Over the years I've learned to seek wise counsel when you're not sure how to do something. Seeking Erich out was the best decision I made in regards to my child support case. Erich is kind, soft spoken, and fully knowledgeabe about the law. He was able to prepare me for trial and keep me calm. I appreciate your kindness and support. If I need help in the future, you will be the first person I call.

Erich is an EXCELLENT attorney and anyone needing his service would be wise to hire him. Erich assisted me with a case that required attention to detail. On our first meeting, Erich was able to accurately assess my outcome, giving me peace of mind that other attorneys simply could not. For this, it was MONEY WELL SPENT when I was potentially facing extensive jail time and a long probation period. Erich's demeanor and knowledge of Massillon's court system ensured that I knew what to expect, how to navigate the strained resources of the current legal system, and reassurance when I needed bodycam footage. Affordability was also an issue, as my case had affected my financial standing while I reassembled my life. Eric's rates were absolutely reasonable and I felt he provided value that FAR exceeded what other attorneys were capable of. Ultimately, Erich's patience when dealing with me (I can be a handful) ensured that I was able to get the lowest possible charge possible. While I know in my heart of hearts that I was innocent, the legal system is what it is and I accept the verdict. Best of all, Erich was able to negotiate cash payment for community service so that I wouldn't have to return to Stark County. To anyone reading, I'll leave you some PRO TIPS when dealing with neighbors that trespass on your property repeatedly: Call the police first, don't make verbal threats--even if the person who pressed charges yelled at children and was passive aggressive. Also, you probably don't want to see yourself in body cam footage - I am NOT a handsome man...

Cons
1
Possible breach of client-attorney privilege
“He does not honor client attorney privilege. He has been my attorney for over 10 years. I called for legal advice regarding a custody case involving my wife and I just to turn around and find him representing the opposing party.”
2
Failure to follow through on tasks
“He didn't file paperwork like he should have when he did a TOD. I found out by talking to another secretary at another law firm what should have been done. When I called Breyfogle he said he would take care of it. When I called back to see if it had been done I couldn't get them to call me back.”
3
Negative case outcomes
“Worst choice you could make as a attorney. Unless you want to lose then you have your man.....stay away...”
4
Failure to deliver on services paid for
“took my money, never did anything..I handled everything on my own.”

Judge "Eddie" has been in the Massillon Court System for many years. I watch the Massillon Court TV sometimes and am very pleased with how he tries to help people in trouble. He always tries to be fair. If a kid is in trouble, he makes sure they get a diploma if they don't have one. If a person needs a job, he tries to help them get one. Overall I think he has left quite a legacy for the people of Massillon and for any one that's ever been in his court.

Mr. B Deforest has done a couple things for me & my Family.. First he did some work for my Parents such as Power of Attorney documents, will ect.. my Mom was diagnosed with Pancreatic Cancer so we had to get things together quickly while trying to deal with this terrible situation.. Mr. Deforest had got it done quickly and professionally.. He was very compassionate. Then after my parents situation I decided it was time for me to get my stuff in order for my children before something happens to me..Mr. Deforest was very busy but still found the time to work with me still.. During all this my dog had surgery done, and I had to pause things for awhile.. He had no problem with that he so patient and caring about the situation I so appreciated that.. Eventually I got back to him and we got things done.. If you are looking for an Elder attorney he is the best he knows his work and is very knowledgeable and helpful, patient, and professional I highly recommend him…

Benjamin led us through the myriad of confusion called Medicaid. His interaction with Medicaid was invaluable in saving us time and interpreting correctly the regulations that allowed us to preserve my sister's assets and receive added benefits. He always was prompt in answering all the questions.

Can a Lawyer Represent Me in Courts Outside of Massillon, Ohio?

Whether a lawyer can represent you in courts outside of your city or state depends on their licensure and the jurisdiction of the court:

  • Within the Same State:
Lawyers licensed in a particular state can typically practice anywhere within that state, including all cities and counties. They can represent you in both state and federal courts located in that state.
  • Outside of Their Licensed State:
If your case is in a different state, the lawyer must be licensed in that state to represent you. However, there are exceptions:
    • Pro Hac Vice Admission: An out-of-state lawyer can request special permission to represent a client in a specific case in another state. This requires filing a motion with the court and often working in conjunction with a local attorney.
    • Federal Courts: If your case is in federal court, a lawyer licensed in any state may be able to represent you, provided they are admitted to practice in that particular federal court.
  • International Representation:
For cases outside the United States, different rules apply, and the lawyer may need to comply with the foreign country's legal requirements or collaborate with local counsel.

It's important to discuss your specific situation with the lawyer to determine if they can represent you in the desired jurisdiction and what steps may be necessary to do so.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  • Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing. Most state bar websites have an online directory for this purpose.
  • Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case. Review their website, professional profiles, and case history.
  • Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association's records.
  • Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, Google, or Yelp to gauge client satisfaction and experiences.
  • Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field and adherence to high ethical standards.
  • Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation in the legal community.
  • Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  • Ask for References:
A credible lawyer should be willing to provide references from past clients who can speak to their abilities and professionalism.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  • Relevant Documents:
Bring all documents related to your case, such as:
    • Contracts or agreements
    • Correspondence (emails, letters, texts)
    • Legal notices or court papers
    • Financial records (if applicable)
    • Evidence (photos, videos, receipts)
  • Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and parties involved. This helps the lawyer quickly understand the context.
  • List of Questions:
Write down any questions you have about your case, the legal process, fees, or the lawyer's experience.
  • Financial Information:
If your case involves financial matters, bring relevant documents like pay stubs, tax returns, bank statements, or invoices.
  • Contact Information:
Provide details of any witnesses or other parties relevant to your case, including their names and contact information.
  • Personal Identification:
Bring a valid photo ID for verification purposes.
  • Pen and Notebook:
Take notes during the consultation to remember important points discussed.
  • Budget Constraints:
Be ready to discuss your budget and any financial limitations so the lawyer can provide appropriate guidance on fees and payment options.
  • Openness and Honesty:
Be prepared to discuss your case candidly. Full disclosure allows the lawyer to give accurate advice and anticipate potential challenges.
