I can't thank the team at The Law Offices of David C. Hardaway enough. They handled my case with exceptional care and professionalism, and thanks to their hard work, all of my felony charges were dropped! From the very beginning, they made me feel confident and informed every step of the way. Their knowledge of the law and dedication to my case made a world of difference. If you're looking for a legal team that truly cares about their clients and delivers results, look no further. They saved my future, and I'll forever be grateful!

David Hardaway has been amazing. I was being charged with something that should have been considered self defense and my whole life was quite literally turned upside down, and David helped me through everything and eased my mind about getting a dismissal and charges being dropped. This has definitely been a pretty intense experience and I’m so grateful for David and that it is finally over. I would definitely recommend David! David and his team are so amazing with communication and answering any questions you may have! The charge against me is going to be dropped and now we’re going for an expungement as soon as possible. David is a great lawyer!

Back in 2018, I reached out to The Law Offices of David Hardaway regarding a misdemeanor I received in San Marcos. Initially I met with Mr. Hardaway who was extremely helpful in a time when I didn't know what to do. He started working on my case right away and answered every question I ever asked. Shortly after, my case has handed to Mr. Thomas Pare who took it on as lead attorney on my case and he quickly picked up where Mr. Hardaway left off. Due to Covid and other circumstances, it took 6 years for me to finally have my day in court. When the time came Mr. Pare showed up!! I will admit there was times when I wanted to give up but every time Mr. Pare counseled me and told me we needed to fight. I ended up getting the result we were looking for and will forever be grateful for his persistence. Now that it's all over I want to thank Mr. Hardaway and Mr. Pare for working my case all these years. Lastly, they made me feel like my case was always being worked on and always felt like I was being represented to the best of their ability. I would like to thank everyone who played a part in my case and will recommend The Law Offices of David C. Hardaway and attorney Thomas Pare to anyone who requires a criminal defense attorney in the State of Texas.

As a teenager, our daughter, as do many children of that age, made some poor choices. She was hanging with the wrong crowd and ended up drinking which lead to the involvement of law enforcement. We contacted Amanda Erwin and discussed the case. We immediately felt that she showed true compassion and understanding for our daughter's situation. We were very confident that her advice was in the best interest of our daughter. We scheduled an appointment to meet with Amanda and her husband, Josh. They were both wonderful! The sincerity they showed assured us that we were in the right place. Amanda and Josh took on this case as if it was their own child. They did what they said they would do. They fought for our daughter and had the felony charge reduced to a misdemeanor. Amanda advised us to have the charges expunged so that they would no longer appear on our daughter's record. So when it was time we hired Amanda to handle the expunction. Once again, we were extremely impressed with the way she handled the case. Amanda was adamant that this mistake should not follow our daughter around the rest of her life. She exceed our expectations threefold and we could not be more pleased with the outcome of the situation.

We hired Charles for my Dad's Estate. He was very precise and to the point. He helped us so much to understand the basics of of a will. I would hire him again, because he is very caring & understands his clients feelings in the matter. He gets the case handled properly & doesn't charge you outrageous prices.

Charles represented a family member who was unjustly pulled over by a police officer. He went above and beyond to prove his innocence. He truly cares for his clients. He counseled my son and warned him about following the law. He is an exNavy officer and previously worked in law enforcement. So he knows all sides of the law and he is the most just man I have ever met. His courtroom savvy is incredible to watch. Mostly, it is his character, he is an honorable man who truly cares. He has years of experience and knows how to defend. There are other lawyers out there that might have great ratings cause they are young and work the social media but this is the lawyer you should hire. He has experience, commitment and justice on his side!

Ray and his staff were kind and understanding for the duration of my case. He was considerate of my situation and gave me the time I needed to prepare for my case in the best possible way. During that time he gave me several options making it very clear the pros & cons of each. When the time came he went line-by-line explaining the conditions of my case and the best way to proceed. He made me feel cared for and that he truly only wanted the best outcome for me. Highly recommended for all.

Can a Lawyer Represent Me in Courts Outside of San Marcos, Texas?

Whether a lawyer can represent you in courts outside of your city or state depends on their licensure and the jurisdiction of the court:

  • Within the Same State:
Lawyers licensed in a particular state can typically practice anywhere within that state, including all cities and counties. They can represent you in both state and federal courts located in that state.
  • Outside of Their Licensed State:
If your case is in a different state, the lawyer must be licensed in that state to represent you. However, there are exceptions:
    • Pro Hac Vice Admission: An out-of-state lawyer can request special permission to represent a client in a specific case in another state. This requires filing a motion with the court and often working in conjunction with a local attorney.
    • Federal Courts: If your case is in federal court, a lawyer licensed in any state may be able to represent you, provided they are admitted to practice in that particular federal court.
  • International Representation:
For cases outside the United States, different rules apply, and the lawyer may need to comply with the foreign country's legal requirements or collaborate with local counsel.

It's important to discuss your specific situation with the lawyer to determine if they can represent you in the desired jurisdiction and what steps may be necessary to do so.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  • Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing. Most state bar websites have an online directory for this purpose.
  • Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case. Review their website, professional profiles, and case history.
  • Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association's records.
  • Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, Google, or Yelp to gauge client satisfaction and experiences.
  • Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field and adherence to high ethical standards.
  • Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation in the legal community.
  • Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  • Ask for References:
A credible lawyer should be willing to provide references from past clients who can speak to their abilities and professionalism.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  • Relevant Documents:
Bring all documents related to your case, such as:
    • Contracts or agreements
    • Correspondence (emails, letters, texts)
    • Legal notices or court papers
    • Financial records (if applicable)
    • Evidence (photos, videos, receipts)
  • Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and parties involved. This helps the lawyer quickly understand the context.
  • List of Questions:
Write down any questions you have about your case, the legal process, fees, or the lawyer's experience.
  • Financial Information:
If your case involves financial matters, bring relevant documents like pay stubs, tax returns, bank statements, or invoices.
  • Contact Information:
Provide details of any witnesses or other parties relevant to your case, including their names and contact information.
  • Personal Identification:
Bring a valid photo ID for verification purposes.
  • Pen and Notebook:
Take notes during the consultation to remember important points discussed.
  • Budget Constraints:
Be ready to discuss your budget and any financial limitations so the lawyer can provide appropriate guidance on fees and payment options.
  • Openness and Honesty:
Be prepared to discuss your case candidly. Full disclosure allows the lawyer to give accurate advice and anticipate potential challenges.
