I highly recommend Traci Capistrant and Capistrant Law if you need representation for a high conflict divorce case. I am so very grateful to Traci and her whole team for the enormous amount of excellent work, communication, patience and care that they put into my case. Traci has represented me for the past 6 years, and done an exceptional job. My case has been extremely long, complicated, messy, frustrating and difficult. Through it all, I have been so impressed with Traci's ability to listen well, remain focused and take action. She is kind and caring, gives good advice and is an excellent attorney. This has been the most difficult period in my life, and without Traci and Capistrant Law, I don't know where I would be now. There were times I didn't think I could go on, and Traci and her team were a constant support for me through everything. She is a woman with high character and an attorney that I call friend:) I don't think I would be standing today if it weren't for her. I was just awarded sole legal and sole physical custody of my children, which would not be possible without Traci and her team. THANK YOU Capistrant Law!!

Traci helped me through a very difficult divorce. Always prepared and with thoughtful wisdom, she helped me navigate very difficult waters. Because of her excellent preparation as well as a very comfortable and casual style, the referee in our case always listened to her carefully, with obvious respect. I recommend her without reservation !

Traci is an all-around extraordinary woman, she from the very beginning took the time to understand the particulars of my case and advised me with the best possible outcomes at every turn. Traci took over my case after my first attorney had totally dropped the ball. She then recovered the lost ground and got me to where I needed to be. In the courtroom: She was a rockstar. Being represented by her confidence and strength, I overcame my fear and anxiety while sitting next to her in the courtroom. She maintained the highest coordination with the opposing counsel. In Traci’s office: Every time I met her in her office, she was warm, kind, and patient. She understood my case and my (on-going separation) emotions so well and gave me valuable advice to handle my ex-spouse, which was the sanest thing possible in that situation. So she was also my personal counselor :) She genuinely cares about her clients. She's focused and passionate about her work, doing what is right and fair for all. Overall: Traci pretty much achieved everything I needed out of my divorce financially, child custody, and helped build an amazing court order. She was calm, composed and collective during the hearings we had, and she never failed or disappointed me. I felt I put my life and my daughter’s life in her hands and she took care of us all the way. I do not have enough positive words to describe what an incredible job Traci did with my case, and I truly couldn’t have gotten through this painful time of my life without her support and expertise. Alex and Sue from Traci’s legal team were prompt and went above and beyond for all my requests. 6 months post-divorce now, and I’m still trying to move on - but looking back at those dark days of divorce and child custody battles, I would have to say that Traci and her team were like the angels watching over my shoulders. Thank you once again, Capistrant Law.

October, 2016 -- A year ago, the decision to divorce was made. A friend referred me to Traci Capistrant. It was a difficult time. I immediately felt at lease with Traci. She is clear. She is highly knowledgeable. And she is very professional. During the course of the past 12 months, Traci took the reigns and executed the divorce process most effectively, keeping me fully informed every step along the way. I was so relieved! And I felt very well treated and very reasonably charged. Working with Traci was the experience of working with a top-flight attorney. Also, special acknowledgement must be made about Traci's staff, particularly Alex. Alex is also communicative and professional. Traci Capistrant runs a high-quality law firm. Traci and her staff receive my strongest endorsement.

I am an independent contractor - commissioned sales rep - and wanted advice about choice of law and where would be the best location to file a lawsuit for unpaid commissions. Craig helped me by analyzing my potential claim and the applicabilty of Minnesota laws to my case. Specifically, he addressed the Minnesota Termination of Sales Representatives Act and Minnesota Statutes 181.145 as it might apply to a contractor not located in or having territory including Minnesota (the company not paying commissions is located in MN). He was able to boild down a stack of paperwork to the most important details in a very short period of time. Craig was honest, clear, puctual and truly had my best interests in mind during our meetings. The entire staff, especially Kelly Fiege, were very helpful and supportive. I recommend Craig for any contract or commision related dispute that a person may have.

I consider calling Craig Trepanier to represent me to be one of the best decisions I have made. Craig Trepanier and Mike McCain completely immersed themselves in the intricacies of my case and worked tirelessly to achieve a favorable outcome. They were sensitive to the fact that I had limited resources available with which to defend myself, and always gave candid, sound advice about how best to use those resources. In the course of my legal case I quickly learned that there is a huge range in the quality of representation provided by different employment law firms. I absolutely recommend Trepanier & MacGillis to anyone involved in an employment law dispute.

  4. What is your approach to resolving cases like mine?
Learn about their strategy, whether they prefer negotiation, mediation, or litigation.

Can a Lawyer Represent Me in Courts Outside of Minneapolis, Minnesota?

Whether a lawyer can represent you in courts outside of your city or state depends on their licensure and the jurisdiction of the court:

  • Within the Same State:
Lawyers licensed in a particular state can typically practice anywhere within that state, including all cities and counties. They can represent you in both state and federal courts located in that state.
  • Outside of Their Licensed State:
If your case is in a different state, the lawyer must be licensed in that state to represent you. However, there are exceptions:
    • Pro Hac Vice Admission: An out-of-state lawyer can request special permission to represent a client in a specific case in another state. This requires filing a motion with the court and often working in conjunction with a local attorney.
    • Federal Courts: If your case is in federal court, a lawyer licensed in any state may be able to represent you, provided they are admitted to practice in that particular federal court.
  • International Representation:
For cases outside the United States, different rules apply, and the lawyer may need to comply with the foreign country's legal requirements or collaborate with local counsel.

It's important to discuss your specific situation with the lawyer to determine if they can represent you in the desired jurisdiction and what steps may be necessary to do so.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  • Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing. Most state bar websites have an online directory for this purpose.
  • Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case. Review their website, professional profiles, and case history.
  • Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association's records.
  • Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, Google, or Yelp to gauge client satisfaction and experiences.
  • Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field and adherence to high ethical standards.
  • Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation in the legal community.
  • Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  • Ask for References:
A credible lawyer should be willing to provide references from past clients who can speak to their abilities and professionalism.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  • Relevant Documents:
Bring all documents related to your case, such as:
    • Contracts or agreements
    • Correspondence (emails, letters, texts)
    • Legal notices or court papers
    • Financial records (if applicable)
    • Evidence (photos, videos, receipts)
  • Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and parties involved. This helps the lawyer quickly understand the context.
  • List of Questions:
Write down any questions you have about your case, the legal process, fees, or the lawyer's experience.
  • Financial Information:
If your case involves financial matters, bring relevant documents like pay stubs, tax returns, bank statements, or invoices.
  • Contact Information:
Provide details of any witnesses or other parties relevant to your case, including their names and contact information.
  • Personal Identification:
Bring a valid photo ID for verification purposes.
  • Pen and Notebook:
Take notes during the consultation to remember important points discussed.
  • Budget Constraints:
Be ready to discuss your budget and any financial limitations so the lawyer can provide appropriate guidance on fees and payment options.
  • Openness and Honesty:
Be prepared to discuss your case candidly. Full disclosure allows the lawyer to give accurate advice and anticipate potential challenges.
