I strongly recommend Mr. Columbus as a lawyer! In my experience, I was cited for Passing when unsafe, Virginia Code Section: 46.2–843. This is a very specific charge under the general category of aggressive driving - a Class 2 Misdemeanor! While I was 3 classes shy of a Bachelors Deg. in Criminal Justice and knew that my driving did not fit the elements of this charge, I hired Rocco. I could not represent myself becuase I DO NOT know 2 important things in the court room: 1. How to speak to the judge, 2. The rules of the trial. Rocco used my research and defense to win my case. However, he was adamant that I do not talk until after the police officer presents the evidence to prosecute the case. If I had hinted to the weakness of the case BEFORE the officer completed his case, he could have amended the charges to reckless driving, etc. During the defense of the case, when questioned directly by the judge, I admitted that my driving was as the officer described. She scolded me for what was obviously aggressive, reckless speeding. The judge looked up the VA code and agreed that I was not guilty. The judge asked the police officer if he wanted to amend the charges and Rocco CORRECTED AND TOLD THE JUDGE that that was not allowed per the Virginia RULES OF CRIMINAL PROCEDURE as the officer had completed presentation of the prosecution’s case. Additionally, at this point, double jeopardy of the Fifth Amendment would apply. Rocco quickly scurried me out of the court room telling me to keep my mouth shut again because the judge was livid and powerless to find me guilty of anything else… That was the best $500.00 that I’ve ever spent!
