Lyons Sandstone is a quarry and stone fabrication company north of Boulder CO. My company was negotiating the purchase of a large CAT Wheel Loader from Black Mountain Machinery in Houston TX. Due to the distance involved we were unable to inspect the condition of the loader ourselves so we hired Mustang Caterpillar (the local CAT dealer in Houston) to perform a TA-2 Inspection of the loader. Relying on a local name brand equipment dealer to inspect a piece of equipment that we wish to purchase makes sense when the distance involved makes doing our own inspection impractical and also results in an inspection done by professionals. We paid $2500 to Mustang Cat to do a TA-2 inspection. Mustang CAT sent us a report on the condition of the equipment in question which represented the Cat loader that we wished to purchase to be a good condition. Based on the results of the inspection done by Mustang Cat Lyons Sandstone purchased the loader. When the loader arrived at our facility in Colorado there was considerable head scratching as to whether our employees could get it off the truck. The loader bore only slight resemblance to the inspection represented to us by Mustang CAT. We had the local Caterpillar dealer in the Denver area (Wagner CAT) do inspections and came to the conclusion that the loader was beyond repair. At this point we phoned the Texas Bar Association who recommended a couple of attorneys in the Houston area. We contacted one of them ( Kyle Treadway) and described the situation to him and after sending documentation to him outlining the situation he agreed to take the case. We sent Mr. Treadway photos and all the documents we had of the transaction between Black Mountain Machinery, Mustang Cat and Lyons Sandstone. Mr. Treadway negotiated a settlement between Mustang CAT and Lyons Sandstone which included a an attorney fee of $12000. We were extremely happy with the settlement that Mr. Treadway negotiated. We got all of our money back and then some. Mr. Treadway only took half of the attorney fee that was negotiated between Lyons Sandstone and Mustang CAT. We are extremely happy the settlement we reached and very happy with the work that Mr. Treadway did to secure the settlement of this issue.

I was referred to Mr. Treadway through a lawyer referral service. My issue was due to a fraudulent UCC filing. Throughout the consultation Mr. Treadway was patient, polite and asked the right questions to understand my issue. He educated me on the ramifications of the filing and in the end, although fraudulent, would not wreak the havoc that I had anticipated. Mr. Treadway offered legal alternatives and actions that I could pursue on my own. I would not hesitate to contact him again.
