Background: Most people will emphasize on the saying "I was at the wrong place at the wrong time" when they are accused of driving under the influence. In my defense, that saying is the epitome of my arrest on March 19th, 2017. I was hit by a drunk driver who totaled my car after failing to yield on a left turn. Like anyone who has been arrested for a DUI, I was terrified. More about the accident, and less about the events that transpired later that night. To this day I can remember the night as if it just happened. Anyways. Back to the story. I was questioned by a police officer after being removed from my vehicle about what I had to drink that night, and well the rest was history. Failed the field sobriety test according to their standards, and blew a 0.07. Still, I was arrested and accused of driving under the influence and driving with a BAC of 0.08 and above at the time of driving. To make my situation worse, I was a newly registered nurse in school finishing my Masters of Science in Nursing. Everything to lose, nothing to gain. I was emotionally distraught and terrified when I was released. Having no experience in DUIs, or defense attorneys I began scrambling for an attorney that would defend my case. It took TWO YEARS for my case to be resolved. My attorney Peter Iocona and his partners, spent TWO YEARS being persistent with bringing my charges down to at LEAST a wet and reckless because that is what my case was worth. TWO YEARS were filled with arraignments, pre-trials, and meetings with DA. TWO YEARS later and the DA still would not budge due to the lack of justice the system actually cared about. TWO YEARS later my options were to 1. accept the DUI charges (2 charges) 2. go to trial. With support from my family, friends, and Peter I took my case to trial. Those of you who end up in a trial, or are thinking about it, be prepared for the emotional ride But also know that Peter Iocona is THE best DUI defense attorney off trial and in trial. He comes well prepared to the trial, and is knowledgeable. He is careful and experienced in all the right areas. Peter is absolutely phenomenal in trial with his organized approach. One of the best criminal defense lawyers in Orange County. I was scared s***less when was confronted with a possible 2 year prison sentence but Peter walked me through the whole thing every step of the way. Always answered my messages or calls when I had a question and told me exactly what to do throughout the whole ordeal. When cops tell you to tell them everything because they "want to help you" don't believe them. When Peter tells you to tell him everything because he wants to help you, obey his every word. Needless to say the whole thing took about 6 months and the case was eventually dismissed. His services are not cheap but his expertise is what you pay for. Thankfully he was able to work with me.
