Marcia Stewart represented me for family court. From the moment I spoke with Marcia, she put my fears at ease, and brought a sense of calm, common sense, knowledge, fairness, and compromise to our situation. In court, she expressed our situation so eloquently and organized, and her knowledge and understanding of the legal system was amazing. When you are in a position of having to search for an attorney, finding the “right” attorney is key, and can be a very difficult task. Marcia Stewart not only exceeded my expectations with representation, but she was my personal advocate. The service she provided my family was priceless!

Since my divorce it was very difficult adjusting to the fact that I wouldn't get to see my son everyday like I was used too. In the beginning I worked six days a week so when I was served with custody papers from my sons mother I had no way of getting around anything because of my job. Every other weekend really took a toll on me. Constantly calling my sons mother trying to work out a schedule to see him here and there besides every other weekend always ended in a argument, followed by a hang-up, and "NO" answer when I tried to call back. This literally drained me of my life, and sense of self, and I was lost. So I got a better job with a flexible schedule that could possibly help my situation.I thought "now all I needed was to find a good lawyer". I found two different lawyers and payed my "consultation fees" to both. I got the same results. They didn't even act like they wanted to hear it and didn't care to help. So basically I had nothing. I was so disappointed. One day I was talking with a friend about it and he told me to contact Marcia Stewart. He said she is the best and is fair and honest. Well that is exactly what I did and I just have to say that it was one of the best decisions that I have ever made it my life. She got everything worked out for me. I now feel like I have my life back and can be the father I have always dreamed of being to my son. Thank you Marcia, you changed my life so much.

Simply put, I had a complex case that required lots of detailed review and evidence. Marcia and her staff took the time to understand the situation and prepared the evidence to make a potentially messy situation very clear. Her representation not only gave me the confidence to fight for my parental rights, but also won those rights back. Would I recommend her? Without a doubt!!

Attorney Charlene Nelson, my family is very proud of the way you handled our case. You were very professional and knowledgeable in every area of the law. The way that you presented the case was spot on. The Judge in the case was very impressed with the way you presented the case before him. It didn’t take long for the judge to realize that the officers involved in the case were totally out of order in the way they handled themselves. We thank you for assuring that justice was served. We wish you continued success in case that comes before you!

I was dealing with a family court issue in which I was falsely accused of being in contempt of a court order. Attorney Nelson reviewed my case and sought a dismissal. She was completely successful in getting the judge to dismiss the case. Overall, she was attentive and diligent in her work on my behalf. Thanks!

I had an amazing experience working with Nelson Law Firm. From my first consultation with Ms Nelson I felt so comfortable with her. I was always well informed and thoroughly explained every step of this custody process. Ms Nelson was not only knowledgeable in her field but also welcomed any and all questions I had. I truly felt that she was fighting for me and I would happily refer any of my family and friends to this law firm. I am very thankful that I was able to work with Ms Nelson.

Can a Lawyer Represent Me in Courts Outside of Smithfield, North Carolina?

Whether a lawyer can represent you in courts outside of your city or state depends on their licensure and the jurisdiction of the court:

  • Within the Same State:
Lawyers licensed in a particular state can typically practice anywhere within that state, including all cities and counties. They can represent you in both state and federal courts located in that state.
  • Outside of Their Licensed State:
If your case is in a different state, the lawyer must be licensed in that state to represent you. However, there are exceptions:
    • Pro Hac Vice Admission: An out-of-state lawyer can request special permission to represent a client in a specific case in another state. This requires filing a motion with the court and often working in conjunction with a local attorney.
    • Federal Courts: If your case is in federal court, a lawyer licensed in any state may be able to represent you, provided they are admitted to practice in that particular federal court.
  • International Representation:
For cases outside the United States, different rules apply, and the lawyer may need to comply with the foreign country's legal requirements or collaborate with local counsel.

It's important to discuss your specific situation with the lawyer to determine if they can represent you in the desired jurisdiction and what steps may be necessary to do so.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  • Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing. Most state bar websites have an online directory for this purpose.
  • Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case. Review their website, professional profiles, and case history.
  • Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association's records.
  • Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, Google, or Yelp to gauge client satisfaction and experiences.
  • Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field and adherence to high ethical standards.
  • Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation in the legal community.
  • Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  • Ask for References:
A credible lawyer should be willing to provide references from past clients who can speak to their abilities and professionalism.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  • Relevant Documents:
Bring all documents related to your case, such as:
    • Contracts or agreements
    • Correspondence (emails, letters, texts)
    • Legal notices or court papers
    • Financial records (if applicable)
    • Evidence (photos, videos, receipts)
  • Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and parties involved. This helps the lawyer quickly understand the context.
  • List of Questions:
Write down any questions you have about your case, the legal process, fees, or the lawyer's experience.
  • Financial Information:
If your case involves financial matters, bring relevant documents like pay stubs, tax returns, bank statements, or invoices.
  • Contact Information:
Provide details of any witnesses or other parties relevant to your case, including their names and contact information.
  • Personal Identification:
Bring a valid photo ID for verification purposes.
  • Pen and Notebook:
Take notes during the consultation to remember important points discussed.
  • Budget Constraints:
Be ready to discuss your budget and any financial limitations so the lawyer can provide appropriate guidance on fees and payment options.
  • Openness and Honesty:
Be prepared to discuss your case candidly. Full disclosure allows the lawyer to give accurate advice and anticipate potential challenges.
