After working with another prominent defense attorney for more than 1 year on my case, I switched to Dave Risk. My original attorney did not communicate well with me and my case was floundering. To be fair, my case was anything but straightforward. Dave Risk's ability to listen and explain immediately reduced my anxiety over my case. Even though many of his clients were facing more serious charges than I, he never made me feel as though my case was not important. Dave was tough when he needed to be and I appreciate his willingness to fight above all else. He jumped in midstream and turned my case around, achieving the best possible result. My only regret is not hiring him sooner.

After hiring and working with Dave Risk for several months through the resolution of my case, I enthusiastically give Dave the highest possible recommendation and would refer him to my colleagues, friends, and family. He is exceptionally bright and has a mastery of the law. In addition to having a brilliant legal mind, Dave is a truly kind and generous man. Despite his busy professional schedule, he was always prompt about responding to my emails and text messages and taking my phone calls. His answers to my questions were always thorough and thoughtful and never unclear. He was very deliberate about setting my expectations and not only met them but exceeded them at every step of the way. Certainly, if I ever were unfortunate enough to have a similar problem, I would turn to Dave without hesitation. Again, I whole-heartedly give Dave the highest possible recommendation.

I was represented by Mr. Risk in a matter that thankfully didn't end up in court. I was very impressed by Mr. Risk's knowledge and an immediate game plan for defending my rights and innocence. I was innocent of the allegations against me and I have no doubt Mr. Risk's aggressive defense and game plan even in the investigative stage assisted in my being exonerated. I very much recommend Mr. Risk and his firm if you are in need of top notch criminal defense.

I found myself in a situation where I needed the best of the best attorney. Dave was understanding, knew every aspect of the law. Worked very hard to get me out of the situation which he succeed 100%. Since I am a slower learner I ended up in the same situation a 2nd time. Dave's first response to me was "Vicki I do not like repeat business. I like referrals. Again, his knowledge, compassion and hard work helped me once again. Dave was a key person to me getting my life on track. Not to get me out of trouble but to keep me out of trouble. I am proud to call Dave ever year on April 14th starting with the year 2008 to let him know I have yet another year of sobriety. By the grace of God it will be 8 years in 3 days. Dave has gone above and beyond for me. Again, he saved my life in more ways than one. I have such respect and admiration for this man. Please believe every word I say. When you are in need of an attorney I highly recommend Dave Risk. Thank you Dave for all that you have done for me.

I heartily recommend John Fossum. He has both represented and advised us, on many occasions, concerning both corporate and personal issues. His advice comes from a position of both knowledge and compassion. Northfield is lucky to have such a fine lawyer here in town.

Paul was great to work with. He really took the time to discuss my options and above all keep me focused on moving forward. It wasn't the end of the world which getting a DUI can feel like. Very professional and great attitude. Above all I took responsibility for what I did and realized I wasn't a loser just a person who ran out of luck and needed to get my life back on track and focused!

When my husband and I decided to get our affairs in order and develop an estate plan we found an amazing attorney, Timothy J. Scott (TJ). From the very first meeting and through the entire process TJ provided answers to our questions and explained the legal terms involved in a revocable living trust. All information discussed was provided in a format for our reference. TJ is extremely easy to talk with and we felt comfortable he listened to our concerns. Change is inevitable and TJ assured us he will be available to answer questions we might have in the future. We feel confident we made the right choice in working with the Law Office of Timothy J. Scott, P. A.

  2. How do you charge for your services, and what are the estimated costs?
Understand the fee structure, including hourly rates, flat fees, retainer fees, and any additional expenses.
  3. Who will be handling my case?

  4. What is your approach to resolving cases like mine?
Learn about their strategy, whether they prefer negotiation, mediation, or litigation.
  5. What potential outcomes can I expect?
While no lawyer can guarantee results, they can provide an assessment of possible scenarios based on their experience.

Can a Lawyer Represent Me in Courts Outside of Bloomington, Minnesota?

Whether a lawyer can represent you in courts outside of your city or state depends on their licensure and the jurisdiction of the court:

  • Within the Same State:
Lawyers licensed in a particular state can typically practice anywhere within that state, including all cities and counties. They can represent you in both state and federal courts located in that state.
  • Outside of Their Licensed State:
If your case is in a different state, the lawyer must be licensed in that state to represent you. However, there are exceptions:
    • Pro Hac Vice Admission: An out-of-state lawyer can request special permission to represent a client in a specific case in another state. This requires filing a motion with the court and often working in conjunction with a local attorney.
    • Federal Courts: If your case is in federal court, a lawyer licensed in any state may be able to represent you, provided they are admitted to practice in that particular federal court.
  • International Representation:
For cases outside the United States, different rules apply, and the lawyer may need to comply with the foreign country's legal requirements or collaborate with local counsel.

It's important to discuss your specific situation with the lawyer to determine if they can represent you in the desired jurisdiction and what steps may be necessary to do so.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  • Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing. Most state bar websites have an online directory for this purpose.
  • Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case. Review their website, professional profiles, and case history.
  • Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association's records.
  • Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, Google, or Yelp to gauge client satisfaction and experiences.
  • Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field and adherence to high ethical standards.
  • Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation in the legal community.
  • Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  • Ask for References:
A credible lawyer should be willing to provide references from past clients who can speak to their abilities and professionalism.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  • Relevant Documents:
Bring all documents related to your case, such as:
    • Contracts or agreements
    • Correspondence (emails, letters, texts)
    • Legal notices or court papers
    • Financial records (if applicable)
    • Evidence (photos, videos, receipts)
  • Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and parties involved. This helps the lawyer quickly understand the context.
  • List of Questions:
Write down any questions you have about your case, the legal process, fees, or the lawyer's experience.
  • Financial Information:
If your case involves financial matters, bring relevant documents like pay stubs, tax returns, bank statements, or invoices.
  • Contact Information:
Provide details of any witnesses or other parties relevant to your case, including their names and contact information.
  • Personal Identification:
Bring a valid photo ID for verification purposes.
  • Pen and Notebook:
Take notes during the consultation to remember important points discussed.
  • Budget Constraints:
Be ready to discuss your budget and any financial limitations so the lawyer can provide appropriate guidance on fees and payment options.
  • Openness and Honesty:
Be prepared to discuss your case candidly. Full disclosure allows the lawyer to give accurate advice and anticipate potential challenges.
