Filing for disability was a difficult decision for me. I had worked a consecutive 39 years in accounting and financial analysis. I had no desire to cease working at 61 years old. However, the symptoms from degenerative disc disease in my neck and rampant stenosis in my lower back were so debilitating and painful, I began to have immense difficulty focusing at work especially with the level of detail required for my profession. I decided I was just going to quit work and retire early until my HR Director reminded me that we did have an employer-paid disability plan.
I was certain that I was disabled based on the definitions in the plan materials once I read them. I applied for benefits and worked with the insurance company’s friendly claims manager. As I detailed my medical situation to this person and provided evidence, he even conceded that my issues would continue long past a year which he said is kind of their line in the sand for consideration. As a naïve applicant, I thought they would approve it pretty quickly but instead the decision was stretched out as long as they could stretch it and I was ultimately denied benefits.
A retired attorney friend of mine looked up law firms specializing in private disability and referred Roy Law to me. They read my denial letter and said it was one of the worst they had seen and agreed to represent me. Roy Law filed my appeal and broke down every falsehood and understatement the insurance company wrote about the severity of my conditions. The denial was ultimately reversed and I considered it a fine job by Roy Law. Attorney Darrin Class was always there to answer my questions and I’m sure I had quite a few along the way.
A few months later, the insurance company denied benefits again because I made the grave mistake of telling the truth to my Neurosurgeon about what was at that time, some short-term pain relief after my neck surgery. Unfortunately for me, my painful symptoms gradually returned to a worse level than they were previously. Roy Law jumped to bat for me again suggesting more specialized treatment with a Physiatrist. By the time we appealed a second time, I had all three of my primary medical professionals including the aforementioned Neurosurgeon agree in writing that I was disabled.
The insurance company still stretched their decision out and ultimately required that I have a functional capacity evaluation (FCE). I did so and my second appeal was finally reversed recently. I was very impressed by the appeals process as executed by Roy Law. I was not initially happy being denied by the insurance company and I did not take the payment of a 1/3rd contingency lightly when I hooked up with Roy Law. In reality, your choice ends up being 100% of zero or 2/3 of the benefits you deserve. I chose the latter and Roy Law served me very well throughout the entire process. If you do end up receiving benefits on an employer-paid plan with a contingency, do some tax homework. Due to Trump’s tax changes, you likely won’t appreciate the answer but at least you can plan for it.
Finally, listen to your attorneys because they know what actions will serve you best. In my case, Darrin Class suggested early on that I go have and FCE at my own cost. I declined and realize now that such a move would have likely sealed the decision in my case much earlier than the nearly two years the entire process with two appeals took. I highly recommend Roy Law for anyone who has been wrongfully denied benefits as I was.

This firm was able to help me within a few months. I was ready to hunker down for a couple of years. I really thought all attorneys are terrible, but this firm renewed my faith in representation. Roy Law recently helped me win my short and long term disability case with Sun Life. I had been trying to continue working while coping with ongoing back problems and psoriatic arthritis and spondylitis. Things were falling apart at work and I couldn't do it anymore. Words cannot express my sincere and heartfelt gratitude for all that Darrin and Kali at Roy Law did for me regarding my short term and long-term disability insurance claim with Prudential Insurance Company.
After working for the same company for 10 years, I became very ill with the flu, missing several weeks of work. Initially, Prudential approved me for short-term disability payments, but then after 4 weeks, stopped payments, even though my MD still had me off work, and I was too sick to return to work. After several more weeks of continued illness, I contacted Roy Law. I was so sick, that I had lost my ability to advocate for myself. Roy Law took my case, taking all of the worry and burden from me. I then suffered other illnesses, including 2 mild heart attacks, during which time; Roy Law continued to work with the insurance company to obtain both short term, and long-term benefits.
Finally, Prudential Insurance Company was forced to reverse their denial of my claims, due to the continued persistence of Darrin and Kali to fight for my benefits. Their kindness and perseverance on my behalf took the burden of having to do it myself.
I can tell you firsthand that Darrin and Kali worked tirelessly on my case, and kept me updated throughout the process. Also, I watched a family member experience having to fight for their long term disability payments a couple years ago, and even though they were genuinely disabled, and hired a lawyer, their lawyer was not able to bring about results. When I compare the 2 firms, Roy Law went far far beyond what the other firm did in developing a case. I witnessed Darrin and Kali professionally and systematically develop a legal case, which ultimately Prudential could not deny.
When I signed up for the short term and long term benefits, the advertisement promised the benefits would be there if one became unable to work. Then I learned sadly, that when you do become ill, and are unable to work, the insurance company will look for any reason they can find to deny your claim. They take your premium happily, but when it comes to paying the claim, they are not so nice to work with.
I highly recommend Roy Law to anyone who finds they cannot work due to illness, and has the insurance coverage on the day they go down. KS
