After a very difficult year and 5,000 mile relocation to NC with my two small children, I was very nervous about my financial future and protecting my children's future. Peter facilitated this transition and guided me through the estate planning process. It was a relaxing and very professional atmosphere. Peter pointed out other aspects of financial planning that I had not even considered and put me in touch with several other professional associates. The process went very quickly. Directions were complete and thorough. I look forward to a long relationship with this firm.

In the handling of my estate and personal legal concerns Peter McGuire has suggested different courses of action, and explained each in a manner that is understandable. Within the direction I decided upon, my concerns were addressed, the consequences of each course of action explained, and the final documents have been prepared promptly. P ayment was not accepted or asked for until I was satisfied.

When I finally found Peter I had met with Three other attorneys and after six weeks had been no further on in setting up two trusts for my wife and I. I was frustrated and could not believe the lack of professional courtesy. The first meeting with Peter was very informative and totally relaxing. I explained what I was trying to achieve and he took the ball and ran with it. By the second meeting (just one week later) with my wife the trust was ready to be finalized. One week later our trusts were complete and Peter throughly reviewed the trusts again with us. I'm extremely impressed with Peter's concern that our trusts were drawn up properly and that they addressed all our concerns and needs.

I met Peter on very short notice; that is, I needed the advice and counsel of a litigator very quickly, and Peter chiseled a hole in his schedule to see me within two days. Within that two day period, he had thoroughly reviewed a good deal of documentation on a complicated Trust matter, and so was prepared no only to hear me out, which was all that I had expected, but to offer suggestions and advice on the spot. His suggestions were clear, and could be easily implemented. I was required to take action within a matter of days, and Peter reviewed and followed through on the work that had been done, catching things that I had missed after hours of review. I enjoy working with Peter, and hope to do so again.

I have been affiliated with The McKinney Law Group both personally and professionally for a number of years now. Damien is tough when it comes to the cases he handles, all while maintaining ultimate professionalism and a pleasant demeanor that makes him wonderful to work with. An expert in both FL and NC laws, he steps up to bat for his clients and always aims to achieve the best possible results for them.

I hired James Mills to represent my case for a DWI refusal to blow. I was in a severe car accident and was unable to comply due to my injuries. However, I did refuse medical help so I was arrested and taken to jail. I spoke with James within a few days of my arrest and he said we had a strong case but he would not guarantee my outcome. He understood the law well and informed me of what my options were. Because my case was in a county outside of where he primarily works I did have to sit in court 6 times due to continuances because he was unable to make the appearance. With that being said, we met before my trial in his office and I felt prepared and confident with him as my attorney. The day of my trial, the arresting trooper made several untrue allegations and James was still able to keep the trial on track. He was Thorough and I was found not guilty by the judge. I am very confident that James is a great attorney and will get the job done. My only recommendation if you hire him is to not expect him to hold your hand. I didn't hear from him much and this being my first time in court, made me nervous because I wasn't sure how the court system worked and what to expect. He did what he was hired to do and he was very kind and very affordable. I would highly recommend him.

Can a Lawyer Represent Me in Courts Outside of Asheville, North Carolina?

Whether a lawyer can represent you in courts outside of your city or state depends on their licensure and the jurisdiction of the court:

  • Within the Same State:
Lawyers licensed in a particular state can typically practice anywhere within that state, including all cities and counties. They can represent you in both state and federal courts located in that state.
  • Outside of Their Licensed State:
If your case is in a different state, the lawyer must be licensed in that state to represent you. However, there are exceptions:
    • Pro Hac Vice Admission: An out-of-state lawyer can request special permission to represent a client in a specific case in another state. This requires filing a motion with the court and often working in conjunction with a local attorney.
    • Federal Courts: If your case is in federal court, a lawyer licensed in any state may be able to represent you, provided they are admitted to practice in that particular federal court.
  • International Representation:
For cases outside the United States, different rules apply, and the lawyer may need to comply with the foreign country's legal requirements or collaborate with local counsel.

It's important to discuss your specific situation with the lawyer to determine if they can represent you in the desired jurisdiction and what steps may be necessary to do so.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  • Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing. Most state bar websites have an online directory for this purpose.
  • Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case. Review their website, professional profiles, and case history.
  • Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association's records.
  • Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, Google, or Yelp to gauge client satisfaction and experiences.
  • Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field and adherence to high ethical standards.
  • Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation in the legal community.
  • Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  • Ask for References:
A credible lawyer should be willing to provide references from past clients who can speak to their abilities and professionalism.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  • Relevant Documents:
Bring all documents related to your case, such as:
    • Contracts or agreements
    • Correspondence (emails, letters, texts)
    • Legal notices or court papers
    • Financial records (if applicable)
    • Evidence (photos, videos, receipts)
  • Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and parties involved. This helps the lawyer quickly understand the context.
  • List of Questions:
Write down any questions you have about your case, the legal process, fees, or the lawyer's experience.
  • Financial Information:
If your case involves financial matters, bring relevant documents like pay stubs, tax returns, bank statements, or invoices.
  • Contact Information:
Provide details of any witnesses or other parties relevant to your case, including their names and contact information.
  • Personal Identification:
Bring a valid photo ID for verification purposes.
  • Pen and Notebook:
Take notes during the consultation to remember important points discussed.
  • Budget Constraints:
Be ready to discuss your budget and any financial limitations so the lawyer can provide appropriate guidance on fees and payment options.
  • Openness and Honesty:
Be prepared to discuss your case candidly. Full disclosure allows the lawyer to give accurate advice and anticipate potential challenges.
