Date: 11/23/2024 Title: In Response to the Firm’s Reply Regarding Attorney Colby B. Lund Thank you for your reply to my review. However, your response does not address the core issue: Mr. Colby B. Lund intentionally altered the language of a legal settlement agreement, changing “cannot be deemed” to “can be deemed.” This was a calculated act, not an oversight, and was clearly done to create a false threat and manipulate the situation. While you mention that the Minnesota Board of Professional Responsibility dismissed my complaint, this dismissal does not absolve Mr. Lund of his unethical behavior. In fact, it highlights systemic failures within the Office of Lawyers Professional Responsibility (OLPR) and the Lawyers Professional Responsibility Board (LPRB). These oversight bodies not only failed to investigate clear evidence of ethical violations but also demonstrated negligence, such as the LPRB Chair’s shocking misidentification of Mr. Lund as “Mr. Young” in their official response. Your reliance on the fact that my complaint was dismissed by these agencies only raises more questions. An apology, informal or otherwise, from Mr. Lund does not erase wrongdoing or excuse his misconduct. Accountability is not negated simply because Mr. Lund admitted his misquote (or intentional lying). In fact, Mr. Lund’s informal apology and acknowledgment of his misquote is not a defense but rather strong EVIDENCE of his misconduct. His deliberate falsification of a legal document violates ethical rules and should have prompted a thorough investigation and appropriate disciplinary action. It is disappointing to see both the oversight agencies and your firm dismissing the seriousness of these actions instead of addressing them transparently. Are you willing to defend Mr. Lund’s actions on ethical grounds, or are you simply leaning on procedural dismissals to avoid accountability? Your firm states on its website that "We are committed to being honest and respectful in all aspects of our work.". However, defending Mr. Lund without addressing the clear ethical violations he committed contradicts these values. I urge you to take this matter seriously and act in accordance with the principles you claim to uphold. For transparency, I have also documented my experiences with the OLPR and LPRB in a public review to highlight the systemic issues that have allowed this unethical behavior to go unchecked. Sincerely, ---------------------------------------------- [Original review] This review is intended specifically for Colby B. Lund, who works at Arthur, Chapman, Kettering, Smetak & Pikala, PA, and not for the firm as a whole. My experience with Colby B Lund was absolutely alarming and deeply troubling. In a legal matter, Mr Lund blatantly and deliberately altered the language of a legal settlement agreement, changing the term 'cannot be deemed' to 'can be deemed.' This was not an oversight or mistake, it was a calculated and intentional act by a senior attorney. His actions were not only unethical but outright terrible and showed a shocking disregard for the integrity expected of someone in his position. His clear intention was to manipulate the terms to create a false threat, which is unacceptable and should raise serious concerns for anyone considering his services. As a senior attorney, Mr Lund should exemplify honesty and professionalism, but instead, his behavior was horrible and showed a complete lack of basic principles. Such misconduct is alarming and should not go without consequences. If you are considering hiring Mr B Lund, I strongly urge you to think twice. My experience revealed a blatant lack of ethical conduct and integrity, qualities that are essential in any attorney.

I broke my hip May 1, 2022 and Kristen Taft is the defense attorney and also a Broker with this firm. My lawyer Gretchen Hall has been trying to close my case for a while now. Kristen Taft has ignored my lawyer's email's and phone calls for 4 months. I've lost my house, car and my lively hood since this injury at work. This law firm doesn't care about what happens to someone who isn't their client, so if they have that mentality, how can they care about anyone except themselves and the firm. I've lived on the streets and shelters. This claim settlement won't make me rich but, it'll help me get on my feet with my family. The arrogance that my lawyer and I have experienced is rooted deeply in this firm. Don't get me wrong, we have only dealt with Kristen Taft but, the saying goes! Birds of a feather flaps together! I would be very wary of this lawfirm for anything they offer!

Beth and her firm provided excellent support during my employment situation with my previous employer. She inquired as to the situation, requested summary information and provided a variety of options. She was strategic in her guidance and the situation was successfully resolved.

I am an independent contractor - commissioned sales rep - and wanted advice about choice of law and where would be the best location to file a lawsuit for unpaid commissions. Craig helped me by analyzing my potential claim and the applicabilty of Minnesota laws to my case. Specifically, he addressed the Minnesota Termination of Sales Representatives Act and Minnesota Statutes 181.145 as it might apply to a contractor not located in or having territory including Minnesota (the company not paying commissions is located in MN). He was able to boild down a stack of paperwork to the most important details in a very short period of time. Craig was honest, clear, puctual and truly had my best interests in mind during our meetings. The entire staff, especially Kelly Fiege, were very helpful and supportive. I recommend Craig for any contract or commision related dispute that a person may have.

I am a medical device salesperson in New York facing issues surrounding termination of employment by a Minnesota company, negotiating a severance package, and modifying restrictions under a non-compete agreement. Craig is a true professional with his realistic advise and take charge attitude..

I consider calling Craig Trepanier to represent me to be one of the best decisions I have made. Craig Trepanier and Mike McCain completely immersed themselves in the intricacies of my case and worked tirelessly to achieve a favorable outcome. They were sensitive to the fact that I had limited resources available with which to defend myself, and always gave candid, sound advice about how best to use those resources. In the course of my legal case I quickly learned that there is a huge range in the quality of representation provided by different employment law firms. I absolutely recommend Trepanier & MacGillis to anyone involved in an employment law dispute.

Over the 13 years I’ve known and worked with Elliot, I have come to understand his passion for the practice of law and unique/difficult personal injury cases. He is energized to learn new things in order to fully understand the intricacies of a case. He is intelligent, organized, down to earth, compassionate and extremely kind. Because I have the utmost trust in him, I have referred several people to Elliot over the years and if the day comes that I need him, he’ll be my only call.

Hiring the right lawyer is crucial for the success of your case. Here are some important questions to ask during your initial consultation:

  1. What experience do you have with cases similar to mine?
Ensure the lawyer has relevant experience in the specific area of law pertaining to your case.
  2. How do you charge for your services, and what are the estimated costs?
Understand the fee structure, including hourly rates, flat fees, retainer fees, and any additional expenses.
  3. Who will be handling my case?
Find out if the lawyer will handle your case personally or delegate tasks to other attorneys or paralegals.
  4. What is your approach to resolving cases like mine?
Learn about their strategy, whether they prefer negotiation, mediation, or litigation.
  5. What potential outcomes can I expect?

Can a Lawyer Represent Me in Courts Outside of Minneapolis, Minnesota?

Whether a lawyer can represent you in courts outside of your city or state depends on their licensure and the jurisdiction of the court:

  • Within the Same State:
Lawyers licensed in a particular state can typically practice anywhere within that state, including all cities and counties. They can represent you in both state and federal courts located in that state.
  • Outside of Their Licensed State:
If your case is in a different state, the lawyer must be licensed in that state to represent you. However, there are exceptions:
    • Pro Hac Vice Admission: An out-of-state lawyer can request special permission to represent a client in a specific case in another state. This requires filing a motion with the court and often working in conjunction with a local attorney.
    • Federal Courts: If your case is in federal court, a lawyer licensed in any state may be able to represent you, provided they are admitted to practice in that particular federal court.
  • International Representation:
For cases outside the United States, different rules apply, and the lawyer may need to comply with the foreign country's legal requirements or collaborate with local counsel.

It's important to discuss your specific situation with the lawyer to determine if they can represent you in the desired jurisdiction and what steps may be necessary to do so.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  • Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing. Most state bar websites have an online directory for this purpose.
  • Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case. Review their website, professional profiles, and case history.
  • Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association's records.
  • Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, Google, or Yelp to gauge client satisfaction and experiences.
  • Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field and adherence to high ethical standards.
  • Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation in the legal community.
  • Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  • Ask for References:
A credible lawyer should be willing to provide references from past clients who can speak to their abilities and professionalism.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  • Relevant Documents:
Bring all documents related to your case, such as:
    • Contracts or agreements
    • Correspondence (emails, letters, texts)
    • Legal notices or court papers
    • Financial records (if applicable)
    • Evidence (photos, videos, receipts)
  • Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and parties involved. This helps the lawyer quickly understand the context.
  • List of Questions:
Write down any questions you have about your case, the legal process, fees, or the lawyer's experience.
  • Financial Information:
If your case involves financial matters, bring relevant documents like pay stubs, tax returns, bank statements, or invoices.
  • Contact Information:
Provide details of any witnesses or other parties relevant to your case, including their names and contact information.
  • Personal Identification:
Bring a valid photo ID for verification purposes.
  • Pen and Notebook:
Take notes during the consultation to remember important points discussed.
  • Budget Constraints:
Be ready to discuss your budget and any financial limitations so the lawyer can provide appropriate guidance on fees and payment options.
  • Openness and Honesty:
Be prepared to discuss your case candidly. Full disclosure allows the lawyer to give accurate advice and anticipate potential challenges.
