Jasmine Kiai's law office is wonderful. She took on my case for the NIW application and worked closely with me throughout the process. She was responsive to my emails and questions promptly. He strung me along for three months, agreed to take the case, then never sent me a fee agreement, never called me and when I emailed to follow up on the status of the lawsuit that was to have been filed, he informed me that he had changed his mind and decided not to take the case.
Very very very disappointing...
11/9/22 Response to Owner's comments:
Mr. Grundon, your assertions are defamatory:
1) The previous firm was never paid costs it was owed for their collection efforts - The firm was paid over $10,000 costs for doing little useful work. I paid the costs on behalf of my client when I had no obligation to do so. Any remaining costs due are not owed by me pursuant to the contract I had with the firm.
Mr. Van Der Walde misrepresented how the previous firm was let go in order to avoid addressing the effect of the previous firm's lien on the case - they were let go because they would not file a lawsuit for fraudulent conveyance and had exhausted their collection efforts through judgment collection law. After 8 months, they had not obtained any money on behalf of my clients on a $40 million judgment.
At that point I walked away. We never made a formal agreement to take the case - he agreed to take the case after talking to former counsel, we agreed on fees, costs and the scope of work to be done - he told me he would be sending out a fee agreement. After several months, I followed up by phone and e-mail, did not receive a return call, rather only an e-mail stating that because of the complexity, amount of time and liens he would be passing on the case.
Here is my e-mail from August 29, 2022, to him following up on the agreement:
"Bryan-
In follow up to your July 21, 2022, e-mail please advise as to the status of our agreement contingency/cost retainer agreement.
Last we communicated, you had estimated a filing by the end of the summer. Time has a way of sneaking up and I wanted to follow up on your thoughts on a filing date. This is particularly important vis-à-vis the next point, the Sacramento Bee is doing a follow-up story about collection efforts and Dause's alleged efforts to conceal money - I would like to tell them about working with you, but don't want to tip our hat too much so we can hit defendants when they are not prepared.
Please advise asap."
He replied:
"Good Morning,
I've decided that I must pass on the case. The complexity, the liens by the prior counsel and the amount of time and effort needed to do the thorough job to have a shot at this all contributed to this decision. I am sorry. I wish you the best of luck."
Bryan, if you read this, you should immediately retract the above defamatory statements you have now published through YELP!
