles, and case history.
  • Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association's records.
  • Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, Google, or Yelp to gauge client satisfaction and experiences.
  • Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field and adherence to high ethical standards.
  • Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation in the legal community.
  • Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  • Ask for References:
A credible lawyer should be willing to provide references from past clients who can speak to their abilities and professionalism.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  • Relevant Documents:
Bring all documents related to your case, such as:
    • Contracts or agreements
    • Correspondence (emails, letters, texts)
    • Legal notices or court papers
    • Financial records (if applicable)
    • Evidence (photos, videos, receipts)
  • Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and parties involved. This helps the lawyer quickly understand the context.
  • List of Questions:
Write down any questions you have about your case, the legal process, fees, or the lawyer's experience.
  • Financial Information:
If your case involves financial matters, bring relevant documents like pay stubs, tax returns, bank statements, or invoices.
  • Contact Information:
Provide details of any witnesses or other parties relevant to your case, including their names and contact information.
  • Personal Identification:
Bring a valid photo ID for verification purposes.
  • Pen and Notebook:
Take notes during the consultation to remember important points discussed.
  • Budget Constraints:
Be ready to discuss your budget and any financial limitations so the lawyer can provide appropriate guidance on fees and payment options.
  • Openness and Honesty:
Be prepared to discuss your case candidly. Full disclosure allows the lawyer to give accurate advice and anticipate potential challenges.
