My spouse and I received a NOID after our I-485 AOS interview requiring us to submit the infamous(dreaded) I-601 waiver or face a denial. We only had a month to respond and naturally I wanted the best chance of success. I've never been more fond of someone I've never actually met in person. I found Attorney Meisa Banh through US Legal Services, but also discovered many glowing reviews of her on Yelp. She's the epitome of professionalism, and her legal staff, specifically Tessa Fung, is a joy to communicate with. Now, let's rewind about 6 years. I learned that I have a daughter. This was eventually confirmed, not through her mother, but through child support. From that moment, I made every effort to be a part of our daughter's life. Unfortunately, her mother has been less than agreeable. It's been a struggle involving court hearings ever since, and not particularly fair ones, imo. Custody Court isn't much better than Child Support Court. However, I will say that had it not been for Custody Court, I'd be paying a large amount of child support with no say in our daughter's life nor any knowledge of her whereabouts. That was the hand our daughter's mother dealt me. After several hearings and many attorneys, I learned that regardless of what the law says, your chances of winning are only as good as the attorney who actually believes in and will fight to enforce it. I've not found many willing or capable of making that effort. Few would even listen to what I had to say before concocting what seemed to be a cookie cutter routine argument to recite in court. When I provided evidence of the mother violating the court order it was ignored. When I brought it up in court, the judge refused to allow me to speak to it, stating that I have a lawyer for that. That attorney said nothing. Hearing after hearing, what seemed to be open and shut cases, imo, resulted in less than desired outcomes. I interviewed several attorneys and worked with a handful. You know the rule of law has gone out the window when a number of attorneys state their understanding of it to mean one thing and a separate number state it to mean the complete opposite. Some have even ridiculed me for being in opposition of what seems to be a growing alternate understanding. I'm retired law enforcement. And while I realize that does not make me an attorney, it seems that if we're all governed by the same set of laws, we should on some level be in one accord. That's what I like about Meisa. She is, imo, in accordance with the law. I don't have to wonder about 'this' or 'that'. And what I may not have understood, Meisa or Tessa or both were ready to provide ample explanation. It is a breath of fresh air to see Meisa in action. She's easygoing, but direct and speaks with certainty. She listens to my concerns and asks for feedback. She's knowledgeable of the law, but more importantly, she's not afraid to respectfully challenge the judge. She fights! The judge currently assigned to my case, seems to favor the best interest of my daughter's mother rather than my daughter. And she's been less than fair, imo. So, I don't know how much more substantial a role I'll actually have in my daughter's life going forward. But I know if it's the Lord's will, Meisa will find a way to make it happen. I followed their guidance diligently in the last week and a half before the deadline. After submission, I waited for a little over two weeks and received the news that my case had been approved.
