Sounds like an oxymoron, doesn't it? Well, in this case, it is not! In my experience, Elizabeth's approach with me as her client is that she truly cares about setting my family up for an easy transition to taking over the legal matters of my estate when the time comes that they will need to do so. It's not a matter of if, but when. That's a scary thing to think about. However, with Elizabeth's expertise and years of experience of probate law, she truly understands how to leave behind a legacy of love. The last thing you want your family to have to deal with if something unexpected (or not) happens to you, is trying to figure out how to manage your estate or worse, not having the ability to make medical decisions on your behalf. Having a Will in place protects your family from a lot of the legal & family conflict they may face in trying to make necessary decisions. Don't put off setting up your legacy of love.

Ms. Hilbun and her firm have handled my parents estate for four years, during which time they have helped brother and I navigate all manner of challenges and problems arising from my parents changing needs, from their physical disabilities to their declining faculties, and always with compassion and patience. Her firm's close attention to our situation, to include helping me stay informed and closely involved even though I live out of state, is a peace of mind I value dearly.

During the time I was a main care giver for my 86 year old mother, Elizabeth and her firm were compassionate and attentive to our emotional needs. Our family received the legal guidance we needed during this time. I was educated on the processes that would have brought financial relief for my mothers care. After my mother passed Elizabeth continued with her legal and my support during a very difficult time.

I have had for most of my life a fear of lawyers. My parents had never been able to count on them when they were victimized in the past. During a family issue a few years ago we used a couple lawyers that were unable to provide service commensurate with their billing and braggadocio. I know and have read of lawyers that take advantage of the ignorant or twisted the law for person gain, justice be damned. So I considered myself fortunate to have had rare need for a lawyer personally. That all changed in recent years when both my elderly parents suffered health issues and found myself in need of legal assistance. Maybe I'd been so unlucky in the past that I was due, but I scored three good lawyers in a row. Elizabeth is the probate lawyer I found after one of my parents passed away. Elizabeth is the exact opposite of the lawyers I'd feared. She and her team are down to earth and very kind and take pride in helping people. She is upfront with what the costs of her services will be and works primarily on a flat fee basis so there is little risk of surprise. She's experienced in probate, estates and wills, and elder law and has a good network so she can advise you on several things or find someone who can. The Hilbun Law Firm is a smaller firm and first time visitors might be surprised at the office. You're not getting the expensive glass tower you'd expect from a downtown Houston law firm and there aren't multiple floors of interns in thousand dollar suits running around to serve the big guns. And you won't be paying for it either. What you will get are the things worth paying for: fairness and honesty. In addition to the probate I also later commissioned Elizabeth to handle my other parent's will and power of attorney document. Again she was able to get everything done and at a competitive price. I would offer only one caveat; a smaller office stays busy with its clients and in addition Elizabeth is busy serving the community in a myriad of ways between giving free estate planning seminars and putting efforts into helping the elderly and veterans. These are all good things that just reinforce the authenticity of her character, but be prepared and maintain communications with the office during your case and plan ahead when you need to be on the calendar for appointments. It will serve both parties well.

Elizabeth has advised me on a variety of legal matters since I first contacted her. I have had experience with several attorneys throughout my career, and what sets Elizabeth apart is that she takes a truly personal interest in every case. She acts quickly, kept me informed at every step, but most important: she gives me advice that I never have had to "second guess." I know I can truly count on her and her staff.

We started the process of adopting our twin great nieces when they were 8 months old. Our first lawyer basically stole our retainer and did nothing and did not even inform us the case was dismissed. In seeking a new attorney we stumbled upon Mrs. Delvaille through my husband's company program. We called and spoke of our situation and she advised it was not her specialty. We continued searching. The next day she called us back and told us that our story touched her and if we would allow her to, she would like to take our case with the understanding it would also be a learning process for her. BEST decision we ever made. It took 2 years from the time we began with her (girls were 3 at that time) and though we had some setbacks due to the uncooperative legal system and judge, last week (4/16/2024) our family was finally, legally, complete!!! She was always very responsive to any and all questions we had. Even though this was not her specialty she soared through it like a pro. She sought out guidance from other legal professionals when needed. Even though our case is resolved I am pretty sure Tamisha will always be a part of our family now!

We hired Tanner to help us clear title to sell a lot that my father owned before his death - unfortunately, my father had no will or trust. Tanner was helpful in guiding us in the right direction so that we can hopefully sell this lot in the near future. His communication was outstanding - we are still in the process of clearing up last minute paperwork on our side (once again, we are located outside of Texas) but Tanner has given specific instructions on completing everything. We appreciated all of his help because it can be a bit confusing when trying to sell a lot without a will or trust. I would definitely recommend Tanner to help out with similar situations, like ours.

  4. What is your approach to resolving cases like mine?
Learn about their strategy, whether they prefer negotiation, mediation, or litigation.

Can a Lawyer Represent Me in Courts Outside of Cypress, Texas?

Whether a lawyer can represent you in courts outside of your city or state depends on their licensure and the jurisdiction of the court:

  • Within the Same State:
Lawyers licensed in a particular state can typically practice anywhere within that state, including all cities and counties. They can represent you in both state and federal courts located in that state.
  • Outside of Their Licensed State:
If your case is in a different state, the lawyer must be licensed in that state to represent you. However, there are exceptions:
    • Pro Hac Vice Admission: An out-of-state lawyer can request special permission to represent a client in a specific case in another state. This requires filing a motion with the court and often working in conjunction with a local attorney.
    • Federal Courts: If your case is in federal court, a lawyer licensed in any state may be able to represent you, provided they are admitted to practice in that particular federal court.
  • International Representation:
For cases outside the United States, different rules apply, and the lawyer may need to comply with the foreign country's legal requirements or collaborate with local counsel.

It's important to discuss your specific situation with the lawyer to determine if they can represent you in the desired jurisdiction and what steps may be necessary to do so.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  • Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing. Most state bar websites have an online directory for this purpose.
  • Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case. Review their website, professional profiles, and case history.
  • Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association's records.
  • Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, Google, or Yelp to gauge client satisfaction and experiences.
  • Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field and adherence to high ethical standards.
  • Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation in the legal community.
  • Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  • Ask for References:
A credible lawyer should be willing to provide references from past clients who can speak to their abilities and professionalism.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  • Relevant Documents:
Bring all documents related to your case, such as:
    • Contracts or agreements
    • Correspondence (emails, letters, texts)
    • Legal notices or court papers
    • Financial records (if applicable)
    • Evidence (photos, videos, receipts)
  • Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and parties involved. This helps the lawyer quickly understand the context.
  • List of Questions:
Write down any questions you have about your case, the legal process, fees, or the lawyer's experience.
  • Financial Information:
If your case involves financial matters, bring relevant documents like pay stubs, tax returns, bank statements, or invoices.
  • Contact Information:
Provide details of any witnesses or other parties relevant to your case, including their names and contact information.
  • Personal Identification:
Bring a valid photo ID for verification purposes.
  • Pen and Notebook:
Take notes during the consultation to remember important points discussed.
  • Budget Constraints:
Be ready to discuss your budget and any financial limitations so the lawyer can provide appropriate guidance on fees and payment options.
  • Openness and Honesty:
Be prepared to discuss your case candidly. Full disclosure allows the lawyer to give accurate advice and anticipate potential challenges.
