I recently consulted with Bryan Tyson regarding an ERISA health care claim. Bryan was ultimately able to get the claim resolved through a non-legal process, which took a lot of anxiety off our family’s plate. I would highly recommend Bryan and Marcellino & Tyson for any ERISA/employee benefits issues, including health insurance

I was referred to Marcellino & Tyson by another law firm on a matter regarding my former employer. I paid the consultation fee and was shown to a conference room where I was kept waiting for over 30 minutes past our scheduled time to meet. I was finally greeted by two attorneys as I was preparing to leave. I provided them an overview of my situation and expressed a desire to seek a legal remedy. The senior attorney, Bryan Tyson, asked for internal documents which would be key in determining next steps.
I subsequently provided the documents and heard nothing from him for six weeks. I sent him a follow up email re-stating my desire to move forward and two weeks after the fact...radio silence. Completely unprofessional.
A telling exchange during our meeting is indicative of the lack of depth and experience of Mr. Tyson on matters outside of the most basic employment law cases. I researched case law pertaining to my situation and he told me I was up to speed on this matter as it relates to the NC courts and actually began asking me how I thought we should proceed which was shocking to me. I don't have a law degree and he holds himself out to be an employment lawyer.
Based on my experience, I strongly recommend anybody seeking professional guidance based on a thorough examination of all aspects of your situation to seek counsel elsewhere. Integrity and doing what you say you are going to do matters in business and certainly as it relates to sensitive legal issues. I wasted three months as a result of a lack of basic professionalism. In a situation where time matters, you can ill-afford to do the same.

Fortunately, Jennifer Moore plead my case(s), reduced my financial burdens, and enhanced and streamlined my order(s) as such to benefit all parties. Her dedication, procedural knowledge, court room demeanor, coupled with her diligence and moral center exceeded my expectations. A keen ability to read into an opposing attorney's strategy (even during examination/court) is another key asset Jennifer wielded, and proved our case.

I recently contacted this firm and paid a $400 consultation fee to speak with Attorney Tyson in reference to a thoroughly documented and pretty significant employment concern. I sent the firm a 12 page employee statement I’d drafted that included all relevant evidence for my case 10 days in advance of my scheduled appointment. At the time of my consultation, I had to reach out to the office myself to find out what was happening regarding my scheduled appointment as they were late and then was greeted by an attorney who was not the attorney I was originally prepared to speak with (I also know hourly rates differ from Partners to Senior Counsel to Staff Attorneys, etc.) so had concerns regarding overpaying. I was then notified that Attorney Tyson was preparing for a “big case” and couldn’t be available to speak with me that day. Why not communicate to me proactively and allow me to make an informed decision about how I’d like to proceed vs. switching up things at the last minute? Totally unprofessional. From the onset, the attorney I spoke to seemed bent on providing advice to dissuade me from seeking their representation. In addition to that, I had two additional consults with other employment attorneys where they provided far CLEARER guidance on how they could work to effectively expedite the EEOC charge process by completing documentation on my behalf to get the charge processed and none of that was presented to me here. She continued to say we would do this on an hourly basis only. On what grounds? There appear to be atypical handling of employment cases at this firm based on my limited experience. I would not do business with this firm in any capacity based on how they handled me, the level of advice provided, and ultimately the fee arrangement that she couldn’t seem to solidify on the call.
