Pros
1
Knowledgeable and experienced in workers' compensation and social security disability claims
“Her knowledge of work comp rules and laws immediately made me feel better.”
2
Effective in obtaining favorable settlements and benefits for clients
“She got me a great settlement in a timely manner.”
3
Responsive and communicative with clients
“She ALWAYS returned my phone calls when I left messages if I did not reach her right away.”
4
Provides clear explanations and updates throughout the legal process
“Of course if it was something that I just needed a quick answer on, of course I talked to her assistant or paralegal, they were awesome. They understood exactly what was going on in my case and what needed to be done and if not, they would refer to Rachel.”
Cons
1
Lack of personal communication and client meetings
“I can count the number of times I spoke with her on one hand. And believe it or not, the case is over but I never once, met her.”
2
Disregard for client requests and preferences
“I had asked for things to be emailed, not sent via usps, (I live in a small town and didn't want everyone knowing my business) this was NOT done.”
3
Potential conflicts of interest and pursuit of higher fees
“She makes more money the longer the claim is in process since she gets a percentage of the back-pay, so it's obvious that she will sabotage a case early then let another fight for it, only to shark back later to drink the blood which she could have prevented in the first place.”
4
Unwillingness to meet with clients before hearings
“She showed up at the exact time of the hearing and NEVER spoke with me prior. She lost my case and when I called to talk to her about it she told me her policy is to NOT meet with her clients ahead of time, that she has too many clients to do that and if she met with everyone that's all she would be doing.”
5
Delay and obstruction of client cases even after withdrawal
“she is still haunting my case to this day by substantially delaying my benefits with false fee claims that the judge ruled against over eight months ago.”

Attorney Rachel Fitzgerald is so brilliant! She got me everything I deserved from my work comp case! I couldn’t be happier. It was a long drawn out 4.5 year battle with my previous employer and she stuck it out and won me my case against them. Through all the trials and tribulations with this case Rachel made sure to have her team in constant contact with me. I got updates regularly on what was happening and in the end we prevailed. We settled WITHOUT having to go to court and I got all the medical bills paid by my prior employer and a settlement for my disability rating and lost wages. I couldn’t be happier. I HIGHLY RECOMMEND Attorney Rachel Fitzgerald!!

My workmans compensation settlement took 3 years, but Rachel didn't give up. I received a great settlement amount and would highly recommend Rachel and her team. Sara, her paralegal, was fantastic and got back to me almost immediately on all issues. Rachel is also handing my husband's disability claim. I am beyond thankful for Rachel and her staff.

I had a previous Attorney with little results after 2 yrs on the case. I had more progress from Fitzgerald Law in two weeks . Very professional and efficient staff. They were very good with communication. I have highly recommend them to family and friends. My case has not been completed, but I am very happy so far.

It was so nice working with him! He truly cared about the situation we were going through. He dug deep to find the answers we needed and was able to help us out tons before he even requested a retainer! He has been truly amazing to work with. I would suggest him to anyone! Can't thank him enough for all of the help he was able to provide for my family. Definitely will be coming back to him if needed in the future.

I’ve never had any experience with having a lawyer, and honestly it terrified me. Thankfully Jacob was by my side for this case. His confidence assured me I was in good hands. He’s very calm and collected, making this situation a breeze when I expected a hurricane. If I ever get into any kind of legal conflict, Jacob is the first one I’m calling without a doubt.

  2. How do you charge for your services, and what are the estimated costs?
Understand the fee structure, including hourly rates, flat fees, retainer fees, and any additional expenses.
  3. Who will be handling my case?
Find out if the lawyer will handle your case personally or delegate tasks to other attorneys or paralegals.
  4. What is your approach to resolving cases like mine?
Learn about their strategy, whether they prefer negotiation, mediation, or litigation.
  5. What potential outcomes can I expect?
While no lawyer can guarantee results, they can provide an assessment of possible scenarios based on their experience.

Can a Lawyer Represent Me in Courts Outside of Appleton, Wisconsin?

Whether a lawyer can represent you in courts outside of your city or state depends on their licensure and the jurisdiction of the court:

  • Within the Same State:
Lawyers licensed in a particular state can typically practice anywhere within that state, including all cities and counties. They can represent you in both state and federal courts located in that state.
  • Outside of Their Licensed State:
If your case is in a different state, the lawyer must be licensed in that state to represent you. However, there are exceptions:
    • Pro Hac Vice Admission: An out-of-state lawyer can request special permission to represent a client in a specific case in another state. This requires filing a motion with the court and often working in conjunction with a local attorney.
    • Federal Courts: If your case is in federal court, a lawyer licensed in any state may be able to represent you, provided they are admitted to practice in that particular federal court.
  • International Representation:
For cases outside the United States, different rules apply, and the lawyer may need to comply with the foreign country's legal requirements or collaborate with local counsel.

It's important to discuss your specific situation with the lawyer to determine if they can represent you in the desired jurisdiction and what steps may be necessary to do so.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  • Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing. Most state bar websites have an online directory for this purpose.
  • Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case. Review their website, professional profiles, and case history.
  • Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association's records.
  • Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, Google, or Yelp to gauge client satisfaction and experiences.
  • Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field and adherence to high ethical standards.
  • Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation in the legal community.
  • Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  • Ask for References:
A credible lawyer should be willing to provide references from past clients who can speak to their abilities and professionalism.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  • Relevant Documents:
Bring all documents related to your case, such as:
    • Contracts or agreements
    • Correspondence (emails, letters, texts)
    • Legal notices or court papers
    • Financial records (if applicable)
    • Evidence (photos, videos, receipts)
  • Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and parties involved. This helps the lawyer quickly understand the context.
  • List of Questions:
Write down any questions you have about your case, the legal process, fees, or the lawyer's experience.
  • Financial Information:
If your case involves financial matters, bring relevant documents like pay stubs, tax returns, bank statements, or invoices.
  • Contact Information:
Provide details of any witnesses or other parties relevant to your case, including their names and contact information.
  • Personal Identification:
Bring a valid photo ID for verification purposes.
  • Pen and Notebook:
Take notes during the consultation to remember important points discussed.
  • Budget Constraints:
Be ready to discuss your budget and any financial limitations so the lawyer can provide appropriate guidance on fees and payment options.
  • Openness and Honesty:
Be prepared to discuss your case candidly. Full disclosure allows the lawyer to give accurate advice and anticipate potential challenges.
