It has been our good fortune to have worked with Mr. Neville for a year concerning handling of a relative's estate. Leo gave us professional, helpful, consistently good guidance as we dealt with Probate Court and all the legal matters involved with estate business. Leo was always prompt in responding to our inquiries in person, on the phone, and via email. His advice was priceless as we had never dealt with any of these legal issues before. The estate involved a group of people and Leo's expert way of managing our business made everything move along smoothly. All of us involved are very grateful to Leo Neville for everything he did for us. If you are looking for a competent, professional, trustworthy lawyer, we would highly recommend Leo Neville.

Several years ago we hired Stephen Hall to write the documents for our estate. Since then we have retained him for counsel regarding gift-giving and other items throughout the years with the latest issue being the distribution of our father’s estate. When our father died with full blown dementia he left control of his sizable estate and a portion of his holdings to an unlicensed caregiver who had being living with him for a few years. Mr. Hall immediately petitioned the court to have the person removed as trustee. In the courtroom we found Stephen to be an experienced and well prepared negotiator, he sited where the State of California form to leave an inheritance to a caregiver had not been filled out and past cases where abuse occurred; he then met our objective to have the estate put safely in the hands of a fiduciary. Stephen was confident, authoritative and direct. When we met with the caregiver in mediation to resolve the issue of their inheritance Stephen sized up the possible outcomes as new information came to light and counseled us on our options. It came to the point where we had to make a pretty tough decision. Stephen was professional and supportive as he counseled us on the monetary, emotional and time costs to us if we went to trial. This was helpful in making our decision. Stephen Hall is a man who open and above board in every aspect of his dealings. His high moral fiber comes to surface as you work through a process with him. He is committed to giving his clients the best service from himself as well as from his staff.

When my aging parents needed help with their estate planning I set out to interview attorneys for the job of reviewing and updating their existing trust. I gathered recommendations from other professionals in the community, and Stephen Hall was one of three that I met with for initial consultation. While the other two attorneys I met with were more than competent to handle the job, Mr. Hall stood head and shoulders above them both. Mr. Hall's in-depth knowledge of not only the law, but of estate tax issues as well, is a combination that I have not found with any other attorney. He asked questions none of the other attorneys asked, and provided ideas that none of the other attorneys offered either. It was a crystal clear decision to hire Mr. Hall. Since the initial work with my parent's trust, we have had him work on our own family trust, as well as my wife's parents. I have recommended him to anyone who asks, and without exception people have been profoundly pleased with the work of this office. Not only is Mr. Hall one of the most knowledgeable attorneys I've ever worked with, but his staff are all highly professional, competent, and responsive. I cannot recommend this team highly enough.

I had the pleasure of working with Nima Ashtyani to complete my power of attorney, will, and health care directive. My experience with him was nothing short of excellent. He is diligent, thorough, and very thoughtful. He spent quite a bit of time with my wife and me to ensure we carefully considered all our options when completing each document. Despite several concerns and a fair amount of revisions, Nima showed remarkable patience. Because we had such a positive experience, I referred his firm to my parents and friends. All of whom had equally positive experiences working with him. This firm is highly recommended.

I chose Rosalind as my elderly sister's attorney for making choices for Medicaid and Veteran's benefits. After a consoltation with her, we decided she was the right choice for making choices that we would need. As my sister's POA, I was afraid I would make wrong choices for her and Rosalind assured me that they would be there to help any time they were needed. She was right; she has been there with answers to any questions we have. She has always responded quickly and does not let it go until she is sure we have the answers or information we need. I am very pleased with her work and I recommend her very highly whenever we are asked about her and her team. I have recently recommended her Glenhaven Gardens director, Wendy and to my daughter-in-law for her mother. I will continue to use Rosalind's service for myself and husband as we do not have a will at this time and I now realize how important this is. Rosalind has a very outgoing and gentle personality that says she is more than just a person's attorney. She is a very caring individual that will go out of her way to make a person feel that she cares about the outcome of their life and I greatly appreciate all that she has done.

I have to apologize in a way, that I feel so bad...that I actually started to cry so hard, from all that I thought happened at his office, that I wish I could do something for the whole office to make it up to them. I am not afraid to admit when I am wrong no matter how much I have to pay for what I caused for being wrong! The office was still continuing to keep my case in good standing while I was accusing them of losing most of my evidence. They worked very hard to try and find the evidence I claimed that I had left with them at the front desk a week and a half ago. Well? I did not leave the folders for them... I left a folder for my accountant. I ended up finding the files in a bin that was unknowingly put there by my husband! I will be personally giving the office a personal apology for all of the accusations I accused them of that they were not guilty of...Please accept my apologies...

My wife and I are both Real estate Brokers. We met Atty White at the Oakland Co REIA meetings. His landlord seminar presentation was both affordable and his advice was worth his weight in gold. I could not have found better legal representation if he were my own brother. He is always absolutely uber-professional in his representations for our firm. He has also produced our family law will and trust; It wasn't cheap, but, my word, it was certainly thorough. Atty White has since represented our family in District court for everything from traffic tickets to elder care planning, to personal injury lawsuits. He has represented our firm, Real Estate US LLC in the 36th district in Wayne and Oakland counties and he excels in business and K law (Contract law) in areas like M&A, insurance, and complex, real estate title matters. I am constantly amazed at Mr. White's strengths in every legal discipline that we have discussed. He is a Real Estate Law Professor at WCC. Atty White is truly one of a kind and one of the great ones! He plans your legal strategy and the time and costs to your opposition by his taking the case to a higher court at the very outset of the case. I'd say, It is safe to assert that there is certainly NO ONE more connected in LARA agency work in Lansing than this Atty scholar. during the 2011 depression, His analytical skills provided our legal offense revealing these business speculators' debt buyers and the 50th district court tossed out their misleading, false, and scurrilous claims. These people's reprehensible shenanigans were immediately dismissed within 30 minutes, including the judge's 15-minute lecture to the plaintiffs. In our world and association, Atty White is quite a remarkable person, to say the very least.

We were so blessed to have found Peggy a during a family emergency. We interviewed a few attorneys and knew they were not the right fit. After talking to Peg we felt confident we were in good hands right from the start. She knew exactly what we needed and didn't hesitate to come to our rescue. Peg guided us and provided us with all the documents we needed to avoid a crisis. She never failed to show up in court at a moments notice and was totally prepared. As our case progressed, we never hesitated to contact Peg and always felt like we had her undivided attention. We had to rely on Peg for more than 5 years and she never tired of our questions. I have worked in the legal field for about 30 years I can say that and Peg is certainly one of the good ones!

After a glowing recommendation from her prior client, I contacted Peggy regarding my probate/will situation. Her warm and friendly manner put me at ease from the start. And even after learning that my case is in an area she no longer practices, Peggy continued talking with me for almost an hour, offering incredibly valuable advice that helped me make some key decisions. By the time we ended our conversation, I had a stronger understanding of my case, a realistic outlook on my options and two contacts for local attorneys. All this and a reassurance that if they couldn't assist, I could call her back for new leads. Even though I haven’t had the privilege to work with Peggy yet, she was such a crucial and significant part of my process. I will be forever grateful for the time she took to help me -- an otherwise total stranger. Thank you again, Peggy!

As someone whom has been around attorneys on a regular basis due to business over the course of the last thirty years, Tom Begley's Law Firm is amongst the finest legal firms I've had the experience to be around. So much so, that when I needed strong legal advice and assistance in Estate Administration, Estate Planning and a variety of other legal issues for my family, I turned to Tom and his team of professionals at Begley Law Group to handle the array of situations involved. From the outset, Tom has been professional, knowledgeable, timely and responsive; and with his Firm, has provided outstanding representation in what at times has been very difficult situations, requiring top flight legal advice and guidance, on very short notice. The only regret I have about the Begley Law Group is that I, personally, didn't utilize their services earlier, though my family has for years, with a high level of satisfaction. This is a highly rated Firm and deservedly so, unmatched integrity, honesty, ability and attention to detail are all hallmarks to their long standing history of legal service in the area. If your looking for a first rate Lawyer and Firm, look no further, Tom Begley III and the Begley Law Group "is" the Firm to go to first for Eldercare Law, Estate Planning & Administration and a variety of other legal needs in the greater Philadelphia and Southern New Jersey area.

I have had a continuing professional relationship with Mr. Rafkin for the past ten years. I was introduced to Mr. Rafkin by a third party who thought Mr. Rafkin could help in determining a course of action(s) to pursue. At our very first face to face meeting it was apparent that Mr. Rafkin is a cut above. Adam had clearly read all the background information we provided and had formulated a plan of action. He is an excellent listener and incorporated our concerns every step of the way. Mr. Rafkin is particularly skilled at establishing an objective/goal and then insuring that every effort is directed toward that objective/goal. Due to his excellent communication skills we always knew where we were and felt we were part of the solution. During court hearings, conferences, motions, orders, etc. we observed Mr. Rafkin at his finest - on his feet, responding in real time to new or changing information. He just is better than anyone else we observed at absorbing information and articulating a position. The results of the action Mr. Rafkin took on our behalf speak for themselves. We recovered funds well in excess of what we had thought remotely possible, and retained our award through appeal and appellate court. He is knowledgeable, smart, well organized, motivated and persuasive. Most significantly, Mr. Rafkin is a winner.

When starting to prepare for putting a will together, there are so many things to consider. Some things that I never even realized I had to give thought to. Before starting the process, Neal patiently met with me and my husband to discuss specifics of what it means to have a will and all the pieces that go with it, and why it's important. We left his office with the knowledge and understanding of why it's really smart to take those steps, and we were better able to have an honest discussion about all the items required to make the documents effective. Discussing end-of-life issues is never fun or glamorous, but leaving your loved ones without properly preparing for your passing is a burden that you don't want to leave with the people most important to you at a time that will be so difficult. I can't thank Neal enough for making this process much smoother than I thought it could be.

What an Elder Law Lawyer Can Do for You

An elder law lawyer specializes in legal issues that affect older adults, their families, and caregivers. These lawyers handle a broad range of topics, including estate planning, Medicaid and Medicare, long-term care planning, guardianship, elder abuse, and retirement planning. The goal of an elder law lawyer is to protect the rights, finances, and well-being of elderly individuals and to help them plan for future healthcare and financial security.

If you or a loved one is aging and facing challenges related to healthcare, finances, or legal matters, an elder law lawyer can provide essential guidance to protect your rights and interests as you age.

When Should I Hire an Elder Law Lawyer?

Hiring an elder law lawyer can be beneficial in many situations where older adults need help with legal, financial, or healthcare-related decisions. Common reasons to hire an elder law lawyer include:

  • Estate planning: If you want to create or update a will, set up trusts, or ensure that your assets are distributed according to your wishes, an elder law lawyer can help with comprehensive estate planning.
  • Medicaid and Medicare planning: If you need help qualifying for Medicaid to cover long-term care or need advice on navigating Medicare benefits, a lawyer can guide you through the application process and protect your assets.
  • Long-term care planning: If you’re concerned about paying for nursing home care or assisted living, a lawyer can help you create a financial plan and explore options for government assistance.
  • Guardianship or conservatorship: If a family member is unable to make decisions due to age-related cognitive issues, an elder law lawyer can assist in setting up legal guardianship or conservatorship to ensure their care.
  • Elder abuse and exploitation: If you or a loved one is experiencing physical, emotional, or financial abuse, an elder law lawyer can help you take legal action to stop the abuse and recover damages.
  • Retirement planning: Elder law lawyers can assist with planning for retirement, including managing pensions, Social Security, and other retirement income.
  • Special needs planning: If you have a disabled family member who requires special care, an elder law lawyer can help create trusts or other legal arrangements to ensure their long-term financial and healthcare needs are met.

What Does an Elder Law Lawyer Do?

An elder law lawyer provides a wide range of legal services to help older adults and their families navigate the complexities of aging, healthcare, and estate planning. Their responsibilities often include:

  • Drafting wills and trusts: Creating legal documents that outline how an individual’s assets will be distributed after death, ensuring that their wishes are honored.
  • Medicaid and Medicare planning: Helping clients protect their assets while qualifying for government benefits to cover healthcare and long-term care costs.
  • Establishing guardianships: Assisting families in setting up guardianship or conservatorship for loved ones who are unable to make decisions due to mental or physical incapacity.
  • Protecting against elder abuse: Investigating claims of elder abuse or financial exploitation and representing the victim in legal actions to stop the abuse and seek compensation.
  • Planning for long-term care: Developing strategies to cover the costs of nursing homes, assisted living, and other long-term care options without exhausting the elder’s financial resources.
  • Managing probate and estate administration: Guiding families through the probate process to ensure that the decedent’s assets are distributed according to the law and their wishes.
  • Setting up advance directives: Helping clients establish healthcare directives and powers of attorney to ensure their medical and financial decisions are carried out if they become incapacitated.

How Are Elder Law Lawyers Paid?

Elder law lawyers typically charge for their services based on the complexity of the case and the type of legal work involved. Common payment structures include:

  • Hourly rate: Many elder law lawyers charge by the hour, especially for tasks such as drafting documents, handling legal disputes, or providing ongoing legal advice. Hourly rates typically range from $150 to $500 or more, depending on the lawyer’s experience and location.
  • Flat fee: For specific tasks, such as drafting a will or setting up a trust, some lawyers charge a flat fee. This can range from $500 to $5,000 or more, depending on the complexity of the estate plan.
  • Retainer: For long-term legal representation, such as managing a trust or handling guardianship matters, a lawyer may charge a retainer, which is an upfront payment that covers future legal work.
  • Contingency fee: In some elder abuse or financial exploitation cases, a lawyer may work on a contingency fee basis, meaning they only get paid if they recover compensation for the client. This fee is typically a percentage of the settlement or damages awarded.

Be sure to discuss fees with your lawyer during the initial consultation to understand how you will be billed and what the total cost of services might be.

Top Questions to Ask an Elder Law Lawyer

Before hiring an elder law lawyer, it’s important to ask the right questions to ensure they have the experience and expertise needed to handle your case. Key questions to ask include:

  1. What experience do you have with elder law cases?
Make sure the lawyer has experience handling cases similar to yours, whether it's estate planning, Medicaid applications, or elder abuse claims.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, a flat fee, or a retainer, and ask for a detailed estimate of the total cost.
  3. What is the best approach for my case?
Ask for an honest assessment of your situation and what legal strategies the lawyer recommends.
  4. How long will the process take?
Whether it’s drafting an estate plan or setting up a guardianship, ask the lawyer how long they expect the process to take.
  5. Will you handle my case personally?
In larger firms, junior attorneys or paralegals may handle parts of the case. Make sure you know who will be working on your case directly.
  6. What documents should I bring to the consultation?
Ask the lawyer what documentation or information you should prepare for your consultation, such as medical records, financial statements, or prior legal documents.

How to Check the Credibility of an Elder Law Lawyer

To ensure you are hiring a reputable elder law lawyer, follow these steps to verify their credentials and experience:

  • Check their bar status: Verify with your state bar association that the lawyer is licensed to practice and has no history of disciplinary actions.
  • Look for elder law experience: Review the lawyer’s website or professional profile to ensure they specialize in elder law and have experience with cases similar to yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and success rate.
  • Ask for references: A credible lawyer should be able to provide references from past clients who have worked with them on elder law issues.
  • Check for certifications: Look for certifications or affiliations with organizations such as the National Academy of Elder Law Attorneys (NAELA), which can indicate the lawyer’s dedication to elder law.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with an elder law lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Existing estate planning documents: If you have a will, trust, or power of attorney in place, bring copies for the lawyer to review.
  • Financial records: Provide details of your assets, including bank accounts, investments, real estate, and retirement accounts, as well as any debts.
  • Medical information: If the case involves guardianship or Medicaid planning, bring relevant medical records that detail the individual's health condition and care needs.
