I called a local law firm to see if they would take my case and they no longer practiced family law. They recommended Mr Schempf and I'm glad they did. I had a rather unusual matter with my ex-wife of 15 years. He took his time in the consultation and explained, sometimes twice (sorry!) until I understood. He and his staff are very friendly and professional; they got the job done at a very reasonable rate. I won't hesitate to contact Mr Schempf for future matters and if it's something out of his wheel house I'll confidently accept his referral.

Bryan and his team took over a contentious divorce and made it simple, equitable, efficient, and painless. He did it in a fraction of the time I expected - and i received a refund for remainder of the initial retainer! what a treat! honest, trustworthy, clever, and tenacious-- the best! Kudos to a 'Switched On' legal team in the whole office.

Mr. Schempf exudes confidence, his presence in the courtroom is nothing less than commanding. You will feel as though you are his only client from day one. He is more than prepared for whatever is brought up, almost as if he can read opposing counsels mind. Never have I seen a more professional, prepared Atny . He fights for you as if you were part of his family. I can not recommend him and his staff enough....C

In a very long and drawn out divorce case (2 1/2 years) Mr. Schempf aided me in various atypical scenarios in a very professional manner. He asked pointed questions to ensure the documentation reflected my desires in the agreement. Mr. Schempf was always very prompt in responding to correspondence via email. I can honestly say he went the extra mile representing me and negotiating on my behalf. He saw me through to the bitter end. I would recommend him for legal counsel.

I was recommended Mr. Bryan Schempf for hire for my divorce lawyer through a friend who had hired Mr. Schempf himself. I could not have been happier with how professional and responsive he was for me. It was straight to business, and it was carried out as quickly and painlessly as possible. I am very satisfied, and just recommended Mr. Schempf to a friend of mine as well.

Rob has been a go to for us on all legal matters, and has always been very helpful. He's quick with responses and very down to earth. When our new baby came, he was helpful with getting our will set up, and was a huge help with my new business. We'll be using his services as long as he'll let us.

A rising superstar in the litigation field. Bert Elliott was thorough, timely, and made my entire experience enjoyable and painless. I found Mr. Elliott on a whim searching for somebody last minute. He was so great through my entire case. He always responded timely to me and kept me informed of everything. I literally faxed my information to him and he took care of everything. He knew just what to do and told me exactly how everything would happen. I would absolutely recommend anyone to use James Elliott. He was one of the best last minute decisions I've ever made and he truly knows York County. I never worried about a thing with him. He's just the person that a busy professional needs when you don't have time to deal with legal issues!

I hired Mr. Ware to represent me in criminal court for a misdemeanor case. He was extremely thorough in explaining the law and what I could reasonably expect. He did not promise an outcome but together we developed a compelling defense strategy which he successfully presented to the Judge. I would highly recommend him to anyone and would hire him again.

Colleen stood beside me in court during one of the scariest and most stressful days of my life, and she made me feel at ease and confident about everything we were doing. She was kind, and gracious, and so easy to talk to. Her courtroom strategy and demeanor were beyond strong. I deeply appreciate the work she did and the outcome we received because of her diligence. I highly recommend Colleen and the other attorneys at Holcomb Law.

Can a Lawyer Represent Me in Courts Outside of Yorktown, Virginia?

Whether a lawyer can represent you in courts outside of your city or state depends on their licensure and the jurisdiction of the court:

  • Within the Same State:
Lawyers licensed in a particular state can typically practice anywhere within that state, including all cities and counties. They can represent you in both state and federal courts located in that state.
  • Outside of Their Licensed State:
If your case is in a different state, the lawyer must be licensed in that state to represent you. However, there are exceptions:
    • Pro Hac Vice Admission: An out-of-state lawyer can request special permission to represent a client in a specific case in another state. This requires filing a motion with the court and often working in conjunction with a local attorney.
    • Federal Courts: If your case is in federal court, a lawyer licensed in any state may be able to represent you, provided they are admitted to practice in that particular federal court.
  • International Representation:
For cases outside the United States, different rules apply, and the lawyer may need to comply with the foreign country's legal requirements or collaborate with local counsel.

It's important to discuss your specific situation with the lawyer to determine if they can represent you in the desired jurisdiction and what steps may be necessary to do so.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  • Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing. Most state bar websites have an online directory for this purpose.
  • Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case. Review their website, professional profiles, and case history.
  • Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association's records.
  • Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, Google, or Yelp to gauge client satisfaction and experiences.
  • Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field and adherence to high ethical standards.
  • Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation in the legal community.
  • Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  • Ask for References:
A credible lawyer should be willing to provide references from past clients who can speak to their abilities and professionalism.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  • Relevant Documents:
Bring all documents related to your case, such as:
    • Contracts or agreements
    • Correspondence (emails, letters, texts)
    • Legal notices or court papers
    • Financial records (if applicable)
    • Evidence (photos, videos, receipts)
  • Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and parties involved. This helps the lawyer quickly understand the context.
  • List of Questions:
Write down any questions you have about your case, the legal process, fees, or the lawyer's experience.
  • Financial Information:
If your case involves financial matters, bring relevant documents like pay stubs, tax returns, bank statements, or invoices.
  • Contact Information:
Provide details of any witnesses or other parties relevant to your case, including their names and contact information.
  • Personal Identification:
Bring a valid photo ID for verification purposes.
  • Pen and Notebook:
Take notes during the consultation to remember important points discussed.
  • Budget Constraints:
Be ready to discuss your budget and any financial limitations so the lawyer can provide appropriate guidance on fees and payment options.
  • Openness and Honesty:
Be prepared to discuss your case candidly. Full disclosure allows the lawyer to give accurate advice and anticipate potential challenges.
