Rachel Upshaw of Miller Upshaw Family Law, PLLC is an outstanding attorney, whom I would strongly recommend without hesitation, to anyone who is searching for an incredibly knowledgeable, compassionate, trustworthy, and hardworking professional to legally represent them. Rachel gracefully supported me during my divorce process, which began as uncontested, but shifted into a contested divorce, along the way. Rachel was always responsive to my emails throughout my case, and I experienced her as patient and kind during each communication we had during my case. Additionally, I experienced Rachel’s legal guidance throughout my divorce as wise, responsive, and precise, while always keeping my best interest as her client front and center. Rachel had a balanced approach of being warm, while also being realistic and “telling it like it is,” regarding each detail of my case, which I deeply valued and appreciated, and helped me to wholeheartedly trust her as my counsel. Rachel also proactively communicated to me regarding any anticipated absences that she had, during my case, and she always let me know whom else from her office would be responding to my questions and/or handling time-sensitive tasks on her behalf, while she was out of the office. In the midst of my divorce, I also experienced Rachel as caring, thoughtful, and non-judgmental, which was important to me, given some of the more sensitive elements of my case. Furthermore, during our court appearances, for which Rachel was always prepared, it was very clear that Rachel is highly regarded and highly respected amongst her peers, as I observed her professional exchanges when we were at court. One of the aspects of Rachel’s approach as my attorney, that I appreciated the most, was her consistently showing up as a grounded anchor throughout my case, who, even in the face of some situations that I believe would’ve made the most calm person lose their composure–Rachel never wavered, and she was always a validating and grounded anchor during those situations. To note, while I most consistently experienced Rachel as cool, calm, and collected, Rachel was also very “tough” (meaning, to me, more overtly assertive) when the situation called for it, doing so without hesitation, and again, always with my best interest in mind. I grew to learn that this balanced approach from her fit my personality and my needs the best, in comparison to the approach of some other attorneys. During the mediation portion of my case, Rachel was very dedicated to ensuring that my hopes and wishes were consistently reflected and advocated for, throughout the process. Additionally, I am grateful for Rachel’s support, surrounding my ex-spouse and I ultimately reaching an agreement that was satisfactory to me, and the most desirable outcome possible, considering some of the more difficult (beyond her/our control) pieces of my case. Lastly, I want to give a positive “shout-out” to other members of the Miller Upshaw Family Law team who were involved with my case. Attorney Taylor Rippe assisted me with some portions of my case, particularly during times that Rachel was out of the office. My communications with Taylor were always pleasant and I experienced her as knowledgeable and committed to completing tasks related to my case, in a thoughtful and responsive manner. Additionally, Joellyn Kott, their Paralegal, is a true gem of a person, who always exuded warmth and compassion during each of our interactions, whether it was during a phone call or when I needed to stop by their office to handle something related to my case. Furthermore, Ethan Pylant, their Legal Assistant, was always very respectful and timely in his communications with me, regarding my case. Overall, I would (and actually already have!) highly recommend Rachel Upshaw to anyone who is seeking legal representation here in Middle Tennessee. Rachel will be there for you, from beginning to end, providing just, wise, warm, and professional counsel, every step of the way.

I have had such a wonderful experience working with Taylor Rippe! She took me through almost two years of a very unique and tumultuous divorce/custody battle. Taylor was always professional and proactive about my case. She kept me updated at every step and provided valuable insight on every decision we made. I highly recommend her for any situations that involve uncooperative parties or that require non-traditional custody arrangements. She is everything you want in a lawyer that is helping you protect your family.

I went to Rachel Upshaw after over a decade of dealing with a parenting plan that I felt was not in my best interest. Rachel was honest and realistic. She listened and did everything she could to help fix the areas of my parenting plan that needed it. My case went to mediation and unlike the first time that I was represented, by a different attorney, I was actually advocated for. I couldn’t have been more pleased with the results. If you’re ever in need of a family law attorney I highly recommend Rachel Upshaw.

Best attorney ever. She took every call and returned every email. Explained everything in a manor in which I could understand. Sat down with me 2 weeks before my social security hearing and went thru medical records with and provided honest feedback. She wrote a brief for the judge the day of my hearing. She was well organized and ready to fight for me. I was made to feel like I was the most important person. Love her spunk and drive along with her big heart. Thanks for the wonderful job you did for me Ann. You will never be forgotten. Susan Dole

I’ve hired Ann Tycer to represent me in my fight for disability benefits after finding many recommendations for her, but even those did not do justice to her professionalism she gracefully applies while making you feel like a beloved family member. She has a way of connecting on a human level, you do not feel like just a client but a person she truly wants to help. She has taken the anxiety out of this difficult venture and that alone places her at 100 stars in my book!

Great firm. They represent me on my will, trusts, business, etc. They have always been good with me. They care. My primary attorney is William Harbison, one of the partners, and he is a great guy. I'm very fortunate to have found him and this firm. Plus, he knows many people in other areas, that he can recommend. I found my accountant through him. I enjoy working with him and others at this firm. They care about their clients.

Can a Lawyer Represent Me in Courts Outside of Nashville, Tennessee?

Whether a lawyer can represent you in courts outside of your city or state depends on their licensure and the jurisdiction of the court:

  • Within the Same State:
Lawyers licensed in a particular state can typically practice anywhere within that state, including all cities and counties. They can represent you in both state and federal courts located in that state.
  • Outside of Their Licensed State:
If your case is in a different state, the lawyer must be licensed in that state to represent you. However, there are exceptions:
    • Pro Hac Vice Admission: An out-of-state lawyer can request special permission to represent a client in a specific case in another state. This requires filing a motion with the court and often working in conjunction with a local attorney.
    • Federal Courts: If your case is in federal court, a lawyer licensed in any state may be able to represent you, provided they are admitted to practice in that particular federal court.
  • International Representation:
For cases outside the United States, different rules apply, and the lawyer may need to comply with the foreign country's legal requirements or collaborate with local counsel.

It's important to discuss your specific situation with the lawyer to determine if they can represent you in the desired jurisdiction and what steps may be necessary to do so.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  • Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing. Most state bar websites have an online directory for this purpose.
  • Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case. Review their website, professional profiles, and case history.
  • Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association's records.
  • Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, Google, or Yelp to gauge client satisfaction and experiences.
  • Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field and adherence to high ethical standards.
  • Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation in the legal community.
  • Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  • Ask for References:
A credible lawyer should be willing to provide references from past clients who can speak to their abilities and professionalism.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  • Relevant Documents:
Bring all documents related to your case, such as:
    • Contracts or agreements
    • Correspondence (emails, letters, texts)
    • Legal notices or court papers
    • Financial records (if applicable)
    • Evidence (photos, videos, receipts)
  • Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and parties involved. This helps the lawyer quickly understand the context.
  • List of Questions:
Write down any questions you have about your case, the legal process, fees, or the lawyer's experience.
  • Financial Information:
If your case involves financial matters, bring relevant documents like pay stubs, tax returns, bank statements, or invoices.
  • Contact Information:
Provide details of any witnesses or other parties relevant to your case, including their names and contact information.
  • Personal Identification:
Bring a valid photo ID for verification purposes.
  • Pen and Notebook:
Take notes during the consultation to remember important points discussed.
  • Budget Constraints:
Be ready to discuss your budget and any financial limitations so the lawyer can provide appropriate guidance on fees and payment options.
  • Openness and Honesty:
Be prepared to discuss your case candidly. Full disclosure allows the lawyer to give accurate advice and anticipate potential challenges.
