Joseph Kukla at this law firm helped us through the process of obtaining guardianship for our son who has developmental disabilities. Joseph was thorough, friendly, and professional, and we would recommend him to any of our friends who need to go through the guardianship process.

Recently had a custody and child support battle with the mother of my nine year old daughter. As biased as Minnesota Courts are against fathers, I went into this battle very discouraged already. Derk Schweiger was amazing in court, and I felt that because of his professional demeanor, articulateness, and sheer brilliance in court, the judge was able to see where I was coming from, and my life situation, my desire to better myself as a man, and my desire to be a father. The judgment was more than fair, and I was very happy that I chose Derk to be my lawyer. I have referred him to several people, and if need be, I will definitely call upon him again. He was professional, organized, clever, and not as expensive as other lawyers in the metro area. Thanks again! -Ryan Wagner

Tim is an excellent lawyer. He is very knowledgeable and was able to represent me very well during an appeal of my divorce case. Tim was able to work collaboratively with my primary lawyers to get up to speed on my case to save me time and money during the appeal process. Tim's integrity is beyond approach and he helped walk me through each step of the appeals process and what to expect during each step as well as the likely outcome. I appreciate that he didn't make any guarantees and helped explain things to me so that I could make informed decisions. Although Tim wasn't my primary lawyer for my divorce case, he did such a great job during the appeals process that I can confidently recommend him to handle all aspects of your divorce.

Mr. Lees is an excellent lawyer and I very much appreciate all the legal help he gave to me. Mr. Lees was able to use his legal expertise to come to my aid with difficult situations that were troubling and stressful to me, and his help put me at ease. This is something that I will always be Thankful for. My legal needs involved the most important thing in the whole world to me, my children – so I needed a lawyer whom I could trust. Mr. Lees was recommended to me from a highly regarded source as someone that I could trust, and to my relief this proved correct – I put my trust in the right person. Mr. Lees worked very hard to help me, and because of his help some bad situations were turned around and made better for my son. Without this help my son would have been in a situation that would have been very unhealthy for him. Mr. Lees made a way for my son to be free to live his life the way he was meant to live it – and this meant everything to me. Mr. Lees understood me, and what I needed for my children – and he worked to make things better – and that is exactly what I needed. I have much gratitude for all that Mr. Lees did for me during the time that he was my attorney. It is clear that Mr. Lees has much experience as a lawyer, is hard working, is responsive to his client’s needs, wants to make things work for the benefit of his clients, and is trustworthy. I highly recommend Mr. Lees as an attorney.

Tim is an outstanding lawyer. He worked very hard on my case. He was very knowledgeable in all areas of my case. Tim is a compassionate lawyer, who was understanding, caring, and took my case very seriously working very hard on it. I was coming out of a very bad domestic abuse marrriage where I thought I could lose everything. Which would mean losing all the stability that my children had, while going through trauma themselves. I had a head injury, and Tim was so patient, and understanding . He did a great job letting me know what he needed from me. And if I didn’t respond. He would always be persistent, but in a way that was very much appreciated. He did an exceptional job in court each time on my case, and we won. I could not have asked for a better lawyer. I would highly recommend him to any person I know.

What Questions Should I Ask Before Hiring a Lawyer?

Hiring the right lawyer is crucial for the success of your case. Here are some important questions to ask during your initial consultation:

  1. What experience do you have with cases similar to mine?
Ensure the lawyer has relevant experience in the specific area of law pertaining to your case.
  2. How do you charge for your services, and what are the estimated costs?
Understand the fee structure, including hourly rates, flat fees, retainer fees, and any additional expenses.
  3. Who will be handling my case?
Find out if the lawyer will handle your case personally or delegate tasks to other attorneys or paralegals.
  4. What is your approach to resolving cases like mine?
Learn about their strategy, whether they prefer negotiation, mediation, or litigation.
  5. What potential outcomes can I expect?
While no lawyer can guarantee results, they can provide an assessment of possible scenarios based on their experience.
  6. How will you communicate with me throughout the process?
Establish expectations for updates, preferred communication methods, and response times.
  7. What is the expected timeline for my case?

Can a Lawyer Represent Me in Courts Outside of Edina, Minnesota?

Whether a lawyer can represent you in courts outside of your city or state depends on their licensure and the jurisdiction of the court:

  • Within the Same State:
Lawyers licensed in a particular state can typically practice anywhere within that state, including all cities and counties. They can represent you in both state and federal courts located in that state.
  • Outside of Their Licensed State:
If your case is in a different state, the lawyer must be licensed in that state to represent you. However, there are exceptions:
    • Pro Hac Vice Admission: An out-of-state lawyer can request special permission to represent a client in a specific case in another state. This requires filing a motion with the court and often working in conjunction with a local attorney.
    • Federal Courts: If your case is in federal court, a lawyer licensed in any state may be able to represent you, provided they are admitted to practice in that particular federal court.
  • International Representation:
For cases outside the United States, different rules apply, and the lawyer may need to comply with the foreign country's legal requirements or collaborate with local counsel.

It's important to discuss your specific situation with the lawyer to determine if they can represent you in the desired jurisdiction and what steps may be necessary to do so.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  • Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing. Most state bar websites have an online directory for this purpose.
  • Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case. Review their website, professional profiles, and case history.
  • Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association's records.
  • Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, Google, or Yelp to gauge client satisfaction and experiences.
  • Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field and adherence to high ethical standards.
  • Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation in the legal community.
  • Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  • Ask for References:
A credible lawyer should be willing to provide references from past clients who can speak to their abilities and professionalism.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  • Relevant Documents:
Bring all documents related to your case, such as:
    • Contracts or agreements
    • Correspondence (emails, letters, texts)
    • Legal notices or court papers
    • Financial records (if applicable)
    • Evidence (photos, videos, receipts)
  • Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and parties involved. This helps the lawyer quickly understand the context.
  • List of Questions:
Write down any questions you have about your case, the legal process, fees, or the lawyer's experience.
  • Financial Information:
If your case involves financial matters, bring relevant documents like pay stubs, tax returns, bank statements, or invoices.
  • Contact Information:
Provide details of any witnesses or other parties relevant to your case, including their names and contact information.
  • Personal Identification:
Bring a valid photo ID for verification purposes.
  • Pen and Notebook:
Take notes during the consultation to remember important points discussed.
  • Budget Constraints:
Be ready to discuss your budget and any financial limitations so the lawyer can provide appropriate guidance on fees and payment options.
  • Openness and Honesty:
Be prepared to discuss your case candidly. Full disclosure allows the lawyer to give accurate advice and anticipate potential challenges.
