Cons
1
The lawyer is accused of poor communication, failing to keep the client informed, and making unilateral decisions without the client's input
“He does not communicate with his clients instead he gets his secretary/legal aid to do the talking. Then when he does talk he tells you one thing then he changes his mind and his secretary tells you that the defendants are going to do another and something you had told Rick you did not want and you want to know why it changed all of a sudden and so you want to speak with him about it & he has his secretary tell you he will be able to talk to you in two weeks.”
2
The lawyer is alleged to have mishandled the case, made mistakes in depositions, and failed to inform the client of important details
“I was told nothing. Now he is sueing me for $6,018 when I signed a contingency fee agreement with him inwhich he withdrew from the case. He spent his firms money without going over any thing with me or if I wanted to spend that money and If the client is going to have to pay him back then you should be advised as to what is going on but nothing he did helped my case.”
3
The lawyer is accused of being biased and not properly investigating or considering the client's concerns in a custody case
“Against the father from the start in a custody case. Didn't care about his concerns for his sons safety. Spent 1 hour at fathers house, and over 4 at mothers. Talked to child Mrs. Flock was GAL for at the mothers house several times instead of a natural place. Targeted a teen step-son, on the fathers side, who she never talked to.”

You are better off representing yourself. She waited until after telling me she would take my case AND getting paid that she was unfamiliar with the family laws of Trempealeau County. If you care at all about the best interest of your children stay clear of this one!

If I was given a choice I would have given 0 stars. A very poorly educated GAL. She was late to both appointments I had with her, she was rude and very disrespectful to say the least, and I was verbally attacked. She has absolutely zero knowledge of domestic violence. She slept during my trial, never contacted any of my reference and only spoke to my child for a total of a half hour. She refused to take into consideration any of my concerns which included alcoholism, verbal and physical abuse, anger issues as well as many others. She instead accused me of taking my concerns straight out of a horror book. Also trying to get her to return a phone call forget it. I waited sometimes a month for a response. Clearly one sided from the start. Incredible sad children have to suffer because of her negligence.

Literally, I had him as an attorney when he was working for the public defender, and I have to tell you I was pretty messed up meeting this guy, just having been arrested with a large amount of drugs, and having my whole life crumble all while i was out of my home state traveling through this tiny town. Its a long story. I can not speak any higher of any attorney, let alone at the time a public defender. Kyle is well know throughout the area as being a hard working skilled attorney.

I recently hired Kyle for a 17 year old felony and misdemeanor warrant and was a little skeptical trusting an attorney that I found online, especially when I live FL and the case is in WI. I contacted Mr. Davis and was given a free consultation and spoke with several attorneys as well in the 50 mile radius of Kyle, one thing that stuck out to me about Davis was that he did not sell me a dream of having all charges dropped like most of the attorneys that I had spoken with. Mr. Davis was upfront with me from day one and stated that it was an unusual case and he could not promise me a resolution that I would be happy with. I found this more realistic than someone other lawyer saying send me $3,500 and I can guarantee to have all charges dropped without even speaking to the DA or me not having to travel to WI. Long story short I paid Kyle the retainer and he went to work that day, and a month and half later he was able to produce results that I was beyond happy with. I now have a clear record and conscious thanks to Mr. Davis. Definitely worth the money and if I need an attorney again, Kyle will be my first choice with no doubts. Thank you Kyle

So far so good, i will definitely write more once my case is over, but so far, so good. He has always been available whenever I have questions or concerns, and has been reassuring in the process that is ahead of me.

If I could make this negative 10 stars I would, but just for John specifically. Horrible trial attorney, missed a plethora of facts. He suffered a heart attack during trial, but postponed for one day. The most unprofessional, unprepared attorney you could hire.

Understand the fee structure, including hourly rates, flat fees, retainer fees, and any additional expenses.
  3. Who will be handling my case?
Find out if the lawyer will handle your case personally or delegate tasks to other attorneys or paralegals.
  4. What is your approach to resolving cases like mine?
Learn about their strategy, whether they prefer negotiation, mediation, or litigation.
  5. What potential outcomes can I expect?
While no lawyer can guarantee results, they can provide an assessment of possible scenarios based on their experience.

Can a Lawyer Represent Me in Courts Outside of Sparta, Wisconsin?

Whether a lawyer can represent you in courts outside of your city or state depends on their licensure and the jurisdiction of the court:

  • Within the Same State:
Lawyers licensed in a particular state can typically practice anywhere within that state, including all cities and counties. They can represent you in both state and federal courts located in that state.
  • Outside of Their Licensed State:
If your case is in a different state, the lawyer must be licensed in that state to represent you. However, there are exceptions:
    • Pro Hac Vice Admission: An out-of-state lawyer can request special permission to represent a client in a specific case in another state. This requires filing a motion with the court and often working in conjunction with a local attorney.
    • Federal Courts: If your case is in federal court, a lawyer licensed in any state may be able to represent you, provided they are admitted to practice in that particular federal court.
  • International Representation:
For cases outside the United States, different rules apply, and the lawyer may need to comply with the foreign country's legal requirements or collaborate with local counsel.

It's important to discuss your specific situation with the lawyer to determine if they can represent you in the desired jurisdiction and what steps may be necessary to do so.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  • Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing. Most state bar websites have an online directory for this purpose.
  • Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case. Review their website, professional profiles, and case history.
  • Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association's records.
  • Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, Google, or Yelp to gauge client satisfaction and experiences.
  • Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field and adherence to high ethical standards.
  • Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation in the legal community.
  • Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  • Ask for References:
A credible lawyer should be willing to provide references from past clients who can speak to their abilities and professionalism.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  • Relevant Documents:
Bring all documents related to your case, such as:
    • Contracts or agreements
    • Correspondence (emails, letters, texts)
    • Legal notices or court papers
    • Financial records (if applicable)
    • Evidence (photos, videos, receipts)
  • Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and parties involved. This helps the lawyer quickly understand the context.
  • List of Questions:
Write down any questions you have about your case, the legal process, fees, or the lawyer's experience.
  • Financial Information:
If your case involves financial matters, bring relevant documents like pay stubs, tax returns, bank statements, or invoices.
  • Contact Information:
Provide details of any witnesses or other parties relevant to your case, including their names and contact information.
  • Personal Identification:
Bring a valid photo ID for verification purposes.
  • Pen and Notebook:
Take notes during the consultation to remember important points discussed.
  • Budget Constraints:
Be ready to discuss your budget and any financial limitations so the lawyer can provide appropriate guidance on fees and payment options.
  • Openness and Honesty:
Be prepared to discuss your case candidly. Full disclosure allows the lawyer to give accurate advice and anticipate potential challenges.
