During my consult with Josh, we discussed what my goals were for the divorce and I hired him immediately. He was amazing during the process and did a great job keeping me focused on my end goals, and how things would affect my children and tried to keep that as positive as possible during a divorce. The divorce was difficult due to the two parties being on not only different pages, but possibly different books. After our journey together, when we got to the end of the process, Josh got me everything that I wanted at the beginning of the divorce. I would recommend Josh over any other lawyer in the Fargo Morehead area. Not only do you get attorney Nyberg when you hire him, you get his office staff who are courteous, professional, and very knowledgeable as well. The three of them are truly a winning team on so many levels I can’t even truly explain it with words.

Attorney Nyberg did pretty good work. He helped me with custody of my children and worked hard on my case. Lawyers are spendy, but you get what you pay for. I would use him again if I ever found myself needing another attorney. He was professional and friendly throughout!

I had a great initial consultation with Josh. He seemed very knowledgeable and personable, but soon after he showed his true lack of work ethic. During my divorce case, he consistently neglected to post documents and even went on vacation - when he said he'd still be working on my case - during the worst possible time in the proceedings. The documents that weren't posted caused hundreds of dollars in extra fees to accrue, which he said he would cover since it was his fault in the first place, but ultimately, I was charged those fees as "miscellaneous legal fees." In the end, I was coerced into taking a deal which left me essentially in financial ruin due to his carelessness and neglect in explaining the fine legal details of the settlement - a settlement that he claimed was the best possible outcome. I've since had other lawyers look over my case and, quite literally, been laughed at because of how terrible a job Josh did. I never once felt like I was actually heard, was constantly interrupted on the phone, and never felt like he truly cared about my case. Would never, ever recommend, even to an ex-spouse.

Horrible wouldn't recommend. After all the work and information I gave him he did nothing to help this matter go efficiently. Questions went on answered. He didn't even listen we always had to be 1 step ahead of him. remind him of dates. Never had time to talk to review. Please go somewhere else. Children matter he says judge doesn't listen to that and he was trying to do what's best at the time. He didn't. We got the child however other things that needed to be answered clearly were not. So sad

I felt that Joel did a great job and represented me extremely well. I felt that Joel listened to me, evaluated everything that came up and gave me the best legal instructions. I will use Fremstad law again in my future needs when I require an attorney.

I have worked with Fremstad Law since 2011. Both personally and professionally. They have our best interest at heart. They listen to our needs and concerns. They try to direct us to the least expensive solution to solve our needs. They are not just racking up time for a big bill. I've learned a lot from working with them. I'd highly recommend setting up a meeting for a free consult. Actions speak louder than words, let them earn your business the way they earned mine.

Can a Lawyer Represent Me in Courts Outside of Fargo, North Dakota?

Whether a lawyer can represent you in courts outside of your city or state depends on their licensure and the jurisdiction of the court:

  • Within the Same State:
Lawyers licensed in a particular state can typically practice anywhere within that state, including all cities and counties. They can represent you in both state and federal courts located in that state.
  • Outside of Their Licensed State:
If your case is in a different state, the lawyer must be licensed in that state to represent you. However, there are exceptions:
    • Pro Hac Vice Admission: An out-of-state lawyer can request special permission to represent a client in a specific case in another state. This requires filing a motion with the court and often working in conjunction with a local attorney.
    • Federal Courts: If your case is in federal court, a lawyer licensed in any state may be able to represent you, provided they are admitted to practice in that particular federal court.
  • International Representation:
For cases outside the United States, different rules apply, and the lawyer may need to comply with the foreign country's legal requirements or collaborate with local counsel.

It's important to discuss your specific situation with the lawyer to determine if they can represent you in the desired jurisdiction and what steps may be necessary to do so.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  • Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing. Most state bar websites have an online directory for this purpose.
  • Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case. Review their website, professional profiles, and case history.
  • Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association's records.
  • Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, Google, or Yelp to gauge client satisfaction and experiences.
  • Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field and adherence to high ethical standards.
  • Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation in the legal community.
  • Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  • Ask for References:
A credible lawyer should be willing to provide references from past clients who can speak to their abilities and professionalism.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  • Relevant Documents:
Bring all documents related to your case, such as:
    • Contracts or agreements
    • Correspondence (emails, letters, texts)
    • Legal notices or court papers
    • Financial records (if applicable)
    • Evidence (photos, videos, receipts)
  • Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and parties involved. This helps the lawyer quickly understand the context.
  • List of Questions:
Write down any questions you have about your case, the legal process, fees, or the lawyer's experience.
  • Financial Information:
If your case involves financial matters, bring relevant documents like pay stubs, tax returns, bank statements, or invoices.
  • Contact Information:
Provide details of any witnesses or other parties relevant to your case, including their names and contact information.
  • Personal Identification:
Bring a valid photo ID for verification purposes.
  • Pen and Notebook:
Take notes during the consultation to remember important points discussed.
  • Budget Constraints:
Be ready to discuss your budget and any financial limitations so the lawyer can provide appropriate guidance on fees and payment options.
  • Openness and Honesty:
Be prepared to discuss your case candidly. Full disclosure allows the lawyer to give accurate advice and anticipate potential challenges.
