Let me just start by saying that The Va. BON is not your friend. Eileen Talamante is your friend. You bet, she is an expensive friend, but that’s only because she is worth every cent you invest towards having her fight to preserve your professional license ( aka: your future earnings potential), and fight she will like a magnificent pitbull.
It was absolutely delightful to watch her spank the BON’s adjudicator ( The nerdy little short man who also fancies himself as a sci-fi author) for trying to take false accusations about me and spin them into “facts” at my formal hearing which was closed/ thrown out as a result of Eileen’s hard work and diligence.
It can be an uphill battle all the way when dealing with an administrative hearing where the BON’s attorneys only have to establish what they consider to be “clear and convincing” evidence. The burden of proof is NOT “beyond a reasonable doubt” as in criminal cases. Take my word for it, you will not be able to “clearly convince” the BON of your innocence if you go it alone at your informal or formal hearing. Why? Because you will never be able to imagine all of the potential pitfalls that the BON will present you with, especially if you attempt to represent yourself, which is what I attempted to do at my informal hearing. However, Eileen knows the BON’s tactics, as well as how to shut them down. I am certain that if I had retained Eileen prior to my informal hearing, there would have likely never been a formal hearing, my total legal expenses would have been much less, and I would have been back to work much sooner. So, be informed and make a better decision than I did. Get representation right away, early on. Because, the BON is NOT your friend. If you are being called for an informal hearing, it’s likely because the BON already believes that “clear and convincing” evidence already exists against you. The circumstantial evidence that was stacked against me was overwhelming. It was like a pit of quicksand and I was up to my chin. Eileen was the rope that pulled me out.
For anyone who is actually guilty of some kind of misconduct, you would still benefit greatly from having Eileen’s representation in order to ensure that you fully understand how to best navigate the disciplinary process imposed on you by the BON and that they are not excessive in regards to their ruling.

When I was faced with a BON complaint, I chose Eileen to represent me and guide me through the entire process, and I could not have made a better decision! From day one Eileen was informative, honest, and knowledgeable about how to handle the issue. Throughout the entire process, Eileen advised and guided me on what to expect, the current process, and her recommendations to help me with the case. She is beyond skilled and knowledgeable in this type of law, and knows the ins and outs of it in every aspect of it all. Being an RN herself makes her an expert in her job. She is supportive and compassionate in a time of fear. Her paralegal Tracy is an absolute gem to work with as well. She is so easy to talk to and I felt like she has been a friend for years. I am so glad that I hired Eileen to represent me with the Board of Nursing. It was one of the scariest times in my life. Eileen is very knowledgeable regarding the BON process, and she helped me understand it. Throughout the whole ordeal she was compassionate and didn't make me feel bad about myself. She worked very hard to get me the best possible outcome I could get. I felt like I was in very good hands with her and her staff who is also great. Going before the BON is a horrible ordeal that I would not wish on anyone, but if you find yourself in that position, I highly recommend that you hire Eileen to represent you.

I hired Eileen back in 2020 after getting paperwork from the BON. She helped me prepare my official letter to the board. In 2022, she helped me prepare for my meeting with the BON. She was personable, professional and knew how to present to the BON. I would recommend her to any nurse that’s looking for a RN attorney.

Eileen was so kind and compassionate. She went above and beyond what you would expect of an attorney. She listened to me, encouraged me and helped me get through on of the worst experiences in my life. I was terrified at the prospect of a hearing in front of the Medical Board. Eileen was knowledgeable and reassuring. She was able to get the best resolution possible in my situation. She was able to work with the board so that I did not have to go to a hearing. Her staff was just as great! If you ever need an attorney to help you with your case with the Board, I would definitely recommend Eileen.

I have had Eileen work with me on multiple issues including responses to the Virginia Board of Medicine regarding a practice complaint as well as self reporting on a malpractice claim. Each time, she has put my mind at ease knowing that she was working for me and the best possible outcome. She also helped me to navigate a very sensitive situation that could have impacted my ability to practice medicine. She is a kind, caring professional that knows her field well. I recommend Eileen Talamante highly for nurses, this is the lawyer you need on your side when you hear from the board. Please contact Eileen when the board calls you or ask to meet with you initially. (I contacted Eileen after my Interview with the board, never do this the interview from the board did not document important details).Eileen is a listener she takes time to listen to the case. Her experience as a nurse and lawyer for nurses makes you comfortable in explaining all details honestly of what occurred. I was accused falsely of harming a patient. Eileen represented me by preparing me , informing me what I needed to get to her; due to COVID we never met , but we communicated over the phone and mostly by email. Her Legal Assistant, Tracey is excellent and patient. ( This is a great Team), I felt a lot of love from this team. I was accused in Sept 2018, Heard from the board in Jan 2019. Hired Eileen in June 2020; completed my paperwork to Eileen on 24th Jul 2020, received a response from Eileen Jul 29th, 2020 my case was closed. God has given me victory over my enemies.

I was recently faced with an investigation by the board of nursing. I was so glad that I had Eileen to guide me through this terrible experience. Eileen and her staff was very informative and knowledgeable about the process of board investigations. She worked with me throughout the process, and know I could not have made it through this ordeal without Eileen and her team. Eileen Talamante was recommended to me when I had a review for the board of nursing. I was in a full on panic and completely in tears. Eileen immediately put me at ease, listened intently, and gave fantastic guidance. The fact that Eileen is a RN helped so much, as she knows what real nursing practice is. She stuck with me for the 2 years it took to reach resolution, answered all of my questions, and made sure I really understood all aspects of my case. I do not think I would have reached the positive outcome I did without her intervention! Eileen really fought for what was right in my case and didn't settle for any less than she agreed was deserved.

I cannot say enough good things about working with Eileen M. Talamante. Medical law is a world of it’s own and I do not believe all lawyers can offer the same experience and help. Eileen is also a registered nurse, by the way. When I was dealing with the Board of Nursing and HPMP she not only knew the ins and outs of both entities, but she knew all the people that worked for each on a first name basis.
During one the most uncertain, and difficult times in my life she was by my side and I feel like she really stood up for me and had my back. I can not imagine going through this without her and her team behind me. I feel like she really cared about my life and the outcome of our case. She explained to me everything that was going to happen and the possible outcomes so I did not feel completely lost and afraid of the unknown. She was honest and did not sugarcoat. I always knew what was going, what my part was and what I needed to do. When the case was thrown out, she called me because she wanted to be the first to let me know in person the outcome. She was almost as excited as I was.
Bottom line, I have a unrestricted license without any kind of record attached to it (as it should be.) My life could be in a very different situation right now if I had chosen to do this alone or if I had chosen a different lawyer. If you are facing any of the medical boards and know you are a good practitioner, I highly recommend using Eileen and her team of hard working, supportive and honest people.
