I spent a lot of time searching for an attorney that has experience in handling expungements in VA. VA is one of the toughest states to grant expungements and to handle it by yourself is pure stupidity. The next couple of days I spoke with many different attorneys via telephone and office consultation. Office: I visited Mr. Vincenzes Law firm in Fairfax where I was greeted by his secretary staff and offered coffee until my appointment time. Consultation: Mr. Vincenzes explained how the expungement process would work and what was needed from me. We agreed on a very reasonable price for 2 misdemeanor expungements. Mr.Vincenzes and his partner Josh understood the urgency I was facing being a college graduate wanting to enter the Law Enforcement profession. I did not want this youthful mistake haunting my future. Mr. Vincenzes and Joshua kept me informed and updated me with any news relating to my case. Court: The prosecutor was hesitant to approve BOTH expungements. However, Mr. Vincenzes did not go down without a fight. He was able to explain to the judge every reason why it should be granted. Believe me, This is an attorney that is very skilled ( I trust him with my life). His Experience & knowledge in the courtroom and law is magnificent. If I EVER needed any legal assistance in the future, I know who to go too. Give him a call and you won't be disappointed. Mr. Vincenzes and Josh are confident, caring, and trustworthy when it comes to handling your case.

Brent is always looking out for your best interest. He truly cares about his clients. I have used him three times and every time, he has achieved the best outcome possible. In my recent case, he set out to achieve 3 objectives and he did it! Both Brent and Sean are creative and are able to think outside of the box. They know many of the prosecutors, judges, and police officers in Fairfax County and that can only help! Brent is also very responsive and flexible. His assistant, Josh, is also very helpful. You will definitely get the A+++ team if you hire Vincenzes Law.

Hired for Two criminal charges and I was saved by Brent!!!! Review for Brenton D. Vincenzes When I was charged two, yes two i really thought my life was over. I had never been in trouble with the law and I was personally battling anxiety depression, and PTSD. The criminal charges were false alarm calls to Loudoun County EMT and deputies and the second was in Fairfax County for disorderly conduct. Fortunately, I went through AVVO and found Brent and his right hand man Sean ( a former prosecutor.) This is the BEST DECISION I MADE. TRUST ME. All got plead out and no jail time for me. I will always remember how thoughtful and considerate they were towards me and as caring. They took their time and really i can’t thank them enough. If you don’t hire Brent you are making a huge mistake. I was looking at a year in jail. I got no jail time. I am and will always be grateful to Brent and Sean. Professional, smart as hell confident. . I had no doubt he would do what he needed to do and HE DID!! Stella, Fairfax VA

David Marks and his team at the Law Offices of David L. Marks are incredible! He helped my dad settle his accident case, and the entire process was smooth from start to finish. David was always responsive, attentive to our needs, and made sure every detail was taken care of. Alex Laufer took my case and represented me throughout a long and challenging insurance settlement following a vehicle accident that caused me irreparable injury and chronic pain. He worked the case with determination and resourceful strategy and obtained a settlement that was fair to all parties. Most important to me, he obtained that result with unquestionable integrity, and without causing animosity or ill will with the insurance companies and parties involved. When the case was concluded, everyone walked away from the experience with the sense that it was a routine business transaction. If I ever need a lawyer again, I will not hesitate to call Alex or his law firm for help.

Mr. Laufar not only approached the case as requested, he also introduced other variables that resulted in a larger award. He explained parts of the law that we were not aware of at the time. Had we gone to Mr. Laufar 6 months earlier, we would have had a much larger award than obtained at the end of the case. If any follow-up work is required, we will definitely go back to Mr. Laufar and we do recommend him for any legal action.

I reached out to Ms. Fogarty in regards to my divorce and custody situation. From the moment I sat down with Ms. Fogarty i knew she would be the best option to represent me after i initially consulted with 2 other family lawyers prior to meeting with Kate. I will say my case was extremely complex and emotional and Kate was dealing with my child's Mother being Pro-Se. Kate handled this case with professionalism and care. Her knowledge of family law was outstanding and her way with words in front of judge was extremely impressive. People (like myself) complain about the costs of lawyers however the saying is true "you get what you pay for" Without going into details, the overall outcome was in my favor and as a Father in the state of Virginia my outcome is rare to say the least and its all due to Kate's knowledge of family law. If anyone is searching around for a family lawyer, just stop and contact Kate Fogarty, she will fight for whats right and try to obtain the best possible outcome for you. I highly recommend Kate Fogarty to represent you regarding Custody/Divorce,

I probably had one of the most trying years last year in 2012. Kate was the one saving grace I had when it appeared all the chips were stacked against me in my divorce and other matters with the court. Kate was very diligent and thorough in her representation of me and helped to keep me grounded when the opposing side was being unreasonable, under-handed, abusive, and just flat out lying. Kate was able to peel back the onion piece by piece until the real truth came out and the tables turned for good in my direction. In the end she was able to have my divorce over in 6 months on the nose, she ensured I retained my home, and ultimately kept me from having to pay much more then the original reasonable offer I gave my ex-wife at the start of our Divorce. Kate is a wonderful attorney and I am just glad she was on my side during this process and not on my ex's. The old saying goes you get what you pay for, well, Kate was worth every penny I spent on her and then some. I would highly recommend anyone in need a good Civil Attorney to consider hiring Kate, you will not be disappointed.

What Questions Should I Ask Before Hiring a Lawyer?

Hiring the right lawyer is crucial for the success of your case. Here are some important questions to ask during your initial consultation:

  1. What experience do you have with cases similar to mine?
Ensure the lawyer has relevant experience in the specific area of law pertaining to your case.
  2. How do you charge for your services, and what are the estimated costs?
Understand the fee structure, including hourly rates, flat fees, retainer fees, and any additional expenses.
  3. Who will be handling my case?
Find out if the lawyer will handle your case personally or delegate tasks to other attorneys or paralegals.
  4. What is your approach to resolving cases like mine?
Learn about their strategy, whether they prefer negotiation, mediation, or litigation.
  5. What potential outcomes can I expect?
While no lawyer can guarantee results, they can provide an assessment of possible scenarios based on their experience.
  6. How will you communicate with me throughout the process?
Establish expectations for updates, preferred communication methods, and response times.
  7. What is the expected timeline for my case?
Get an estimate of how long the process may take from start to finish.

Testimonials or references can provide insight into the lawyer's professionalism and effectiveness.
  9. What challenges do you foresee in my case?
Understanding potential obstacles helps you prepare and sets realistic expectations.
  10. Are there alternative ways to resolve my legal issue?
Discuss options like mediation, arbitration, or settlement to resolve the issue efficiently.

Can a Lawyer Represent Me in Courts Outside of Fairfax, Virginia?

Whether a lawyer can represent you in courts outside of your city or state depends on their licensure and the jurisdiction of the court:

  • Within the Same State:
Lawyers licensed in a particular state can typically practice anywhere within that state, including all cities and counties. They can represent you in both state and federal courts located in that state.
  • Outside of Their Licensed State:
If your case is in a different state, the lawyer must be licensed in that state to represent you. However, there are exceptions:
    • Pro Hac Vice Admission: An out-of-state lawyer can request special permission to represent a client in a specific case in another state. This requires filing a motion with the court and often working in conjunction with a local attorney.
    • Federal Courts: If your case is in federal court, a lawyer licensed in any state may be able to represent you, provided they are admitted to practice in that particular federal court.
  • International Representation:
For cases outside the United States, different rules apply, and the lawyer may need to comply with the foreign country's legal requirements or collaborate with local counsel.

It's important to discuss your specific situation with the lawyer to determine if they can represent you in the desired jurisdiction and what steps may be necessary to do so.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  • Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing. Most state bar websites have an online directory for this purpose.
  • Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case. Review their website, professional profiles, and case history.
  • Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association's records.
  • Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, Google, or Yelp to gauge client satisfaction and experiences.
  • Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field and adherence to high ethical standards.
  • Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation in the legal community.
  • Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  • Ask for References:
A credible lawyer should be willing to provide references from past clients who can speak to their abilities and professionalism.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  • Relevant Documents:
Bring all documents related to your case, such as:
    • Contracts or agreements
    • Correspondence (emails, letters, texts)
    • Legal notices or court papers
    • Financial records (if applicable)
    • Evidence (photos, videos, receipts)
  • Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and parties involved. This helps the lawyer quickly understand the context.
  • List of Questions:
Write down any questions you have about your case, the legal process, fees, or the lawyer's experience.
  • Financial Information:
If your case involves financial matters, bring relevant documents like pay stubs, tax returns, bank statements, or invoices.
  • Contact Information:
Provide details of any witnesses or other parties relevant to your case, including their names and contact information.
  • Personal Identification:
Bring a valid photo ID for verification purposes.
  • Pen and Notebook:
Take notes during the consultation to remember important points discussed.
  • Budget Constraints:
Be ready to discuss your budget and any financial limitations so the lawyer can provide appropriate guidance on fees and payment options.
  • Openness and Honesty:
Be prepared to discuss your case candidly. Full disclosure allows the lawyer to give accurate advice and anticipate potential challenges.
