I needed an estate attorney for my 90+ year old parents to update Wills, prepare a Living Trust, and prepare Powers of Attorney, Healthcare POA's, Living Wills and Deed changes for the Trust. After interviewing 7 Knoxville attorneys/law firms, I settled on Stephen Carpenter at Carpenter & Lewis. He had fixed pricing (very reasonable for an entire Estate Package) and was impressive and personable on the phone. We have now completed the process and we could NOT be happier with the result. My parents were so complimentary of the very process that they were dreading. Stephen is HIGHLY knowledgeable, tax and estate savvy, detail oriented and is so very down to earth, professional and responsive. His documents were amazing and needed very few changes. He is an avid listener and translated our unique needs into legal language so very well. He was great in explaining everything and answered all our questions in terms we could all understand. The process was painless! I did my own estate documents 10 years ago in another state using a large, high powered law firm -- Believe me -- Stephen's process was 10 TIMES better - and a lot less expensive. Stephen knows how to do this and how to guide you through it VERY WELL! Also, Lorie, his assistant, was a joy to work with, so pleasant and service oriented. I do NOT do reviews of things on the web...but, after using Carpenter & Lewis' services, I wanted all of you who are looking to do estate planning to know -- YOU WILL NOT GO WRONG WITH THEM!!!! So, do yourself a favor...if you want a great outcome, if you want super value for your money, if you want to deal with very pleasant, personable and responsive people who are experts and pros at what they do -- use Stephen Carpenter at Carpenter & Lewis. It's not a large law firm...it's a small, highly effective, service oriented group. You won't regret it...and perhaps afterwards, you'll also WANT to write a review of them to help others who are trying to decide who to use for some of the most important legal documents in their life.

5-Star rating. As long as I have know Stephen Carpenter and worked with him in a client-attorney relationship, he has consistently been helpful, caring, friendly, sincere, honest, fair and (generous) when it comes to charging for services, thorough in researching issues, and willing to refer out to others in areas where others may have more "niche" experience in dealing in certain legal areas. I would highly recommend his services. — Bob

We use Carpenter and Lewis for our small business. Over the years our business has grown and changed, Stephen Carpenter has helped us through these changes with sound advice and quick responses. Stephen has experience in the CPA world as well so is able to give a perspective that contributes in many areas of our business. What I like the most is the personal attention and response. There is no red tape or hoops to jump through - it is just straight honest answers.

Mr. Carpenter drafted excellent last will and testament, family trust, living will, and power of attorney documents for my wife and me. (I also happen to be an attorney.) Mr. Carpenter was referred to us by our retirement investment planning expert. We are very glad that we engaged Mr. Carpenter to take care of our estate planning needs.

Mr. McBride helped my sister and me escape from a dreadful situation and aided us in returning to our home. He was always available for questions, kept us well informed as the situation progressed, and kept in great contact afterward to make certain that we were well cared for in our new environment.

David went above and beyond making our daughter’s adoption experience wonderful. He was quick to answer any and all questions we had. The whole process was quick, and special. We remember when David said upon consultation , “This is a celebration”. We knew then he was the perfect lawyer for us. Thank you David for all you did for our family! Forever grateful.

Dave Otten went above and beyond helping me sell my house. We ran into a few issues during the process, but he was extremely helpful every step of the way. I couldn’t have asked for a better agent. He even took care of things for me while I was out of the country! He was very patient with me and helped me navigate the entire process as a first-time seller. I would 100% recommend Dave to anyone looking for a real estate agent!

  4. What is your approach to resolving cases like mine?
Learn about their strategy, whether they prefer negotiation, mediation, or litigation.
  5. What potential outcomes can I expect?
While no lawyer can guarantee results, they can provide an assessment of possible scenarios based on their experience.

Can a Lawyer Represent Me in Courts Outside of Knoxville, Tennessee?

Whether a lawyer can represent you in courts outside of your city or state depends on their licensure and the jurisdiction of the court:

  • Within the Same State:
Lawyers licensed in a particular state can typically practice anywhere within that state, including all cities and counties. They can represent you in both state and federal courts located in that state.
  • Outside of Their Licensed State:
If your case is in a different state, the lawyer must be licensed in that state to represent you. However, there are exceptions:
    • Pro Hac Vice Admission: An out-of-state lawyer can request special permission to represent a client in a specific case in another state. This requires filing a motion with the court and often working in conjunction with a local attorney.
    • Federal Courts: If your case is in federal court, a lawyer licensed in any state may be able to represent you, provided they are admitted to practice in that particular federal court.
  • International Representation:
For cases outside the United States, different rules apply, and the lawyer may need to comply with the foreign country's legal requirements or collaborate with local counsel.

It's important to discuss your specific situation with the lawyer to determine if they can represent you in the desired jurisdiction and what steps may be necessary to do so.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  • Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing. Most state bar websites have an online directory for this purpose.
  • Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case. Review their website, professional profiles, and case history.
  • Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association's records.
  • Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, Google, or Yelp to gauge client satisfaction and experiences.
  • Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field and adherence to high ethical standards.
  • Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation in the legal community.
  • Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  • Ask for References:
A credible lawyer should be willing to provide references from past clients who can speak to their abilities and professionalism.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  • Relevant Documents:
Bring all documents related to your case, such as:
    • Contracts or agreements
    • Correspondence (emails, letters, texts)
    • Legal notices or court papers
    • Financial records (if applicable)
    • Evidence (photos, videos, receipts)
  • Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and parties involved. This helps the lawyer quickly understand the context.
  • List of Questions:
Write down any questions you have about your case, the legal process, fees, or the lawyer's experience.
  • Financial Information:
If your case involves financial matters, bring relevant documents like pay stubs, tax returns, bank statements, or invoices.
  • Contact Information:
Provide details of any witnesses or other parties relevant to your case, including their names and contact information.
  • Personal Identification:
Bring a valid photo ID for verification purposes.
  • Pen and Notebook:
Take notes during the consultation to remember important points discussed.
  • Budget Constraints:
Be ready to discuss your budget and any financial limitations so the lawyer can provide appropriate guidance on fees and payment options.
  • Openness and Honesty:
Be prepared to discuss your case candidly. Full disclosure allows the lawyer to give accurate advice and anticipate potential challenges.
