Everyone at Montoya Hinckley was so very helpful during a difficult time. Kind, compassionate, always willing to explain and answer questions, but most importantly, they know their stuff.

Without the help of Kevan Montoya I know that I would not have had the successfully outcome that was achieved. He took a very difficult situation and made sure that the truth was told and presently perfectly. He was a calm and confident presence during this difficult time for our family. I very much appreciate the knowledge and support I received from Mr. Montoya. I highly recommend this firm.

I just wanted to take the time to thank everyone at Montoya Hinckley for the outstanding job that they did on my personal injury case. I was in a motor vehicle accident seven years ago resulting in health and job complications. I was worried that no firm would take my case due to its complicated and difficult nature, but Kevan and his team had no problem taking my case. They were completely up for the challenge. I am so grateful that I had them in my corner. Kevan and his team worked tirelessly on my case for seven years to get me the best settlement possible, and they absolutely did! Not only did Kevan and Tyler help get me a great settlement, but they also helped me with everything else along the way. From medical issues to job/employment issues, they were there for me every time I needed them. There is no other firm who would have worked that hard and for that long just for one case and client. They are truly the best in the business. They are the “Real Heavy Hitters”.

Kevan Montoya was able to make time for me with short notice to review and discuss my situation. He was extremely easy to talk to and listened to everything I had to say. I found his input and guidance very helpful for my issue. While I hope I do not have to proceed with an attorney involved, I definitely feel more comfortable knowing I can quickly call him if I ever need him again!

Honest, dependable, exceedingly bright, intelligent, reliable predictions and recommendations, superb case law research, tenacious pursuit for a client-oriented result tempered with pragmatism which ultimately prevailed in proving our cause and winning our case with the favorable result and vindication we sought. If we had lost the case my recommendation for Rob would be the same. I don't think anyone can ask for more in their representation. Ours was not a simple process. We felt our position was morally and legally correct and therefore we were not willing to compromise or settle. Rob stuck with us. Our case lasted 6 1/2 years involving lower court and higher court rulings, summary judgments, higher court appeals, poor and mistaken lower court rulings, and ultimately higher court rulings rectifying the lower court errors. Rob's performance throughout was excellent in all venues revealing a thorough mastery of the law and competence in strategic preparation, planning, presentation, and higher court appeal processes.

I had a lengthy employment/non-compete case that went to trial and beyond, the other side was relentless...their flashy, big city attorneys tried everything (we won, every step of the way). Rob was always beyond prepared and could counter any attack like a well experienced professional. He does his homework and it shows. He also has a gift for crafting clever & logical analogies on the spot.

Favian helped me get my DUI charges lowered to Wreck less Driving. Two years later it would come off my record and I'd be done with probation. He was fast and very professional.

Family law can often be stressful but I believe I got the best experience thanks to my attorney's hard work and approachable nature. My Favian Valencia and his staff were extremely helpful through the entire process and when I didn't understand something, they were quick to explain the next steps so that I would not feel overwhelmed. Favian also got me benefits that I did not know I was entitled to. It was extremely helpful that he is fluent in Spanish and English so that when everyone sat down to talk, we did not need interpreters for my children. He is now helping me with a worker's compensation case and I have already seen great results.

  4. What is your approach to resolving cases like mine?
Learn about their strategy, whether they prefer negotiation, mediation, or litigation.

Can a Lawyer Represent Me in Courts Outside of Yakima, Washington?

Whether a lawyer can represent you in courts outside of your city or state depends on their licensure and the jurisdiction of the court:

  • Within the Same State:
Lawyers licensed in a particular state can typically practice anywhere within that state, including all cities and counties. They can represent you in both state and federal courts located in that state.
  • Outside of Their Licensed State:
If your case is in a different state, the lawyer must be licensed in that state to represent you. However, there are exceptions:
    • Pro Hac Vice Admission: An out-of-state lawyer can request special permission to represent a client in a specific case in another state. This requires filing a motion with the court and often working in conjunction with a local attorney.
    • Federal Courts: If your case is in federal court, a lawyer licensed in any state may be able to represent you, provided they are admitted to practice in that particular federal court.
  • International Representation:
For cases outside the United States, different rules apply, and the lawyer may need to comply with the foreign country's legal requirements or collaborate with local counsel.

It's important to discuss your specific situation with the lawyer to determine if they can represent you in the desired jurisdiction and what steps may be necessary to do so.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  • Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing. Most state bar websites have an online directory for this purpose.
  • Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case. Review their website, professional profiles, and case history.
  • Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association's records.
  • Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, Google, or Yelp to gauge client satisfaction and experiences.
  • Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field and adherence to high ethical standards.
  • Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation in the legal community.
  • Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  • Ask for References:
A credible lawyer should be willing to provide references from past clients who can speak to their abilities and professionalism.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  • Relevant Documents:
Bring all documents related to your case, such as:
    • Contracts or agreements
    • Correspondence (emails, letters, texts)
    • Legal notices or court papers
    • Financial records (if applicable)
    • Evidence (photos, videos, receipts)
  • Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and parties involved. This helps the lawyer quickly understand the context.
  • List of Questions:
Write down any questions you have about your case, the legal process, fees, or the lawyer's experience.
  • Financial Information:
If your case involves financial matters, bring relevant documents like pay stubs, tax returns, bank statements, or invoices.
  • Contact Information:
Provide details of any witnesses or other parties relevant to your case, including their names and contact information.
  • Personal Identification:
Bring a valid photo ID for verification purposes.
  • Pen and Notebook:
Take notes during the consultation to remember important points discussed.
  • Budget Constraints:
Be ready to discuss your budget and any financial limitations so the lawyer can provide appropriate guidance on fees and payment options.
  • Openness and Honesty:
Be prepared to discuss your case candidly. Full disclosure allows the lawyer to give accurate advice and anticipate potential challenges.
