I went through a messy divorce after a long marriage. Harriet guided me through the process, made me feel taken care of and in good hands. Everyone working with her was helpful, compassionate and responsive. The case did not have to go to court, which I appreciated a lot, not only because I saved money that way, but also for the sake of the children and to get the divorce over and done with. She did an expert job and helped uncover monies my ex was attempting to hide. Highly recommended!

Working with Harriet Cohen was an exercise in extreme frustration for me. I would have had better results if 1) I defended myself; or 2) if I just used the same attorney that my ex-wife used, because I had a lot more respect for her. When I met Harriet, she quoted me her hourly rate and explained the process. The first meeting after that, I was introduced to her accountant who was to be involved about 80% of the time, thereby almost doubling the fee. For three years, I witnessed an inexcusable amount of wheel-spinning, back-tracking, and confusion. She had no regard for my financial status during the process. After almost three years, I finally told her I was running out of money and somehow she was able to quickly resolve the case. Of course, I lost a great deal of money to her, and ended up with a terribly inequitable "settlement," just to end the situation. I would never even consider recommending her

Jay Berg was retained to represent my family's Property Management company in a landlord/tenant issue. Not only did he fail to properly do his job, he was incredibly rude. His receptionist was also impossible, even raising her voice on the phone and becoming fresh for no apparent reason. I would NEVER recommend this firm. Not only did they not do their job properly, they were nasty to work with!

Over the course of two years, Berg guided me throughout a protracted neighbor dispute involving harrassment that threatened to destroy my health and property; the board on which the offender served as an officer looked the other way. Berg's experience in real estate law and commitment to educating clients on navigating the court system gave me stamina to focus on building my case for court. Fiercely protective and firmly task centered, diplomatic with difficult people at all times.

Bruce young is no stranger to disciplinary actions as a lawyer he has been disciplined for maliciously deceiving client's the disciplinary action is public record My story will Bruce is he created a false narrative on my complaint on a child abuse case and then expected me to do a deposition on a false narrative that he created and not putting my abusers in the case and sueing people that had nothing to do with the case a recipe for pure disaster and failure on me being victimized as a child through sexual assault

Reid Murdoch explained everything about my case very clearly and made sure i understood every aspect. He was able to get a misdemeanor dismissed for me and explained to the judge that a warrant I had was issued incorrectly. Reid cares alot about his clients and will do everything in his power to fight for them. Not only will he fight hard for justice for you but he took the time to follow up on the progress of my case which is not something you see everyday. Great lawyer and highly recommend. Thanks again Reid!

I recently used The Postlethwaite Law Firm PLLC for my divorce. Preston was very informative and explained everything throughout the process. Due to the pandemic and the courts being closed, various parts of my stipulation changed. Despite that, Preston went above and beyond making the necessary changes and making sure that everything was squared away. I've used a lawyer in the past, and if I had any questions or concerns they would charge me in blocks of time to answer or respond to my queries. Not so with Preston. In fact, he encouraged that I asked questions and voiced any and all concerns so I could be at ease throughout the process. I would highly recommend The Postlethwaite Law Firm PLLC and if need be, I would use them again

What an absolute CROOK. Borelli & Associates lied to me numerous times. They played bait and switch, took months to file a notice of claim that should have only taken weeks, were hardly reachable with piss poor customer service, and so petty that they actually sent me an invoice for $8.95 for postage fees after they charged me almost $6,000.00 for a notice of claim against the City of New York, applying a state law that the city is exempt from. If they were competant attorneys, they would have known that and told me from the start, instead of wasting my time and money while stringing me along. Do yourself a favor and hire a real attorney, not these shoe makers!

Then the man who works at the front desk said you have to pay $200 for consultation fee. No one mention about a fee to see the lawyer except to bring a passport and id and a ck of $2000. I hired Michael Beyda (divorce ) because I knew my husband was worth a lot of money and at the end of the day I wasn’t protected A stay at home mom married 37 years I had to go to trial and my ex didn’t want to give me anything Michael Beyda was weak in court and I was on trail My husband had told me the company was worth 8-10 mil Michael couldn’t prove it Actually Michael didn’t care enough to really investigate It cost me the proceeds of the marital home, and which Michael Beyda sent a courier to pick up his fee because my ex paid a very small portion of my legal fees and FYI I’m still paying legal fees because my ex still isn’t honoring the stipulation but in regards to the company he owned I received $200,000 (final) but knew he would sell for millions and Michael Beta ““ said to me if you your going to get the gains in the future you’re also responsible for the losses that advice was horrible and my emotions were all over the place He was hired to protect me and didn’t Once the judge signed the papers and the divorce was final, my ex-husband sold the company for $42 million and you know who is struggling financially me and Michael Beyda Ran off with hundreds of thousands and never looked back He actually had the nerve to say to me maybe you’ll come into an inheritance one day really, karma He has ruined my life

While I have not had much interaction with lawyers, I am a successful, high profile executive with more than 20 years of experience. Mr. Beyda is the weakest and most selfish person I have ever met. My particular case was all about common sense and should have been a lay-up for anyone with a head on their shoulders. Instead, I found myself in a constant defending position with a judge that paid zero attention to Mr. Beyda or whatever he said. Not only was he not aggressive, he was fixated on money. From day one, his questions were around how much I made, how much I had on my accounts and where was "other" money. After getting pounded at each and every appearance, rather than answer questions about strategy or what just happened, he would refer to outstanding bills as the reason why we were where we were. I was constantly answering questions to relatives and friends and even other lawyers about "what exactly is your lawyer doing?" He never had a strategy, he was extremely lazy and wanted me to do all the work, and his obsession with getting paid clouded his judgement. I would not recommend this guy to anyone ever. In a matter of 4 months I paid him $50K and had zero results, other than him asking for another $30K. And when the judgement started getting away from us, rather than regroup, he insisted on signing a release form so that he could get out from under this losing scenario he put us in. Stay away from this guy and his firm.

I went to him looking for a consultation concerning defamation not knowing how it works having no experience with lawyers before. He informed me that they do no accept clients unless referred to by other clients or lawyers. As I was made aware of this I said ok I will get a referral now that I know this. I was simply looking for a brief consultation on services and get a first opinion and nothing more. He refused to even consider it even if I was to get a referral. He was rude and condescending and talked down to me as someone from another country simply looking for small assistance in my project. The fact that he would not even consider looking at it and talked down to me saying I misunderstand him was rude and disrespectful. He clearly said they do not consider clients unless referred to. When I responded if I get a referral he changed his story and said we cannot assist you in connection in any respect. Seriously rude, disrespectful and all in all terrible people skills. Lawyers are here to help, but that kind of attitude is disgraceful.

Retained this attorney for corporate trademark registrations. He charged us his full hourly billings for the work yet we found out a paralegal submitted the applications. When another employee parted ways with the firm, we received a solicitation to hire that other firm which meant this attorney was not securing our information securely. Not happy with how this all turned out.

Went to this attorney for 5 PTO registration filings. Was told it would cost $7,000. They did the work and then billed more than double what they quoted. Had to go for arbitration to reduce their excessive invoice, for which the First Department ruled in favor of the client. We hired a P.I. who provided proof the filings cost only $2,000 and change.

I was in an accident and had several lawyers offering representation. I decided to go with John Appell based on a friend's recommendation. For the past six months, he and his team continuously failed to communicate with me on what they needed from me and what steps they were taking regarding my case. Even a simple request to receive the insurance claim information from the person who hit me was a huge task for his office. At one point his office told me that I can expect to see some (but little) compensation for the accident, so I thought thing were going well. The next time I hear from his office is via a letter in the mail stating after a review of my case that John will not represent me. I found this process long, unprofessional, and unnecessarily difficult. It also didn't help that I only spoke to John once during this timeframe.

What an Appeals Lawyer Can Do for You

An appeals lawyer specializes in representing clients in appellate courts, challenging or defending lower court decisions. If you believe that a legal error was made during your trial or that the court’s decision was unjust, an appeals lawyer can help you appeal the ruling to a higher court. They work to identify mistakes made during the trial, such as improper application of law, exclusion of key evidence, or jury misconduct. On the other hand, if you're defending a favorable judgment, an appeals lawyer can help protect the decision from being overturned.

Appeals lawyers don’t retry the case but instead focus on legal arguments and procedural issues to convince the appellate court to either overturn, modify, or uphold the lower court’s decision.

When Should I Hire an Appeals Lawyer?

Hiring an appeals lawyer is necessary when you are involved in a legal appeal, either as the appellant (the party appealing the case) or the appellee (the party defending the lower court’s ruling). Common situations in which you should hire an appeals lawyer include:

  • Appealing a conviction or ruling: If you’ve been convicted in a criminal case or lost a civil case and believe the decision was based on legal errors or improper procedures, an appeals lawyer can review the case and file an appeal on your behalf.
  • Challenging a sentence: In criminal cases, if you feel that the sentence is excessively harsh or not in line with legal standards, an appeals lawyer can work to reduce or modify the sentence.
  • Defending a lower court ruling: If the opposing party has filed an appeal to overturn a favorable ruling, an appeals lawyer can help defend the judgment and argue that the lower court’s decision should be upheld.
  • Complex legal issues: If your case involves complicated legal issues or interpretations of the law, an appeals lawyer can provide the necessary expertise to argue those points effectively before an appellate court.
  • Reviewing trial errors: Appeals lawyers can examine whether mistakes such as jury misconduct, improper exclusion or admission of evidence, or incorrect jury instructions occurred during the trial.

You should hire an appeals lawyer as soon as you decide to appeal or are informed that the other party is appealing the case, as appellate procedures are time-sensitive.

What Does an Appeals Lawyer Do?

An appeals lawyer provides specialized legal services to challenge or defend a lower court decision. Their role focuses on legal arguments, reviewing the trial record, and persuading the appellate court to either reverse or uphold the ruling. They can:

  • Review the trial record: Appeals lawyers meticulously review transcripts, evidence, and rulings from the original trial to identify any legal errors or procedural mistakes that could be grounds for appeal.
  • Prepare and file briefs: Appeals lawyers write legal briefs that present persuasive arguments to the appellate court. These briefs focus on the legal errors made during the trial and how they affected the outcome.
  • Present oral arguments: In many appeals, lawyers present oral arguments before a panel of judges, explaining why the lower court’s decision should be reversed or upheld based on legal principles.
  • Monitor case law developments: Appeals lawyers stay updated on changes in the law and precedents set by higher courts, which can be crucial in shaping the arguments they present during the appeal.
  • Provide legal advice on the likelihood of success: Appeals lawyers can offer a realistic assessment of your chances of winning the appeal based on the legal errors and evidence from the trial.

How Are Appeals Lawyers Paid?

Appeals lawyers typically charge for their services based on the complexity of the appeal and the amount of work required to prepare briefs and present arguments. Common payment structures include:

  • Hourly rate: Many appeals lawyers charge by the hour due to the significant amount of research, writing, and preparation involved in appeals. Hourly rates can range from $200 to $600 or more, depending on the lawyer’s experience and the case’s complexity.
  • Flat fee: For some straightforward appeals, a lawyer may charge a flat fee that covers all the work necessary to complete the appeal.
  • Retainer fee: In complex or high-stakes appeals, a lawyer may require a retainer, an upfront payment that covers the initial stages of the appeal. The lawyer then bills against this retainer for ongoing work.

It's important to discuss fees and costs upfront with your lawyer during the initial consultation to ensure you understand the financial commitment involved.

How Much Does an Appeals Lawyer Cost?

The cost of hiring an appeals lawyer varies depending on factors such as the complexity of the case, the lawyer’s experience, and the amount of work involved. General cost estimates include:

  • Straightforward appeals: For simpler appeals, such as those involving minor legal errors, fees can range from $5,000 to $15,000, depending on the scope of work.
  • Complex appeals: Appeals that involve complicated legal issues, multiple grounds for appeal, or high-stakes outcomes can cost anywhere from $20,000 to $100,000 or more, especially if the case requires extensive legal research, brief writing, and oral arguments.
  • Hourly rates: Many appeals lawyers charge hourly rates ranging from $200 to $600 per hour, with higher rates often associated with more experienced attorneys or particularly challenging cases.

Before proceeding with your appeal, it’s crucial to ask for a clear estimate of the costs involved so you can budget appropriately.

Top Questions to Ask an Appeals Lawyer

Before hiring an appeals lawyer, it’s essential to ask questions to ensure they are well-suited for your case and that you understand the appeals process. Important questions include:

  1. What experience do you have with appeals?
Ensure the lawyer has substantial experience handling appellate cases, particularly in the area of law relevant to your case (e.g., criminal, civil, family, etc.).
  2. How do you charge for appeals?
Ask whether the lawyer charges an hourly rate, a flat fee, or a retainer, and request an estimate of the total costs for handling your appeal.
  3. What is the likelihood of success for my appeal?
A good appeals lawyer should provide an honest assessment of your case’s strengths and weaknesses and the chances of winning the appeal.
  4. How long will the appeal process take?
Ask for an estimate of how long the appeal process might take, from filing the initial briefs to a final decision by the appellate court.
  5. Will you personally handle my appeal?
In larger law firms, junior attorneys or legal assistants may handle some of the research or drafting. Clarify who will be responsible for preparing and arguing your case.
  6. What is your approach to handling appeals?
Some lawyers may be more inclined to focus on procedural issues, while others emphasize broader legal arguments. Make sure the lawyer’s approach aligns with your goals.

How to Check the Credibility of an Appeals Lawyer

To ensure that you’re hiring a reputable appeals lawyer, take the following steps to verify their credentials and experience:

  • Verify their bar status: Check with your state bar association to confirm that the lawyer is licensed and in good standing, with no history of disciplinary actions.
  • Look for appellate experience: Review the lawyer’s website or profile to ensure they specialize in appellate law and have successfully handled appeals similar to yours.
  • Check client reviews and testimonials: Look for client feedback on platforms like Avvo, Martindale-Hubbell, or Google to get insight into the lawyer’s track record and client satisfaction.
  • Ask for references: A credible lawyer should be willing to provide references from past clients who can speak to their expertise and success in handling appeals.
  • Look for recognition in appellate law: Membership in organizations like the American Academy of Appellate Lawyers (AAAL) or awards and recognition in appellate law can indicate a lawyer’s expertise in this specialized area.

What Should I Prepare for My First Consultation?

To make the most out of your first consultation with an appeals lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Trial transcripts and court records: The lawyer will need a complete record of the original trial, including transcripts, motions, exhibits, and the final judgment or order.
  • Legal briefs from the trial: If any briefs or motions were filed during the trial, bring copies so the appeals lawyer can review the legal arguments that were presented.
  • Written decision or verdict: Bring the court’s written ruling, verdict, or decision so the lawyer can identify any potential errors or issues to raise on appeal.
  • Questions about the appeal process: Write down any questions you have about the appeal’s timeline, costs, and potential outcomes.
  • List of potential legal errors: If you believe specific mistakes were made during the trial (e.g., improper evidence, legal misinterpretations), provide a list of those issues.

Being well-prepared for your consultation allows the lawyer to assess your case more effectively and provide the best guidance on how to proceed with your appeal.
