I went to Gary with an invention not knowing how to proceed. Gary went over the invention with me and took me to a whole different outlook on my product. He quickly got me into the patent process. Not only did Gary take on the patent process, he was very helpful with many ideas on how to proceed with the patent as well as a lot of the necessary business aspects of the invention. I really appreciated Gary's suggestions and demeanor throughout the process. Gary has helped us take our invention to a whole new level and we are very encouraged with the potential of our invention thanks to Gary. I would highly recommend Gary to anyone looking to patent any type of product.

I was introduced to Gary D.E. Pierce in 2014. After a very difficult legal dispute involving a trademark issue in which we basically lost the case, Gary was presented the settlement that was handed down to our company to review and see if he could make any suggestions. You must understand that our company felt very bad about the outcome of the settlement. Gary met with us a short time later and presented 5 or 6 possible solutions that could possibly enhance our position in the future. One remedy that he proposed was truly exceptional and opened the door for a legitimate improvement over all that we could have hoped for. Gary was diligent, resourceful, and extremely pleasant to work with. I could not be happier with the outcome. I esteem Gary as perhaps the best legal council I have every hired and continue to use him today. He is an 11 on the scale of being outstanding in his profession. I am proud to know such an outstanding individual and professional as Gary D.E. Pierce.

“Erin Jacobson is hands down the best music and entertainment attorney that I’ve ever dealt with! I’ve hired many lawyers to assist in music licensing and publishing deals over my career and have have not had any that I would rave about. They all essentially did their job to some extent, but none of them actually worked hard for me or even pretended to be interested. Erin is not only very intelligent and professional, she also really cares about my business and takes pride in her work. Often, when you give a lawyer a retainer you have to hunt them down for updates…not Erin. She’s easy to get in touch with, quick to respond and always on top of it. If you want an attorney that will work hard for you, I’d obviously recommend her!”

I was searching for a Copyright Law Attorney because of a letter I received from another lawyer threatening me because I posted a wedding video on YouTube that contained a popular song that allegedly violated copyright laws. As a very small Wedding Video company I got very scared. To my surprise Mr. Golab answered the phone himself and it was already 7:00PM when I called! He actually gave me free advice and the GOOD kind of advice which is why I am still going to hire him in the near future to write a few contracts for me to use in my business. I am very pleased to have spoken to him! I believe that Mr. Golab has passion for what he does; it's not every day you speak to an attorney that is willing to help the way he did. Legal entities need more people like Mario Golab.

Lachauna is an excellent attorney who is accessible, very responsive, thorough, and patient. She is such a pleasure to work with! As an attorney myself, I know it is advisable to seek counsel in areas in which I am not an expert, so when I was ready to file my trademark application, I contacted Lachauna because I know she is not only highly skilled in NIL, i.e. name, image, and likeness, but also in intellectual property in general, which includes trademark law. Lachauna walked me through what the process would look like, including the potential challenges and estimated time it would take. Can I tell you, the way this trademark application was thoroughly completed and filed, no challenges arose, and the timeframe Lachauna estimated was pretty accurate. I am happy to report that my trademark is now officially registered! I highly recommend Lachauna Edwards for your NIL or intellectual property needs!

I am an archaeologist with an international profile (see my profile in the London Times website entitled "The Real-life Indiana Jones and the Mansion of Doom"). I have been keenly interested in Homer and his great epic poems, The Iliad and The Odyssey, and I created a multifaceted project to celebrate and research Homer, called The Homeric Project (homericproject.com). A part of that effort was to conduct archaeological fieldwork on a Greek island, searching for the lost Palace of Odysseus from the Odyssey. As part of my overall research on Homer, I believe I have discovered a lost code involving sacred symbolic numbers that Homer, I believe, intentionally incorporated into both his epic poems. I wrote up my research, with my new discoveries, in a research paper entitled, "The Mystery of Homer's Numbers," which I copyrighted with the US Copyright Office in 2013. The reason I retained Mr. Lauson was due to the following. I was conducting my field work in Greece with a colleague, with whom I also spent time writing on a projected book about the project. I had a falling-out with that colleague and terminated the joint project (including the book). In a subsequent letter from the colleague, a claim was made that she had filed a joint co-authorship of my "Homer's Numbers" paper with the US Copyright Office and it was implied that it had not only been applied for, but had actually been accepted and was in force. Therefore, my former colleague made those claims, which were not true. Since I could not stand to have such claims made on my original research, my discoveries and my paper -- and especially after my ex-colleague had an attorney send me a letter re-affirming the false claims -- I was forced to seek a professional attorney to defend me, my work and my reputation. I'm glad I found Mr. Robert Lauson because he did an outstanding job in straightening the mess out. He reviewed the facts I gave him, including a copy of my 2013 copyright which pre-dates the alleged copyright of 2014 by a year. His due diligence also disclosed that my ex-colleague did not submit my paper for copyright as stated. In fact, the copyright was not submitted until May 6 of this year (2015). Mr. Lauson completely agreed with my position on the whole matter and, unlike my ex-colleague's attorney who wrote an inaccurate and disparaging letter to me, Mr. Lauson wrote him back a very professional letter factually pointing out all the "misrepresentations" that my ex-colleague's attorney had stated based on the wrong information he had received from his client. Mr. Lauson also quoted in the same letter the legal precedents which supported my rightful legal interpretation of the case. Furthermore, and subsequent to that letter, Mr. Lauson was proactive with the US Copyright Office and got them to reject my ex-colleague's attempt to make a claim on my exclusive intellectual property. Hopefully that good action will have the effect of being a final termination to the attempt to make any claims on my original research and written research paper. In short, Attorney Robert Lauson was cordial, very professional and knowledgeable about how to handle my case. Moreover, he did an outstanding job of dealing with my adversary's attorney and with straightening out the situation with the US Copyright Office, that resulted in a decision by it in my favor. I can't thank him enough for his good work, which has not only set the record straight but has gone a long way to restoring my peace of mind about my original work and my career.

I was intimidated to speak with a lawyer about an area of the law that was totally foreign to me but I needed a professional opinion of my idea and the likelihood of obtaining a patent. It was as important to me to get an assessment, as it was to learn as much as could about the process. I did not want to drop my idea on a desk and wait for results. A friend of mine referred me to Bob. I knew at the end of our first appointment that he fit my requirements. He explained that his job is to interpret the Patent Law and apply it to my idea, so that if necessary, modifications can me made to be successful with the Patent Office. He made suggestions that gave me food for thought, including that I should consider a trademark for the name. I was very comfortable speaking with him and liked that he took the time to teach me. I left his office feeling good and knowing what I needed to do to keep rolling, what to expect, and that I made contact with a friendly lawyer that will guide me without me being intimidated. Since that appointment, he has communicated with me often to make sure we are progressing. I would recommend him to anyone seeking a patent.

My wife and I launched a new vegan food business in May of 2018. Our first product went on the shelves and sold out quickly. We had waited for our first reorder before shelling out the money from our shoestring budget to register our Trademark at the USPTO. Huge mistake! Some person applied at the USPTO for our Trademark just after our product went on the shelves, and two days before we attempted to apply. We learned a bit later, after some investigation, that they had no products, nor any legitimate proof that they actually intended to use the Trademark. We quickly hired Jackson and he wrote them a cease and desist letter. Their attorney notified us if we paid them $15,000, they would be happy to withdrawal their application and go away. Your classic shakedown. Jackson laid out all the evidence, making a strong case for our rights to and implied ownership of the Trademark. He is a true expert in Trademark law, using previous case law rulings that led their attorney, who seemed to possess little knowledge in this field, to quickly and dramatically lower their offer. The USPTO is a system of nightmarish bureaucracy that allows even clear-cut extortion schemes like the one we experienced to thrive. Having a Trademark Attorney as experienced and knowledgeable as Jackson can help you to avoid these kinds of problems. We will definitely use him again. Thank you Jackson!

Although I kept telling Verizon they had the wrong number, both by phone and using Verizon's own online contact system, the calls kept coming. Verizon insisted they did not make calls like that and that the calls were not originating from them. When the calls increased (numerous calls in one day), I turned to Kim. She explained the federal statutes that cover this and I called Verizon again, mentioning key words. I was transferred to someone who found my number was incorrectly listed as an alternate contact number and the calls stopped! However, that was the last piece of the puzzle we needed and Kim went after Verizon and negotiated a very nice settlement. THANK YOU, KIM! No more calls AND a nice payoff.

Ms Tamburrino is represented me in a personally painful bankruptcy filing. Upon our first meeting, she explained the process with professionalism and compassion. She has consistently responded quickly to my questions and concerns and has followed up with unanticipated issues that have arisen. She has made a dreadful situation less painful and continues to keep me informed. If you are thinking about the option of bankruptcy, I do recommend that you consider speaking with Stacy. It took me many, many months - and many sleepless nights - before I took the first step. Looking back, the process was less painful because of solid representation. Looking forward, things become under control and the rebuilding begins!

Dennis did a great job in getting my patent off the ground and fully approved. He knew absolutely nothing about my product when we started, but it didn't take him long to have a complete understanding and to be able to prepare my case for the examiners. I'm not funded like the Boeings and Monsantos of the world, and it was quite unusual to find that Dennis caters so well to small businesses. Knowing what I do now, I think it is remarkable that I was able to go through the entire patent process so affordably. If I went to the large firms, hourly rates just would not have been feasible. Not only does Dennis offer a flat rate fee structure, he even offers no-cost sessions occasionally for clients so you can bounce ideas off him. I plan to take advantage of this service soon. While I'm sure he can handle big firms quite well, my review has to do with how he handled my case. Just couldn't be happier.

Before working with Dennis, we worked with a couple of other attorneys to process our patent without much success. What made the difference was the time Dennis took to understand, and immerse himself in our business so he could articulate our invention in a format that could easily be understood by our examiner.

I recently hired Mr. Palmateer in a Federal trademark dispute case in which I was the defendant. First of all, Lee is very personable and an excellent communicator, which I have found to be qualities lacking in some attorneys. He is diligent about returning phone calls and e-mails and is scrupulously honest in his billing practices. He is, in short, a credit to the legal profession. But don't let Lee's unassuming demeanor fool you, he excels as a litigator. In fact, he is a litigator of uncommon ability and judgment. I have found him to be tenacious in pursuit of his client's best interests, and I would not hesitate to recommend him to someone in need of a seasoned intellectual property attorney. I credit his expertise and hard work for the amicable end to my case.

I had been sitting on my business trademark for years knowing I need to secure an official trademark but clueless on where to start. I was seriously considering using an online legal filling service but very uncomfortable with the unknowns and completely overwhelmed by the process knowing there was much more that had to be considered. A colleague recommended I contact Lee. It was the best move I could have made. I called his office and he got back to me immediately. He listened very carefully and answered all of my questions to complete satisfaction. In all of our conversations I felt like we were communicating as equals. There was no condescension whatsoever. All of the fees were presented in detail and I completely trust his judgement. He is timely with any follow up issues and clear about deadlines and the consequences in regard to my application for not meeting them. I highly recommend Lee Palmateer and look forward to working with him in the future.

I can't speak highly enough about Valerie. First off, she's an amicable person. I know that doesn't count for much in a world governed by law, but just her tone of voice is so comforting. And it's nice to have a lawyer you feel like you can trust. She is a professor @ Berklee College of Music in Boston, MA. So if that doesn't scream credibility, then I don't know what does! Let's get down to business: Valerie knows everything regarding music law. Period. End. You will never need to retain another lawyer. And she's honest! I feel like most lawyers just want quick money. But her rates are surprisingly quite reasonable. I highly doubt you'll find another lawyer with rates as competitive as hers, who will put the same amount of time and energy into your case(s) as she will. Valerie helped my band with trademarks, copyrights, professional name searches, and so much more. Seriously, without Valerie we probably would have made a several major mistakes upon entering the music industry. She helped us dodge & squash all of that, along with a few red flag issues we were having with our former recording studio. I've learned so much in the process as well. As a result, I'm more aware, and I feel like a better musician now. Valerie doesn't offer free consultations. BUT the pre-consultation form is pretty much a free consultation in itself. I like it because it asks you questions that you may not have even thought of yet because you've been focused on making music/booking gigs. For example: your goals, your concept, if you have a manager/agent, your creative process, copyrights filings, etc. It gets you really thinking about the overall bigger picture. And it helps Valerie get to know you or your band better. From there, she can help guide you in the right direction. I remember my consultation with was 2 hours long. We literally covered at least 10+ different things extensively over the phone. I couldn't remember some of what we discussed the next day, but I was SO happy when 2 days later she emailed me a professionally drafted follow up consultation document that contained everything we talked about in detail. It had a glossary, and everything. Just like a book. She even included a to do list, ha! That consultation was worth every single penny! And I still reference the follow up document every now and then when I need to.

Valerie is an outstanding music attorney. She's smart, fair, organized, proactive, and a pleasure to work with. She's great at the big picture and fine details and she's excellent at what she does. Indeed, she usually finds errors in my third-party contracts that they are thrilled to learn of and fix. Valerie does what she says she'll do, for the price she quotes and in the time she says it will take. She's a woman of her word. There are never any surprises. People looking for a music attorney should jump at the chance to work with Valerie Lovely.

As a start-up entrepreneur, I was hesitant to hire an attorney for fear of the big fees and being treated as the small business owner not worthy of a big firm's time, as I had previously experienced. Kristin Mendoza has permanently changed that attitude. She has a concierge fee structure where you know the cost of a job upfront. She CARES. Kristin genuinely cares and understands the fear and stress that both the entrepreneur and seasoned business owner face in today's complex business environment. She has provided me with insightful advice that has protected me legally as well as focusing my time more productively. With Kristin, I get a forward-thinking professional who has my back because she cares not only about my business, but about me as well. Thank you Kristin for being a calm, steady voice, partner and friend!

I contacted Monroe months ago to review a situation I had to see if it was worth making a case for. He set a fair, low price for the review. He got back to me in the time frame(FAST) he set up. Adam is a helpful and genuine person who was really interested in me, my business, and how he could help me get my trademark. I tried to register the trademark myself, read the USPTO site guidelines and watched their videos... and I STILL got the rejection notice. Adam understood the problem, helped me clarify the issues, and got it registered way ahead of schedule compared to the initial time estimate. Absolutely saved me a ton of headache and worry, best money I spent all year. My trademark is announced for publication in a few weeks. This is a person to develop a business relationship with, 100%.

What a Copyright Lawyer Can Do for You

A copyright lawyer specializes in helping individuals and businesses protect their creative works by navigating the complexities of copyright law. They assist with registering copyrights, enforcing rights against infringement, drafting licensing agreements, and advising on the fair use of copyrighted material. Whether you're an author, artist, musician, software developer, or content creator, a copyright lawyer can help ensure your intellectual property is legally protected and monetized appropriately.

When Should I Hire a Copyright Lawyer?

You should consider hiring a copyright lawyer in the following situations:

  • Registering a copyright: While copyright protection exists upon the creation of an original work, registering your copyright with the U.S. Copyright Office provides legal advantages, such as the ability to file a lawsuit for infringement and eligibility for statutory damages and attorney's fees.
  • Enforcing your rights: If someone is using your work without permission, a lawyer can help you enforce your rights by sending cease and desist letters, negotiating settlements, or filing infringement lawsuits.
  • Defending against infringement claims: If you're accused of infringing someone else's copyright, a lawyer can defend you by assessing the validity of the claim and representing you in negotiations or court proceedings.
  • Drafting and reviewing contracts: When creating licensing agreements, work-for-hire agreements, or transferring ownership of a copyright, a lawyer can ensure the terms are legally sound and protect your interests.
  • Fair use assessment: If you plan to use copyrighted material under the fair use doctrine, a lawyer can evaluate the risks and advise on compliance to prevent potential legal issues.
  • International copyright concerns: If you need to protect your work internationally, a lawyer can guide you through the process of securing rights in other countries and navigating international treaties.

What Does a Copyright Lawyer Do?

A copyright lawyer provides a range of legal services related to the creation, protection, and enforcement of copyrighted works:

  • Copyright registration: Assist in preparing and filing applications with the U.S. Copyright Office, ensuring all legal requirements are met for successful registration.
  • Legal advice on protection strategies: Offer guidance on how to safeguard your work, including the best practices for documentation and disclosure.
  • Drafting and negotiating agreements: Prepare contracts such as licensing agreements, assignments, and work-for-hire agreements to monetize your work while protecting your rights.
  • Enforcement actions: Take legal steps against infringers, including sending cease and desist letters, negotiating settlements, and litigating infringement cases.
  • Defense against infringement claims: Represent you if accused of infringement, developing defense strategies and handling negotiations or court proceedings.
  • Fair use evaluation: Analyze whether your intended use of copyrighted material qualifies as fair use under the law, reducing the risk of infringement.
  • International protection: Advise on securing copyright protection abroad and complying with international intellectual property laws and treaties.

How Are Copyright Lawyers Paid?

Copyright lawyers typically charge for their services in the following ways:

  • Hourly rate: Many lawyers bill by the hour, with rates ranging from $200 to $600 or more, depending on experience and location.
  • Flat fee: For straightforward tasks like filing a copyright application or drafting a simple contract, some lawyers offer flat fees, which provide cost predictability.
  • Retainer: For ongoing services, a lawyer may require a retainer - a lump sum deposited in advance - against which hourly fees are charged.
  • Contingency fee: In some infringement cases, especially those involving significant damages, a lawyer may work on a contingency basis, receiving a percentage (typically 25% to 40%) of any settlement or judgment.

It's important to discuss payment arrangements upfront to understand the total cost and billing practices.

How Much Does a Copyright Lawyer Cost?

The cost of hiring a copyright lawyer varies based on the complexity of your needs:

  • Copyright registration: Legal fees for preparing and filing a copyright application typically range from $250 to $1,000, plus U.S. Copyright Office filing fees (which are $45 to $85 per application as of 2024).
  • Contract drafting or review: Fees for drafting or reviewing agreements can range from $500 to $2,500 or more, depending on complexity.
  • Infringement matters:
    • Cease and desist letters: Sending a letter may cost between $500 and $1,500.
    • Negotiations and settlements: Legal fees can range from $2,000 to $10,000 or more.
    • Litigation: Taking a case to court can be expensive, with costs ranging from $10,000 to over $100,000, depending on the case's complexity and duration.
  • Hourly rates: Expect to pay between $200 and $600 per hour for most services.

Always request a detailed cost estimate during your initial consultation to understand the potential expenses involved.

Top Questions to Ask a Copyright Lawyer

Before hiring a copyright lawyer, consider asking the following questions:

  1. What experience do you have with copyright law?
Ensure the lawyer has specific expertise in copyright matters similar to yours.
  2. How do you charge for your services?
Clarify the fee structure, including hourly rates, flat fees, or contingency fees, and any additional costs.
  3. What is the process for registering my copyright?
Ask about the steps involved, timelines, and what information you'll need to provide.
  4. How can I enforce my copyright if someone infringes it?
Discuss enforcement options, potential remedies, and the likelihood of success.
  5. What are the risks involved in my situation?
Whether you're protecting your work or using someone else's, understand the legal risks and how to mitigate them.
  6. Can you assist with international copyright protection?
If you need global protection, inquire about the lawyer's experience with international copyright laws and treaties.
  7. What strategies can you suggest for licensing my work?
Explore options for monetizing your copyright through licensing agreements and how to structure them effectively.

How to Check the Credibility of a Copyright Lawyer

To ensure you're hiring a reputable copyright lawyer:

  • Verify their license: Check with your state's bar association to confirm the lawyer is licensed and in good standing.
  • Review their experience: Look for lawyers who specialize in intellectual property law, particularly copyright issues.
  • Read client reviews and testimonials: Websites like Avvo, Martindale-Hubbell, or Google Reviews can provide insights into the lawyer's reputation and client satisfaction.
  • Ask for references: A credible lawyer should be willing to provide references from past clients.
  • Professional memberships: Membership in organizations like the American Intellectual Property Law Association (AIPLA) or the International Trademark Association (INTA) indicates a focus on intellectual property law.
  • Check for certifications: Some lawyers hold certifications or advanced degrees in intellectual property law, demonstrating specialized expertise.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a copyright lawyer, bring the following:

  • Descriptions of your work: Provide detailed descriptions or copies of the work you wish to protect, such as manuscripts, recordings, software code, or artwork.
  • Evidence of creation: Documentation that proves when and how you created the work, such as drafts, timestamps, or metadata.
  • Existing agreements: Any contracts, licensing agreements, or previous registrations related to your work.
  • Infringement evidence (if applicable): If someone is infringing your copyright, bring evidence like copies of the infringing material, URLs, screenshots, or witness statements.
  • Questions and concerns: Prepare a list of questions about your rights, the registration process, enforcement options, and any potential legal risks.
  • Goals and objectives: Be clear about what you hope to achieve, whether it's registering your work, licensing it, or taking action against an infringer.

By coming prepared, you enable the lawyer to provide accurate advice and develop an effective legal strategy tailored to your needs.
