After filing for divorce on the grounds of physical and mental abuse, this attorney drug me through the mud. I had legal medical documentation of my diagnosis of CPTSD. NONE OF THIS WAS PRESENTED TO THE JUDGE. IM now suffering from more trauma because this attorney did not represent me as a client. THIS attorney I paid to treat me as if he represented my ex husband! I Do not recommend this person.

Don't use this firm. They fail to communicate for months. A legal issue that should've been handled almost a year ago, is still active and not showing any sign of being addressed anytime soon. Jason Graves still has my money and won't return my calls. At this point, it'd have been better to save my money and go through this process on my own. Absolutely astonished this has gone this route when it should've been a clean, no contest divorce.

Hired the firm for child, custody issues and visitation rights. They were very unprofessional assigned and reassigned me to different attorneys on a basic case the attorney I had representing me initially Jason Graves went MIA for months, and many of my legal and support needs were not met for the duration of my case, despite having paid the retainer. The order that was put in place has glaring flaws and mistakes throughout now that I have been to the process. I would not recommend this firm for anything.

I met with Nathan in regards to pursuing litigation against my HOA. When I met with Nathan he seemed extremely interested in pursuing my case. We had clear evidence of mismanagement of HOA funds and both agreed this was worth taking on. We agreed on a set initial price of 1,000 dollars for Nathan to send my HOA a certified letter demanding for my HOA to disclose their financials records (this is required by law for them to do so.) Upon leaving his office, Nathan advised me that if I didn’t want to pay all 1,000 up front, he’s completely fine with monthly installments while the initial phases were getting underway. Although we didn’t agree on any set monthly amount, I was unsure of Nathan’s record and skill as an attorney, so not knowing what to pay, I decided to go with 250.00 a month. Over the next 30 days all Nathan did was send an email to my HOA requesting their financials. My HOA essentially laughed at him and never replied. During this time I checked in with Nathan to explore what our options were going forward if they didn’t respond. Nathan was vague about his explanation and stated he would send a certified letter to them advising them that they had 14 days to respond. 14 days came and went, they simply continued ignoring us. 16 more days went by now approaching the 60+ day mark, I pay another 250 dollars. Nothing still was done. At this point it’s almost 75 days in, and I again ask Nathan what’s the delay in him sending the certified mail. Nathan then completely changes gears saying he doesn’t think we have enough information to do anything, despite him making his case clearly to me and my HOA that they were in violation of by-laws by not providing us with the financial documents. Despite these crystal clear facts, Nathan then advised me that he would need 5,000 dollars up front in order to be comfortable going forward with the case and discussing pre-trial. Having seen Nathan’s lackluster performance thus far (having not even sent the certified letter in 60+ days) I advised Nathan that I wasn’t confident in his performance thus far and would only be comfortable paying 5,000 on a contingency basis if we were to win the case (plus whatever fees he required) as any reputable attorney who’s confident in their abilities would do. After sending that email, Nathan emailed me the next day stating he would no longer be able to help me with my case. I cannot explain the rapid change in confidence and behavior, maybe he was intimidated by facing a company of this size? Either way, he got completely cold feet and stated he wanted out. Despite my immense frustration with my time and money being wasted this whole time, I accepted his resignation and requested my 500 dollars back because he decided to part ways with me not holding up his end of the bargain which was sending the certified letter. After seeing that I requested my money back, he claimed he was charging me by the hour (which we never agreed upon) and apparently typing up his two paragraph email came to 500+ dollars worth of “labor”. Seeing how Nathan failed to meet our agreed upon goal I pushed back and advised that if he wanted to take advantage of my kindness, I would simply contact my bank and file a dispute of the charges for services failing to be rendered. After sending that email Nathan called me and began screaming and cursing at me. He was using Profanity that I haven’t heard since I was in the Navy. Seeing this come from a “lawyer” was quite shocking I must say. After repeated requests for him to stop cursing at me, he then accused me of being poor. He said: “You couldn’t even afford the first 1,000 how are you going to afford 5,000 more?” Laughing in the irony to myself that it was HIS recommendation for installments. After more yelling he finally agreed to give me my money back. My recommendation? Find a lawyer that’s reputable and knows their stuff. This guy was hitting out of his league and decided to blame me for his failure.

Nathan was very knowledgeable and attentive to the issue I brought to him. Because of his counsel, I was able to get a more desirable outcome from the issue than I thought would originally happen. Nathan is very available and always seems ready to be a great resource

Met with attorney ,discussed case, was given advice on what to do , and how to proceed. Left his office with the feeling that he had Accepted the case . Mailed down payment , the following month I called to make sure all was in order and to verify payment received . After being placed on hold for a period of time , a young women informed me he decided not to take my case. Would have been nice to have been told this at time of consultation rather than a month later! Searched for the phone call they stated was made , and there was no voice message left as they stated, nor did I recognize his office number as having called.. Pleasant at consultation, and gave me no indication that he would not be taking the case. Still have not received a response as to why this change in decision was made. Retaining fee was not signed but I was not aware of this until I called . Again this was a month later. If you choose to consult, make sure you have a definitive answer as to whether he will consider your case , or a definite acceptance or refusal . I feel I was left hanging, causing my situation to be worse. I'm not mad but very disappointed in the way I was informed that he changed his mind. Let me stress he was nice at consultation and very knowledgeable ( recommendations made). The way it was handled after the consultation , was unfair and should have been handled differently.

Smith and Mirshak altered documents to take my assets and personal belongs in a divorce causing me to file bankruptcy. Smith and Mirshak worked with the opposing counsel behind my back to take assets. I listed all the assets and personal belongs in the bankruptcy papers that Smith and Mirshak took but Smith and Mirshak showed up at bankruptcy court to stop my bankruptcy. It has taken five years of going to court before a judge finally omitted that Smith and Mirshak or the courts committed fraud but I had the right to appeal per the Judge.

Joan is the epitome of class and integrity. She communicated regularly and timely with us on all matters. Her job first and foremost - and one she takes extremely seriously - is to advocate what causes the least amount of stress and strain on the child/children involved in divorce and custody. I have nothing but the absolute highest praise for Joan. I came to Mirshak and Smith after receiving less than stellar representation from another lawyer. I was told up front the costs involved as well as the caveat that costs may increase based on the length of time the case took and how many court appearances could be involved. Both Tim and Joan are professional. They work in concert at times as well as solo, but always with the needs of the client in mind. Divorce and resulting custody issues are painful. They are emotional. Sometimes the attorney has to tell the client things they may not want to hear. I can attest that Joan and Tim were always direct and honest with me. My process of retaining custody of my child began nearly twelve years ago after a contentious divorce. Joan and Tim took my case over ten years ago and continued to represent me up until the last action one year ago. Joan in particular is adept at avoiding court when possible and making both parties comfortable with the outcomes. Is Joan expensive? Yes. Was she worth every single penny? YES.

Although Mr. James is experienced, I felt that he did little to meet me half way with my case. In all honesty I felt that he was more on the side of the non-custodial parent, rather than on the side of his client (me). I say this because I did most of the leg work for him (providing financial records, employment records, etc), yet he did not subpeona the non-custodial parents records. He insisted that the non custodial parent gave a verbal record of his own records and that was sufficient in his eyes. I had proof the ex was lying, yet Mr. James swept that by the wayside. He insisted that because of the ex's occupation, the ex "would be easy to find if a child abduction occurred". Maybe he is close to retiring and that is why he had no passion or time for my case. I paid IN FULL, yet received 1/10 of the services.

Top Questions to Ask a Lawyer

When meeting with a lawyer for the first time, it's important to ask the right questions to understand their expertise and determine if they're the right fit for your legal needs. Here are some top questions to consider:

  1. What experience do you have with cases similar to mine?
Ensure the lawyer has relevant experience in the specific area of law pertaining to your case.
  2. How do you charge for your services, and what are the estimated costs?
Understand the fee structure, including hourly rates, flat fees, retainer fees, and any additional expenses.
  3. What potential outcomes can I expect from my case?
While no lawyer can guarantee results, they can provide an assessment of possible scenarios based on their experience.
  4. What is your approach to handling cases like mine?
Learn about their strategy, whether they prefer negotiation, mediation, or litigation.
  5. Who will be working on my case?
Find out if the lawyer will handle your case personally or delegate tasks to other attorneys or paralegals.
  6. How will you communicate with me throughout the process?
Establish expectations for updates, preferred communication methods, and response times.
  7. What is the likely timeline for resolving my case?
Get an estimate of how long the process may take from start to finish.
  8. Do you have references from past clients?
Testimonials or references can provide insight into the lawyer's professionalism and effectiveness.
  9. What are the strengths and weaknesses of my case?
Understanding potential challenges helps you prepare and sets realistic expectations.
  10. Are there alternative ways to solve my legal problem?
Discuss options like mediation, arbitration, or settlement to resolve the issue efficiently.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  1. Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing.
  2. Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case.
  3. Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association.
  4. Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, or Google to gauge client satisfaction.
  5. Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field.
  6. Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation.
  7. Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  8. Ask for References:
A credible lawyer should be willing to provide references from past clients.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  1. Relevant Documents:
Bring all documents related to your case, such as contracts, correspondence, legal notices, court papers, or evidence.
  2. Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and involved parties.
  3. List of Questions:
Write down any questions you have about your case, the legal process, or the lawyer's experience.
  4. Financial Information:
If applicable, bring financial documents like pay stubs, tax returns, or bank statements.
  5. Contact Information:
Provide details of any witnesses or other parties relevant to your case.
  6. Personal Identification:
Bring a valid ID for verification purposes.
  7. Pen and Notebook:
Take notes during the consultation to remember important points.
  8. Budget Constraints:
Be ready to discuss your budget and any financial limitations.

How Much Does a Lawyer Cost?

The cost of hiring a lawyer varies widely based on several factors:

  • Fee Structures:
    • Hourly Rate:
Lawyers may charge anywhere from $150 to $500 or more per hour, depending on experience and location.
    • Flat Fee:
For routine legal services like drafting a will or handling an uncontested divorce, lawyers might offer a flat fee.
    • Retainer Fee:
An upfront payment against which the lawyer bills hourly fees.
    • Contingency Fee:
Common in personal injury cases; the lawyer receives a percentage (typically 25% to 40%) of any settlement or award.
    • Monthly Retainer:
For ongoing services, businesses might pay a monthly fee for a set number of hours or services.
  • Factors Affecting Cost:
    • Complexity of the Case:
More complex cases require more time and resources, increasing costs.
    • Lawyer's Experience:
Highly experienced lawyers may charge higher fees.
    • Geographic Location:
Legal fees can vary significantly by region or city.
    • Additional Expenses:
Court filing fees, expert witness fees, travel expenses, and administrative costs may be extra.
  • Estimating Total Costs:
Request a detailed fee agreement outlining all potential costs.
Discuss any additional expenses that may arise during the case.
  • Negotiating Fees:
Some lawyers may be willing to negotiate fees or offer payment plans, especially for clients with financial constraints.
  • Pro Bono Services:
For those who cannot afford legal services, some lawyers or legal aid organizations offer services at reduced rates or for free.
