I successfully defended myself when Chancey et al said it wasn't possible... A poor showing for these guys.
I was involved in a car accident where I hit another car in the rear with my car. The police, who did not witness it, said it was my fault and charged me with following too closely.
I reviewed the dashcam video later and saw that in the video, I was NOT at fault. I was following at a safe and reasonable distance when the car ahead of me changed lanes quickly, leaving me not enough time to fully avoid the person ahead of them. The person ahead of them was STOPPED at a green light for 10 seconds after it changed (Probably texting!).
After reviewing the video, I decided to fight the charges and fine. I called around and Chancey and Kanavos agreed to give me a consultation. I met with them at their office. They didn't introduce themselves to me, just asked to see the video. After watching it, they said I had no chance in court, and I would be better off just taking the charge and going on with life.
He said the law was the law, and that "Following too closely" means exactly what it was... If you hit someone, you are by the laws of physics FOLLOWING TOO CLOSELY. I thought this was ridiculous. I didn't want to argue because I don't want literalist simpletons defending me in court, so I left.
Last night, I went to court, showed my video to the city attorney, and he said I wasn't guilty. He talked to the judge and the judge agreed to throw the case out.
Afterward, the city attorney told me that people take Following Too Closely at face value, when in reality, the law has factors that are involved in applying it.
Since in the video I was traveling at a safe distance, at a safe speed, tried to avoid hitting the person, and the other person was clearly obstructing traffic illegally, I was not at fault and NOT following too closely.
It just takes some careful thought and analyzation of the evidence to prove your innocence. Moral of the story: always get a second opinion or defend yourself if no one else will, because if you know in your heart you are innocent and you have the evidence to prove it, it's worth fighting for.
