We needed advice and representation quickly. Mr. Stanley was prompt in his reply to our request and knowledgeable about the process and the steps to move forward. He made us feel that we finally had someone working on our behalf. It was very easy to talk with this attorney, he was genuine in his desire to help the situation. So glad we hired him!

When I needed help on a matter that was unjust, I could only think of one person to call. Over the years working in the criminals justice system, I have seen Mr. Stanley work tirelessly for his clients and he truly goes above and beyond. When I found myself needing an attorney on a civil matter, I called Mr. Stanley and as expected, he did not disappoint. By the end of this civil matter, Mr. Stanley got the case dismissed, attorney fees paid by the petitioner and I didn't even to have to go to court. 10 out of 10 recommend this man.

I met Dale when he and his colleague Joe Della-Rodolfa had represented me in some federal & state matters. He is one of the best - point blank... I have been to many offices and been in several claims/cases - his team was by far the BEST out of every other encounter.. He is honest, he will listen to you, he will fight for you, and he will have no reservations whatsoever in speaking his mind to stand up for what's right. He is a very honorable person and he has no issues with being firm and aggressive in his stance while fighting for you! A++ and a 20 out of 10 in my view.. I`ll follow him and Joe for life - they will be the main two I call for any future matters if within their practice areas for sure!

Kent and I first met when our daughters were playing AYSO soccer. He was/is approachable, engaging, intelligent, and someone you trust almost immediately. For me the measure of a man is how he interacts with his family and Kent sets the bar for all of us. Later when I had a sensitive legal issue, Kent was the first person I called. He was extraordinarily professional yet understanding on a personal level. He seemed to never forget we were husbands and fathers first and foremost. Later Kent advised my wife on some IP matters and again, he was thorough and profoundly human. In this day when professional services providers are so transactional, Kent remains the one setting the bar for competence and compassion. My family and I trust him in all matters from the legally complex to the personally sensitive.

He has a great demeanor with clients and knows how to make people feel comfortable while asking the tough questions and getting to the bottom of whatever issue the client is dealing with.

David was excellent from the start. He informed me of the best and worst case scenarios and gave me his expert advice on how he thought we should approach my case with the best results. I ended up getting the best results in my case and I owe it all to David Hopkin's expert advise and knowledge. He listened to my concerns and I am more than pleased with his representation of me and my case and would more than strongly recommend him to anyone needing a lawyer.

Trouble came knocking on a Saturday afternoon. I was scared and needed advice. But it was Saturday. I used Avvo to locate a lawyer in my area. I selected David based on his breadth of practice and sent a contact request. I figured it would be Tuesday before I received a response, since Monday was the MLK holiday. My mind was racing and I was preparing to take action on my own. David returned my contact request on a Sunday in the middle of a holiday weekend. We consulted and he put my mind at rest. I now had an expert opinion as to the severity of the issue and what action I needed to take. I am now planning to discuss our entire family's legal needs with David.

Sarah-Katherine Wright is my 1st recommendation when clients ask for a real estate closing attorney! My clients hire SK, however I cannot put a value on her expertise when it comes to the advice she provides...if it’s consulting my clients on how to take title & policies or reviewing the language within a offer to make sure the client is protected. I know SK will have our client’s best interest at top of mind. Whether the client is a first-time buyer with lots of questions or a seasoned buyer &/or seller, SK is the attorney I trust to consult with my clients & close the transaction. Over the years I’ve had the opportunity to work with SK numerous times & she has never let me down. To get to the closing table it takes a team effort between the Realtor, Lender, & Attorney all representing the client. I'm more than proud to work with Sarah-Katherine Wright!

About 15 years ago my attorney for many years dropped his private practice to work for a Federal Judge. I wandered in the wilderness for most of time since and about two weeks ago I had something come up where I really needed good, competent legal assistance. I scanned Google for a familiar name and saw Bernstein, Stair & McAdams whom I recognized and gave them a call. I was put through to Mike Moyers. I am not an attorney but I have a better than average understanding of business law and have a lot of practical business experience and knew within a few minutes I had found the right guy. It was clear that Mike understood the problem and knew what he was doing. He handled my situation deftly and was always out in front of what was going on. Problem solved. I found my new guy. Thank you Mike. Well done sir.

I have known Mike Moyers since he was a Chancellor on the bench for 20 years. I appeared in his Court for many years. He was compassionate about his work as a Judge. Recently, he decided to retire as Chancellor and move to practicing law again. He wants to help people and use his expertise to help those people struggling and need help. He is an asset to our legal community. He is genuinely a kind person and very intelligent. In my life there are few people that I consider to be "real" and he is one of the few. He calls it how he sees it with honesty and integrity. His representation brings his clients the "edge" of being a Judge for years and now a litigator. I personally rely on reviews when I am searching for professionals, travel, etc. I focus on reviews that are sincere and appear to be "real." I assure you that Mike Moyers will provide you with top notch legal representation. It appears that I now have a major competitor in my profession. I welcome him back. He is a good one! Definitely 5 stars.

Around thirty years ago I had the privilege of hiring Don Vowell as our attorney involving a case with the company that I owed with my brother. We immediately liked Mr. Vowell, and we both decided that we wanted him as our go to attorney. Over the next twenty years of business, we had more than our share of opportunities to use Mr Vowell's services. He was always there for us. Always supportive, knowledgeable, and capable of guiding us to make some very tough decisions. Not only did Don Vowell earn our respect and confidence, he would, also, earn the respect of opposing Attorneys. They discovered that Mr Vowell had extensive knowledge of the law, and he was extremely capable in communicating this knowledge both written and verbally. I could write a book about our experiences with Don Vowell, but let me just say this: there is no better feeling when you are experiencing the fear of the unknown than to be able to call on your Champion (knowing that you have the very best). With all that said the most important thing I can say is that I am proud to call Don my friend

Don was our attorney in a complicated and long-running suit, and I have never seen anything quite like it. He was a bulldog, and long after I thought we were lost he kept at it, through two appeals, and actually won the case. I had not really thought the suit was winnable, but I do not know if Don ever gave winning any thought. I believe he was entirely driven by what he thought was right. He believed in the case and, believing in it, he was relentless.

After getting myself into serious enough trouble that it could have derailed my life, I couldn't be happier or more relieved after Mr. Grady Smith handled my case. After speaking with Mr. Morrell about my case, he recommended Mr. Smith as he was the most familiar with my local law enforcement and it certainly worked in my favor. Mr. Smith was very polite, knowledgeable, and explained everything in a way I could easily understand. I can't stress enough that the outcome was much better than I, or my family and friends, could have ever expected. I'll be recommending this law firm to anyone who asks for as long as I'm around.

Bill was our first call when we discovered a potential problem with our JV partner in a complex transaction. Over the next nine months, he was able to help us evaluate a complete range of strategies, but with a practical focus, consistently keeping our best interests in mind rather than running down rabbit trails or low-probability tactics. In other words, Bill did the minimum effective dose of legal work to prepare us for litigation while pursuing settlement. Bill's advice was excellent, providing true counsel rather than just a series of options. He was able to bring clarity to very complex legal situation, and help move the ball forward through effective communication with the other side. Because of Bill's involvement, we were able to achieve an outstanding result, receiving a full capital recovery while avoiding costly litigation. There is no doubt in our mind that we could not have achieved this result this quickly without Bill's help.

There is nothing more rare than an attorney who is consistently honest and dedicated to the law. Her passion for what is right and consistent with law is unavailing and consistent with the truth. There was never a time that a "fee" became the primary focus and that is unusual as we have had experience with other attorneys who were all about fees and could care less whether they won or lost. What a breath of fresh air. I would recommend Kristin Fecteau to those who desire a fair fight with an attorney who genuinely cares.

In December 2015 my house had an upstairs water line break while I was out of the house for a kitchen remodel. Water ran for 12-18 hours and ruined the newly placed hardwood flooring and most of my content. Insurance stepped in and provided a fair estimate of the work, but I was hasty in selecting a new contractor for the work that turned out to not be qualified (to say the least). This was a grave mistake. The contractor was behind schedule, placed my new kitchen cabinets outside to get rained on, but worst of all he did not know how to install hardwood flooring and did the worst job possible. When I expressed dissatisfaction with the work in place he walked off the job and let my house in ruin. Knowing that I was going to have to fire and sue, I started asking around for legal advice. Briton Collins was recommended to me by my mother who is in tune with the local legal community, so I consulted with Briton and decided he was the best advice available. Briton navigated me through the Notice of Default procedures so that the "process" was correct from the beginning. Then we stepped through the beginning of the arbitration process. Arbitration clause=red flag, don't sign that contract! We ultimately settled just before the hearing. Without Briton's strong presence during the process, I know I would have gotten nothing. I believe somewhat surprised I decided to settle (pleasantly surprised, I believe), Briton was extremely clear with me to make sure I understood what I was doing. I appreciate the repetition when it comes to confirming big decisions. I don't wish what I was put through on anyone, but if something similar happens to you, you will be better off consulting with a professional such as Briton.

I'm hoping he will expand his specialty ,becuse he's the best attorney I have ever hired , related to actually working on my case ; & he seemed to do all this with ease . I'm not sure ,but some of the other attorneys were from Mississippi & is there something to that?! It is Difficult to find a good Divorce lawyer to represent you, esp. when you're married to a Senator's son ; although, it was for 25 yrs . Ms. Dihigo helped me receive a fair settlement with an insurance company after a car accident. If I had handled the case by myself I would have been left with a hospital bill and a small cash out for a totaled car. Ms. Dihigo negotiated on my behalf with the insurance company of the person who hit my vehicle. She made the process quick and effective. I would definitely use her services again and have recommended her to friends and acquaintances.

As a military veteran it was hard for me to find a trusted partner capable of protecting my family’s interests. After interviewing several attorneys, I decided to trust my personal brand and reputation with Heather Parker. Heather’s office has the right blend of expertise and office support, which when mixed together created the best-value for my legal spend. In the matter Heather was retained for, I was incredibly pleased when Heather achieved a decisive victory for my family. My legal victory was due to Heather’s analytical capabilities, combined with her incredibly strong community relationships. Unlikely other attorneys I have hired in the past, Heather & her team fully focused on maximizing the quality of service and my outcome rather than maximizing a bill. In the legal industry price is what you pay, and value is what you get. In Murfreesboro, Heather is a great, top performing, attorney. To Heather and Team, I genuinely appreciate the time and effort you dedicated to my legal matter. What a great victory! Thank you!

I needed a lawyer and Lee Davis was highly recommended. I was charged with aggravated assault. Mr. Davis did his best to keep me calm and informed. With his patience and directions, my case was dismissed and expunged 100%. One of the most disturbing incidents in my live was resolved.

What an Appeals Lawyer Can Do for You

An appeals lawyer specializes in representing clients in appellate courts, challenging or defending lower court decisions. If you believe that a legal error was made during your trial or that the court’s decision was unjust, an appeals lawyer can help you appeal the ruling to a higher court. They work to identify mistakes made during the trial, such as improper application of law, exclusion of key evidence, or jury misconduct. On the other hand, if you're defending a favorable judgment, an appeals lawyer can help protect the decision from being overturned.

Appeals lawyers don’t retry the case but instead focus on legal arguments and procedural issues to convince the appellate court to either overturn, modify, or uphold the lower court’s decision.

When Should I Hire an Appeals Lawyer?

Hiring an appeals lawyer is necessary when you are involved in a legal appeal, either as the appellant (the party appealing the case) or the appellee (the party defending the lower court’s ruling). Common situations in which you should hire an appeals lawyer include:

  • Appealing a conviction or ruling: If you’ve been convicted in a criminal case or lost a civil case and believe the decision was based on legal errors or improper procedures, an appeals lawyer can review the case and file an appeal on your behalf.
  • Challenging a sentence: In criminal cases, if you feel that the sentence is excessively harsh or not in line with legal standards, an appeals lawyer can work to reduce or modify the sentence.
  • Defending a lower court ruling: If the opposing party has filed an appeal to overturn a favorable ruling, an appeals lawyer can help defend the judgment and argue that the lower court’s decision should be upheld.
  • Complex legal issues: If your case involves complicated legal issues or interpretations of the law, an appeals lawyer can provide the necessary expertise to argue those points effectively before an appellate court.
  • Reviewing trial errors: Appeals lawyers can examine whether mistakes such as jury misconduct, improper exclusion or admission of evidence, or incorrect jury instructions occurred during the trial.

You should hire an appeals lawyer as soon as you decide to appeal or are informed that the other party is appealing the case, as appellate procedures are time-sensitive.

What Does an Appeals Lawyer Do?

An appeals lawyer provides specialized legal services to challenge or defend a lower court decision. Their role focuses on legal arguments, reviewing the trial record, and persuading the appellate court to either reverse or uphold the ruling. They can:

  • Review the trial record: Appeals lawyers meticulously review transcripts, evidence, and rulings from the original trial to identify any legal errors or procedural mistakes that could be grounds for appeal.
  • Prepare and file briefs: Appeals lawyers write legal briefs that present persuasive arguments to the appellate court. These briefs focus on the legal errors made during the trial and how they affected the outcome.
  • Present oral arguments: In many appeals, lawyers present oral arguments before a panel of judges, explaining why the lower court’s decision should be reversed or upheld based on legal principles.
  • Monitor case law developments: Appeals lawyers stay updated on changes in the law and precedents set by higher courts, which can be crucial in shaping the arguments they present during the appeal.
  • Provide legal advice on the likelihood of success: Appeals lawyers can offer a realistic assessment of your chances of winning the appeal based on the legal errors and evidence from the trial.

How Are Appeals Lawyers Paid?

Appeals lawyers typically charge for their services based on the complexity of the appeal and the amount of work required to prepare briefs and present arguments. Common payment structures include:

  • Hourly rate: Many appeals lawyers charge by the hour due to the significant amount of research, writing, and preparation involved in appeals. Hourly rates can range from $200 to $600 or more, depending on the lawyer’s experience and the case’s complexity.
  • Flat fee: For some straightforward appeals, a lawyer may charge a flat fee that covers all the work necessary to complete the appeal.
  • Retainer fee: In complex or high-stakes appeals, a lawyer may require a retainer, an upfront payment that covers the initial stages of the appeal. The lawyer then bills against this retainer for ongoing work.

It's important to discuss fees and costs upfront with your lawyer during the initial consultation to ensure you understand the financial commitment involved.

How Much Does an Appeals Lawyer Cost?

The cost of hiring an appeals lawyer varies depending on factors such as the complexity of the case, the lawyer’s experience, and the amount of work involved. General cost estimates include:

  • Straightforward appeals: For simpler appeals, such as those involving minor legal errors, fees can range from $5,000 to $15,000, depending on the scope of work.
  • Complex appeals: Appeals that involve complicated legal issues, multiple grounds for appeal, or high-stakes outcomes can cost anywhere from $20,000 to $100,000 or more, especially if the case requires extensive legal research, brief writing, and oral arguments.
  • Hourly rates: Many appeals lawyers charge hourly rates ranging from $200 to $600 per hour, with higher rates often associated with more experienced attorneys or particularly challenging cases.

Before proceeding with your appeal, it’s crucial to ask for a clear estimate of the costs involved so you can budget appropriately.

Top Questions to Ask an Appeals Lawyer

Before hiring an appeals lawyer, it’s essential to ask questions to ensure they are well-suited for your case and that you understand the appeals process. Important questions include:

  1. What experience do you have with appeals?
Ensure the lawyer has substantial experience handling appellate cases, particularly in the area of law relevant to your case (e.g., criminal, civil, family, etc.).
  2. How do you charge for appeals?
Ask whether the lawyer charges an hourly rate, a flat fee, or a retainer, and request an estimate of the total costs for handling your appeal.
  3. What is the likelihood of success for my appeal?
A good appeals lawyer should provide an honest assessment of your case’s strengths and weaknesses and the chances of winning the appeal.
  4. How long will the appeal process take?
Ask for an estimate of how long the appeal process might take, from filing the initial briefs to a final decision by the appellate court.
  5. Will you personally handle my appeal?
In larger law firms, junior attorneys or legal assistants may handle some of the research or drafting. Clarify who will be responsible for preparing and arguing your case.
  6. What is your approach to handling appeals?
Some lawyers may be more inclined to focus on procedural issues, while others emphasize broader legal arguments. Make sure the lawyer’s approach aligns with your goals.

How to Check the Credibility of an Appeals Lawyer

To ensure that you’re hiring a reputable appeals lawyer, take the following steps to verify their credentials and experience:

  • Verify their bar status: Check with your state bar association to confirm that the lawyer is licensed and in good standing, with no history of disciplinary actions.
  • Look for appellate experience: Review the lawyer’s website or profile to ensure they specialize in appellate law and have successfully handled appeals similar to yours.
  • Check client reviews and testimonials: Look for client feedback on platforms like Avvo, Martindale-Hubbell, or Google to get insight into the lawyer’s track record and client satisfaction.
  • Ask for references: A credible lawyer should be willing to provide references from past clients who can speak to their expertise and success in handling appeals.
  • Look for recognition in appellate law: Membership in organizations like the American Academy of Appellate Lawyers (AAAL) or awards and recognition in appellate law can indicate a lawyer’s expertise in this specialized area.

What Should I Prepare for My First Consultation?

To make the most out of your first consultation with an appeals lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Trial transcripts and court records: The lawyer will need a complete record of the original trial, including transcripts, motions, exhibits, and the final judgment or order.
  • Legal briefs from the trial: If any briefs or motions were filed during the trial, bring copies so the appeals lawyer can review the legal arguments that were presented.
  • Written decision or verdict: Bring the court’s written ruling, verdict, or decision so the lawyer can identify any potential errors or issues to raise on appeal.
  • Questions about the appeal process: Write down any questions you have about the appeal’s timeline, costs, and potential outcomes.
  • List of potential legal errors: If you believe specific mistakes were made during the trial (e.g., improper evidence, legal misinterpretations), provide a list of those issues.

Being well-prepared for your consultation allows the lawyer to assess your case more effectively and provide the best guidance on how to proceed with your appeal.
