I have been retained to recover Mr. Rubin's initial retainer that he paid you to represent him in the N.J. criminal matter and to investigate any potential malpractice. Mr. Rubin is entitled to zealous representation pursuant to the N.J. Rules of Professional Conduct. Mr. Rubin hired you to arrange a pre-indictment meeting with the ADA to discuss exculpatory evidence and to work with the ADA to dismiss this case. Mr. Rubin discussed with you that the allegations against him are entirely false and that unless the charges are dropped, he needs an attorney ready to take his case to trial. After Mr. Rubin paid your initial retainer, you failed to arrange a pre-indictment meeting and stopped answering Mr. Rubin's phone calls. Mr. Rubin called the prosecutor's office and was told that although they are ready and willing to speak with Mr. Rubin's counsel, no one from your office ever contacted them. Furthermore, when Mr. Rubin tried to contact your office, you did not answer his calls and refused to speak with him. As a result of your lack of diligence, Mr. Rubin has been prejudiced and has lost the opportunity to resolve his case pre-indictment. He will now have to spend more money on his representation. He will not send you a substitution of counsel form because he has not hired counsel yet. Therefore, please file a motion to withdraw immediately and notify the Court that you have been relieved as counsel by the Defendant. Send Mr. Rubin his funds back today; otherwise, he will file a bar complaint and civil action against you. My wire instructions are enclosed.
