I have worked with the Law Office of James Miner since 2006 until 2024. During the 18 years span, James and his team, provided excellent service for the purchase and sale of 2 NJ homes. They are not only knowledgeable, but courteous and quick to respond to questions providing excellent customer service. Now that we moved to MA, I hope to find a real estate legal office that can provide such great level of service. Thanks Jim ad Tim for all your help over this years. I am so glad to witness how much the office ha grown, which is in itself a testament of the great job you do.

We had such a great experience with Jim and his team! We worked with Jim on the purchase of our condo a few years ago and decided to work with his team again when we were looking to move to new home because of our experience with them. Our new home purchase was a new construction home, and we could not have an agent represent us in the purchase so that heightened our concerns initially. However, Jim and his team put those concerns to rest fairly easily. They were there for us every step of the way – no matter how many questions we had or how many times we reached out, Jim and his team were always there to answer. Their breadth of experience made us feel so comfortable about every decision we made. From initially entering into the contract, all the way until closing a few months later, Jim always stayed in touch to ensure things were moving along as we expected or if there was anything we needed further clarification on. As we get closer to the closing date and things moved quickly, Jim and his team were always very timely in responding to any requests, whether from the bank, builder’s attorney, builder’s rep, etc. When we finally got to closing day, as nervous as we were, Jim made the process seem effortless. He was well prepared with everything we needed, knew exactly where and what we had to sign and where it needed to go. We finished all our paperwork for the closing surprisingly quickly due to Jim’s preparedness. We had such a great experience with his team that we decided to have them represent us in the sale of our current home as well. We would highly recommend Jim and his team to anyone looking for a trustworthy, reliable, and experienced real estate attorney. They’re the best!

I used the Law Office of James Miner on the sale of my home (this was my first time selling a home). Everything was explained to me up front in a clear and professional manner. Any question (email or phone call) was never a bother. Jim and Elise made this stressful process very easy for me. I am grateful for their service and will definitely recommend/use again if purchasing another home is in my future! Thank you again!

Darin Pinto is an extremely knowledgeable attorney and was extremely helpful when foreclosure of my home was evident. He lead my wife and I through the process and assisted in reducing our stress level. He was always available to talk and provided a sense of comfort knowing we were in good hands. He has been my attorney for the past thirteen years assisting with other financial issues including bankruptcy. I have always been satisfied with his services and that of his staff. He supports his clients with a can do attitude and brings about the best possible resolution.

My wife and I moved from out-of-state and were connected with Darin through our real estate agent (she gave us a list of 4-5 names). I called a couple of the names on the list and they all seemed great, but I knew Darin was our guy within a minute of talking to him. I think the main thing I'd underscore about Darin (among many other strengths) is that he just puts you at ease. I won't be trite and say that Darin makes you feel like he's helping a family member, but he comes pretty darn close. The home buying process is extremely stressful -- even if you've done it before -- and we just felt like we didn't have anything to worry about legally in going with Darin. Besides having such a great demeanor, Darin is extremely knowledgable, responsive, assertive when he has to be, and just overall was a pleasure to work with. I honestly can't recommend Darin more (to the point where I'm taking time on Memorial Day weekend to hopefully help someone else find a great lawyer).

In turning to Mr Strauss I was feeling very vulnerable, in pain, and like I was at a dead end in being able to get the help I needed. Mr Strauss and staff were very helpful to facilitate the care I needed to stabilize my health. Mr Strauss always reviewed all the facts, the pros and cons to any situation that arose, and helped me navigate the complexity of what my rights were to get the care I needed to be able to function again. Mr Strauss was able to settle my case reasonably and without having to go through a lengthy litigation process. I feel he was able to negotiate and settle the matter that he was handling with my best interest in mind at all times. Thank you again for a job well done. If I ever needed your assistance again or knew anyone who did I would certainly call or recommend without hesitation.

He works hard, always with your best interests at heart. Mr. Strauss referred me to a doctor who has been invaluable to my treatment and recovery, as he is very knowledgeable of many in the medical profession. I strongly recommend him. He is a pleasure to deal with and comforting to have by your side when feeling most vulnerable.

What Questions Should I Ask Before Hiring a Lawyer?

Hiring the right lawyer is crucial for the success of your case. Here are some important questions to ask during your initial consultation:

  1. What experience do you have with cases similar to mine?
Ensure the lawyer has relevant experience in the specific area of law pertaining to your case.
  2. How do you charge for your services, and what are the estimated costs?
Understand the fee structure, including hourly rates, flat fees, retainer fees, and any additional expenses.
  3. Who will be handling my case?
Find out if the lawyer will handle your case personally or delegate tasks to other attorneys or paralegals.
  4. What is your approach to resolving cases like mine?
Learn about their strategy, whether they prefer negotiation, mediation, or litigation.
  5. What potential outcomes can I expect?
While no lawyer can guarantee results, they can provide an assessment of possible scenarios based on their experience.

Can a Lawyer Represent Me in Courts Outside of Westfield, New Jersey?

Whether a lawyer can represent you in courts outside of your city or state depends on their licensure and the jurisdiction of the court:

  • Within the Same State:
Lawyers licensed in a particular state can typically practice anywhere within that state, including all cities and counties. They can represent you in both state and federal courts located in that state.
  • Outside of Their Licensed State:
If your case is in a different state, the lawyer must be licensed in that state to represent you. However, there are exceptions:
    • Pro Hac Vice Admission: An out-of-state lawyer can request special permission to represent a client in a specific case in another state. This requires filing a motion with the court and often working in conjunction with a local attorney.
    • Federal Courts: If your case is in federal court, a lawyer licensed in any state may be able to represent you, provided they are admitted to practice in that particular federal court.
  • International Representation:
For cases outside the United States, different rules apply, and the lawyer may need to comply with the foreign country's legal requirements or collaborate with local counsel.

It's important to discuss your specific situation with the lawyer to determine if they can represent you in the desired jurisdiction and what steps may be necessary to do so.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  • Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing. Most state bar websites have an online directory for this purpose.
  • Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case. Review their website, professional profiles, and case history.
  • Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association's records.
  • Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, Google, or Yelp to gauge client satisfaction and experiences.
  • Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field and adherence to high ethical standards.
  • Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation in the legal community.
  • Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  • Ask for References:
A credible lawyer should be willing to provide references from past clients who can speak to their abilities and professionalism.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  • Relevant Documents:
Bring all documents related to your case, such as:
    • Contracts or agreements
    • Correspondence (emails, letters, texts)
    • Legal notices or court papers
    • Financial records (if applicable)
    • Evidence (photos, videos, receipts)
  • Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and parties involved. This helps the lawyer quickly understand the context.
  • List of Questions:
Write down any questions you have about your case, the legal process, fees, or the lawyer's experience.
  • Financial Information:
If your case involves financial matters, bring relevant documents like pay stubs, tax returns, bank statements, or invoices.
  • Contact Information:
Provide details of any witnesses or other parties relevant to your case, including their names and contact information.
  • Personal Identification:
Bring a valid photo ID for verification purposes.
  • Pen and Notebook:
Take notes during the consultation to remember important points discussed.
  • Budget Constraints:
Be ready to discuss your budget and any financial limitations so the lawyer can provide appropriate guidance on fees and payment options.
  • Openness and Honesty:
Be prepared to discuss your case candidly. Full disclosure allows the lawyer to give accurate advice and anticipate potential challenges.
