I was picked out of random for a DUI leaving a restaurant in Murrells Inlet. I did not know of any lawyers in the Myrtle Beach area and when I did internet search for lawyers in Myrtle Beach, I was very impressed with Mr. Monckton's background. I met with Mr. Monckton and his paralegal. They told me that I had a great case because of my upcoming knee replacement surgery. His paralegal Rhonda kept up to date with everything and they got my DUI dismissed. I would highly recommend Mr. Monckton.

My nephew became addicted to drugs 5 years ago. I brought him to Myrtle Beach in hopes of a new environment and to have the support of his family near him. In July 2016 drugs found their way back into his life and on August 14, 2016 he was arrested. I reached out to Billy Monckton, as I was unsure who I could turn to. He went and met with my nephew, listened to his side of the story and contacted me. He said he would represent my nephew. I knew at that moment my nephew was in good hands. After 7 months of my nephew behind bars Billy Monckton was able to secure Drug Court in lieu of the reduced sentence of 5 years in jail. Billy Monckton takes the time to know the reason(s) one came to the point they are in their life and what lead them to do a crime. He does his homework and does what is in the best interest of the client and not what the family wants at the immediate. Billy Monckton works for the long term success of his clients. Without Billy Monckton's expertise and willingness to go above and beyond, my nephew would not have a second lease on life. I would highly recommend Billy Monckton to anyone who was looking for counsel who cares, who is honest and who is willing to fight for ones rights.

Because of some really bad decisions I found myself facing some serious charges. When I got word that there was a warrant for my arrest, I immediately contacted Mr. Monckton who made a phone call arranging a time in which I could surrender in order to save the embarrassment of being arrested at my job plus giving me the opportunity to make arrangements for a bondsman. Once I was bonded out I met with Mr. Monckton and explained everything that had happened. He took notes as he listened, he asked questions and was genuinely interested in hearing what happened and how I got to this point. He assured me that he would be able to help me, he explained to me in detail the seriousness of my charges and the maximum time I was facing. He explained the law and all the negative ramifications that my charges carried. I was looking at up to 20 years in prison. Once I retained his services he always made himself available to me, answering my calls, returning messages and keeping me updated on my case. He fought hard for me and with his knowledge of the law he was able to get my charges dismissed in exchange for me pleading to a lesser non violent charge carried up to 10 years in prison. When Mr. Monckton told me that I figured that since this is my first offense I'd probably get 3 maybe 5 years, but Mr. Monckton was able to negotiate a YOA sentence. Mr. Monckton was able to get me a resolution far better than I was looking at originally or could have imagined. My charges can be expunged once I complete all my probation and other requirements. I want to be able to use this opportunity to get my priorities right and my life straightened out and all of this is possible because Mr. Monckton was the man by my side through my legal process. With my record expunged I can start over with a clean slate. I would highly recommend him to anyone in need of an attorney.

Can a Lawyer Represent Me in Courts Outside of Myrtle Beach, South Carolina?

Whether a lawyer can represent you in courts outside of your city or state depends on their licensure and the jurisdiction of the court:

  • Within the Same State:
Lawyers licensed in a particular state can typically practice anywhere within that state, including all cities and counties. They can represent you in both state and federal courts located in that state.
  • Outside of Their Licensed State:
If your case is in a different state, the lawyer must be licensed in that state to represent you. However, there are exceptions:
    • Pro Hac Vice Admission: An out-of-state lawyer can request special permission to represent a client in a specific case in another state. This requires filing a motion with the court and often working in conjunction with a local attorney.
    • Federal Courts: If your case is in federal court, a lawyer licensed in any state may be able to represent you, provided they are admitted to practice in that particular federal court.
  • International Representation:
For cases outside the United States, different rules apply, and the lawyer may need to comply with the foreign country's legal requirements or collaborate with local counsel.

It's important to discuss your specific situation with the lawyer to determine if they can represent you in the desired jurisdiction and what steps may be necessary to do so.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  • Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing. Most state bar websites have an online directory for this purpose.
  • Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case. Review their website, professional profiles, and case history.
  • Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association's records.
  • Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, Google, or Yelp to gauge client satisfaction and experiences.
  • Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field and adherence to high ethical standards.
  • Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation in the legal community.
  • Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  • Ask for References:
A credible lawyer should be willing to provide references from past clients who can speak to their abilities and professionalism.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  • Relevant Documents:
Bring all documents related to your case, such as:
    • Contracts or agreements
    • Correspondence (emails, letters, texts)
    • Legal notices or court papers
    • Financial records (if applicable)
    • Evidence (photos, videos, receipts)
  • Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and parties involved. This helps the lawyer quickly understand the context.
  • List of Questions:
Write down any questions you have about your case, the legal process, fees, or the lawyer's experience.
  • Financial Information:
If your case involves financial matters, bring relevant documents like pay stubs, tax returns, bank statements, or invoices.
  • Contact Information:
Provide details of any witnesses or other parties relevant to your case, including their names and contact information.
  • Personal Identification:
Bring a valid photo ID for verification purposes.
  • Pen and Notebook:
Take notes during the consultation to remember important points discussed.
  • Budget Constraints:
Be ready to discuss your budget and any financial limitations so the lawyer can provide appropriate guidance on fees and payment options.
  • Openness and Honesty:
Be prepared to discuss your case candidly. Full disclosure allows the lawyer to give accurate advice and anticipate potential challenges.
