Tim was hired in January 2015 to represent us in a roof warranty situation. Prior to hiring Tim, we had hired an expert to evaluate the roof to compare it to the scope of work actually performed by the roofer. The comprehensive report undeniably confirmed our suspicions that the roofer did not perform the work according to the contract.. Tim was given all the information and conversed with the expert in a lengthy detailed conversation. Tim met with the other party and their experts in February/March. He received a reply from them stating their position stating the work was performed properly. I want to mention here that, during our initial consultation, Tim asked us what our position was if this was the response that we received from the other party. Did we want to go forward and litigate. We said yes. He wanted a $5,000 retainer, which we immediately paid before we left his office Months past. Never heard from Tim. We contacted him to ask what if anything had he done to move forward. He seemed surprised and confused. He had done absolutely nothing. Totally dropped the ball. He then had the audacity to tell me that he had other cases before ours and would need to be put in "que." More time passed, again never hearing from him. We had to call him again to get any information regarding our case. He asked me for information, which I provided immediately the same day. More time passed with no response. We contacted him again, then again, then again. This was the pattern we experienced with Tim. A few days ago, November 20, 2015, he sent us an email stating that "Perhaps we need to meet to get on the same page", Really??? Tim would NEVER take the initiative to keep up with our cause and would only go through motions after he was "rattled" when contact by us. He was repeatedly reminded about the urgency of the roof caving in because of the weight the contractor added and the structural damage the building was incurring; as well as the imminent possibility of injury of the tenants occupying the building. And he wants to meet "to get on the same page?" We were totally outraged by this and hired another attorney, who immediately took the bull by the tail.
