Approached John as my builder did not complete construction as per trec contact . Builder passed 2 years over the TREC contract . Builder has 60k$ of my earnest money . Builder was ready to pay me back my earnest money up on my request . I approached John as I am not happy builder did not proactively reached out to me offering the money but I had to request . In my first consultation with John , I clearly mentioned (1) force buikder to build (2) get the lot for less price (3) my earnest money + 10% for damages John clearly mentioned , TREC contract is powerful , we can demand for the damages and if he don’t respond we will have jury tell builder . Asked me to pay 1000$ in trust fund From there , all John did was SEND EMAILS TO BUILDER I had to request update of next steps and I get updates like “ waiting for buikder to response etc after few follow ups “ I was again asked to refill the trust fund for another 3000$ . Once again I stressed requested for updates , as a response to my question , I get constipated responses where I end up asking questions for clarity Rather than directing me what we shd do , he leaves options to me . Upon back and forth emails , finally I had to request to file a law suit . By this time 2 months past. He agrees and files law suit , and once again lot of back and forth while Filing law suit . Mean while I keep getting charged from The trust fund. After all this spending about 3000$ so far and 2 months time a law suit was drafted .+ additional costs to drafting law suit . Once again I had to send many emails asking for updates . At this point all of a sudden the comes back , “ it would cost me 50000$ to proceed with law suit and there is no point moving ahead as nature of the contract is as such I will loose the case and best is to compromise and take the money back from buikder and forget the damages “ At this point I questioned John , if the nature of the contract is as such I won’t be eligible or in a good position to claim damages then why was I not informed the same in first consultation. Why did we draft a law suit ?? And stop charging for emails He replied back , left over trust fund will be refunded and his firm don’t want to work , there is a fundamental difference blah blah blah With this bad experience I went to a different lawyer . New lawyer requested me to connect with John for a turn over , John denied to speak to my new lawyer because he know he did nothing other than sending emails to buikder and change me 3 to 4000$ for it , drafting a lawsuit and then informing me there is no use proceeding with lawsuit . The new lawyer was great , in first consultation he clearly said what my options are filed a lawsuit on day one , handed over lawsuits to buikder in 3 days and was charged 350$ for all this . John is not a good lawyer for me and I will never work with him again for the below reasons (1) in my first consultation I was not told by him that nature of contract is not good to claim damages it’s best to get money back rather he said we will make him pay and have jury tell builder if not . He sounded fighting is good and law will force buikder to pay Atleast 6% for damages (2) he then took money in trust fund and all He did was sending emails . I had to follow up for every step . For demand draft , for updates (3)I was not provided with steps , he made me exachange emails to understand next steps . Instead directing me what to do , he made me ask questions and ask him to file a law suit (4) knowing lawsuit won’t help me according to the nature of the contract , he simply worked towards drafting law suit which again took multiple emails and multiple days (5) after drafting lawsuit once again I had to send emails asking update and am running short of cash . (6) he finally comes back “ take the earnest money , not proceed with law suit , it costs 50k$ and more if we proceed and nature of the contract does not guarantee a win etc . Denies to turn over to new lawyer . Charged me 4000$ , sent emails to builder , drafted law suit, asks me to back off . 0 progress .
