I am a lawyer, though not a divorce lawyer. When my daughter was a the start of her divorce proceeding, she asked if I knew any lawyer in the field. I spoke with a former colleague, a family lawyer who was about to retire, and she whole-heartedly recommended " a great younger lawyer" she had worked with -- Hayden. My daughter interviewed and hired him. She was thrilled with him, commenting often on his expertise and, as important, his empathy. He took the time to listen and understand her concerns and problems. Though she was Hayden's client, several times during her proceeding she asked Hayden to talk with me so I could provide my views to her. He was great from this fellow lawyer's perspective. His explanations were clear, very helpful and concise. (There are few things I hate more than a rambling lawyer who runs up the cost meter). My daughter's proceeding ended very successfully a few weeks ago. I share her views that Hayden very effectively represented her interests and secured the best possible settlement. I will be forever grateful for his excellent representation of "my little girl."

Hayden believed in me and my worth even before I did. He fought with intelligence and tenacity for what I deserved and my kids and I needed. Hayden gave us a better new beginning than I ever dreamed possible. He truly cared about helping and supporting me through the entire process of divorce and beyond. He is invested in my well being, happiness and future security. Hayden Lee quite simply showed me and delivered me my worth and my freedom. I have never been happier now that I am divorced, safe, secure and at peace. Hayden was my lawyer and counsel and a good friend. He believed in me, and fought for what was right and fair - and even more... I could not recommend him more highly. I am keeping him on retainer indefinitely. He is a great lawyer and a wonderful human!

David Marks and his team at the Law Offices of David L. Marks are incredible! He helped my dad settle his accident case, and the entire process was smooth from start to finish. David was always responsive, attentive to our needs, and made sure every detail was taken care of. We've since referred all of our friends and family to him for their auto accident cases, and he's consistently provided top-notch service. If you're in need of a great lawyer who truly cares, I highly recommend David Marks!

David Marks and team got the job done for me. He and the team explained things and answered all my questions getting through this legal process. He handled everything professionally in a very friendly manner. It was a long process dealing with the insurance companies, but David and his team were able to reach a settlement for me. Alex Laufer took my case and represented me throughout a long and challenging insurance settlement following a vehicle accident that caused me irreparable injury and chronic pain. He worked the case with determination and resourceful strategy and obtained a settlement that was fair to all parties. Most important to me, he obtained that result with unquestionable integrity, and without causing animosity or ill will with the insurance companies and parties involved. When the case was concluded, everyone walked away from the experience with the sense that it was a routine business transaction. If I ever need a lawyer again, I will not hesitate to call Alex or his law firm for help.

Mr. Laufar not only approached the case as requested, he also introduced other variables that resulted in a larger award. He explained parts of the law that we were not aware of at the time. Had we gone to Mr. Laufar 6 months earlier, we would have had a much larger award than obtained at the end of the case. If any follow-up work is required, we will definitely go back to Mr. Laufar and we do recommend him for any legal action.

I reached out to Ms. Fogarty in regards to my divorce and custody situation. From the moment I sat down with Ms. Fogarty i knew she would be the best option to represent me after i initially consulted with 2 other family lawyers prior to meeting with Kate. I will say my case was extremely complex and emotional and Kate was dealing with my child's Mother being Pro-Se. Kate handled this case with professionalism and care. Her knowledge of family law was outstanding and her way with words in front of judge was extremely impressive. People (like myself) complain about the costs of lawyers however the saying is true "you get what you pay for" Without going into details, the overall outcome was in my favor and as a Father in the state of Virginia my outcome is rare to say the least and its all due to Kate's knowledge of family law. If anyone is searching around for a family lawyer, just stop and contact Kate Fogarty, she will fight for whats right and try to obtain the best possible outcome for you. I highly recommend Kate Fogarty to represent you regarding Custody/Divorce,

I probably had one of the most trying years last year in 2012. Kate was the one saving grace I had when it appeared all the chips were stacked against me in my divorce and other matters with the court. Kate was very diligent and thorough in her representation of me and helped to keep me grounded when the opposing side was being unreasonable, under-handed, abusive, and just flat out lying. Kate was able to peel back the onion piece by piece until the real truth came out and the tables turned for good in my direction. In the end she was able to have my divorce over in 6 months on the nose, she ensured I retained my home, and ultimately kept me from having to pay much more then the original reasonable offer I gave my ex-wife at the start of our Divorce. Kate is a wonderful attorney and I am just glad she was on my side during this process and not on my ex's. The old saying goes you get what you pay for, well, Kate was worth every penny I spent on her and then some. I would highly recommend anyone in need a good Civil Attorney to consider hiring Kate, you will not be disappointed.

  4. What is your approach to resolving cases like mine?
Learn about their strategy, whether they prefer negotiation, mediation, or litigation.

Can a Lawyer Represent Me in Courts Outside of Fairfax, Virginia?

Whether a lawyer can represent you in courts outside of your city or state depends on their licensure and the jurisdiction of the court:

  • Within the Same State:
Lawyers licensed in a particular state can typically practice anywhere within that state, including all cities and counties. They can represent you in both state and federal courts located in that state.
  • Outside of Their Licensed State:
If your case is in a different state, the lawyer must be licensed in that state to represent you. However, there are exceptions:
    • Pro Hac Vice Admission: An out-of-state lawyer can request special permission to represent a client in a specific case in another state. This requires filing a motion with the court and often working in conjunction with a local attorney.
    • Federal Courts: If your case is in federal court, a lawyer licensed in any state may be able to represent you, provided they are admitted to practice in that particular federal court.
  • International Representation:
For cases outside the United States, different rules apply, and the lawyer may need to comply with the foreign country's legal requirements or collaborate with local counsel.

It's important to discuss your specific situation with the lawyer to determine if they can represent you in the desired jurisdiction and what steps may be necessary to do so.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  • Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing. Most state bar websites have an online directory for this purpose.
  • Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case. Review their website, professional profiles, and case history.
  • Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association's records.
  • Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, Google, or Yelp to gauge client satisfaction and experiences.
  • Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field and adherence to high ethical standards.
  • Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation in the legal community.
  • Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  • Ask for References:
A credible lawyer should be willing to provide references from past clients who can speak to their abilities and professionalism.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  • Relevant Documents:
Bring all documents related to your case, such as:
    • Contracts or agreements
    • Correspondence (emails, letters, texts)
    • Legal notices or court papers
    • Financial records (if applicable)
    • Evidence (photos, videos, receipts)
  • Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and parties involved. This helps the lawyer quickly understand the context.
  • List of Questions:
Write down any questions you have about your case, the legal process, fees, or the lawyer's experience.
  • Financial Information:
If your case involves financial matters, bring relevant documents like pay stubs, tax returns, bank statements, or invoices.
  • Contact Information:
Provide details of any witnesses or other parties relevant to your case, including their names and contact information.
  • Personal Identification:
Bring a valid photo ID for verification purposes.
  • Pen and Notebook:
Take notes during the consultation to remember important points discussed.
  • Budget Constraints:
Be ready to discuss your budget and any financial limitations so the lawyer can provide appropriate guidance on fees and payment options.
  • Openness and Honesty:
Be prepared to discuss your case candidly. Full disclosure allows the lawyer to give accurate advice and anticipate potential challenges.
