Amanda represented me after I was selectively pulled over by police when driving away from an animal rights-related protest in Beaverton, OR. The protests had become a regular occurrence, and police in the area had started responding with various forms of threat and intimidation, mostly utilizing the legal system. At that point, there had been some arrests, but one tactic the police adopted was pulling people over as they left the protest under random pretenses in an effort to harass protesters and stick them with fines. Their logic was to increase the cost of protesting, hoping to deter through the bureaucracy of the legal system. I had been targeted by the police and pulled over multiple times. I wanted to challenge one of the tickets I received, for "improper signaling", and Amanda represented me in a challenge against the city and the police. After requesting discovery and making it clear that this little traffic violation would be turned into a political case to investigate the city's complicity in quelling protected speech, the City Attorney decided to drop charges. Thanks to Amanda, we were able to mitigate the threat against activists and show the city of Beaverton that they couldn't arbitrarily use the police so easily and not face consequences and challenges. She was a pleasure to work with and a true advocate for activists.

I was unexpectedly arrested at a protest and charged with several misdemeanors as a result. I wanted to fight the case as I felt the charges were unfair, but I needed an attorney who could understand the scope of my situation and be willing to fight for me without pressuring me to accept a plea. I was so lucky to have found Amanda. She fully understood my concerns and helped me mount the best possible defense I could have. She patiently walked me through all the steps, advised me of potential outcomes, and calmed me when I was stressing. I am extremely grateful that there are good lawyers like Amanda.

Amanda Schemkes! Is an incredible defense attorney. She is well-paced, thoughtful, intentional and humble. For my case, she took all potential legal avenues into account and made the safe and effective legal decisions for my well being. After chaining myself to that Arctic Challenger in defense of a livable climate and healthy arctic, I received a $20,000 fine from the USCG. To defend me, Amanda was able to compile a 17-page necessity-defense speaking to the subsistence needs of the Inupiaq people, The Climate and the sensitive ecological systems of the Arctic. Her work brought my fine down to a manageable $5000 dollars, which my community will be able to raise. Amanda, is an amazing person to work with. She is professional, responds to emails, keeps track of time-lines, is available for questions, is an effective listener and always asks the right questions. If you are looking for a lawyer to support you in pushing boundaries Amanda is a great person for the job.

Amanda Schemkes is the type of lawyer that you need when you are standing up for your rights. As a climate justice kayakativist involved in the ShellNo actions in the Pacific Northwest, I was cited by the USCG for a $40,000 fine. Learning that the "judge" in my case also works for the USCG was intimidating. Amanda made it possible for me to stand up for my rights, to tell my story, and to prevail in my case. Amanda cares not only about the law and movement strategy, she cares about representing your unique voice. She is both professional and compassionate. Engaging in civil disobedience is a serious decision with consequences, and I appreciated Amanda having my back in navigating my case.

My daughter locked down to an anchor chain in Bellingham, WA as part of the SHellNo campaign. Contesting Shell's intention to drill in the Arctic. There were many citations served by the USCG to allies involved in the action. Everyone paid their fines and moved on. My daughter and another activist who spent time on the chain bravely decided to contest their fines based on the Necessity Defense. Amanda presented a sound and well researched empirical argument and defense, setting precedence. As a mother it was reassuring to have someone competent and accessible overseeing my daughter's case. The fine was significantly reduced from $20,000 to $5,000. During the action I was out in the water trying to see and communicate with my daughter. The driver of the boat and I were each unjustly fined for entering the safety zone. We contested and Amanda set up a clear and again precedence setting case. My case was dropped due to lack of evidence! The driver of the boat had his fines significantly reduced. Amsnda proved to have the legal competence in a unique case. She was continually available, collaborative and on top of it.

Ryan Scott is an absolute legend. I called him because he was recommended by a friend and gave him everything I had. He took it upon himself to contact the right people and figure out what my options are, all before discussing giving him a dime. Truly a man who cares about justice and doing the right thing. I can’t recommend him enough.

Jennifer has to be hands down the most amazing person I’ve ever dealt with in the legal world. I don’t know if I can find the words to express my gratitude for her. She was so professional, knowledgeable, understanding, and most of all she kicked butt in the courtroom. I would recommend her to handle anyone’s case in a heartbeat.

Susan Ford helped me prepare for a small claims case (where I represented my company) for a customer that sued us for nearly $5,000. Before hiring Susan I had checked with two other lawyers but I did not feel confident. Susan helped with both the mediation and the final court hearing. With her knowledge in my brain, I was able to make a clear and coherent explanation of events. The judge decided the case in my favor. I recommend Res Nova for anyone dealing with business issues in Oregon.

Can a Lawyer Represent Me in Courts Outside of Portland, Oregon?

Whether a lawyer can represent you in courts outside of your city or state depends on their licensure and the jurisdiction of the court:

  • Within the Same State:
Lawyers licensed in a particular state can typically practice anywhere within that state, including all cities and counties. They can represent you in both state and federal courts located in that state.
  • Outside of Their Licensed State:
If your case is in a different state, the lawyer must be licensed in that state to represent you. However, there are exceptions:
    • Pro Hac Vice Admission: An out-of-state lawyer can request special permission to represent a client in a specific case in another state. This requires filing a motion with the court and often working in conjunction with a local attorney.
    • Federal Courts: If your case is in federal court, a lawyer licensed in any state may be able to represent you, provided they are admitted to practice in that particular federal court.
  • International Representation:
For cases outside the United States, different rules apply, and the lawyer may need to comply with the foreign country's legal requirements or collaborate with local counsel.

It's important to discuss your specific situation with the lawyer to determine if they can represent you in the desired jurisdiction and what steps may be necessary to do so.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  • Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing. Most state bar websites have an online directory for this purpose.
  • Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case. Review their website, professional profiles, and case history.
  • Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association's records.
  • Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, Google, or Yelp to gauge client satisfaction and experiences.
  • Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field and adherence to high ethical standards.
  • Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation in the legal community.
  • Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  • Ask for References:
A credible lawyer should be willing to provide references from past clients who can speak to their abilities and professionalism.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  • Relevant Documents:
Bring all documents related to your case, such as:
    • Contracts or agreements
    • Correspondence (emails, letters, texts)
    • Legal notices or court papers
    • Financial records (if applicable)
    • Evidence (photos, videos, receipts)
  • Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and parties involved. This helps the lawyer quickly understand the context.
  • List of Questions:
Write down any questions you have about your case, the legal process, fees, or the lawyer's experience.
  • Financial Information:
If your case involves financial matters, bring relevant documents like pay stubs, tax returns, bank statements, or invoices.
  • Contact Information:
Provide details of any witnesses or other parties relevant to your case, including their names and contact information.
  • Personal Identification:
Bring a valid photo ID for verification purposes.
  • Pen and Notebook:
Take notes during the consultation to remember important points discussed.
  • Budget Constraints:
Be ready to discuss your budget and any financial limitations so the lawyer can provide appropriate guidance on fees and payment options.
  • Openness and Honesty:
Be prepared to discuss your case candidly. Full disclosure allows the lawyer to give accurate advice and anticipate potential challenges.
