In the thick of Covid I decided it was the best thing to get a handle on old debt that I had accrued over time so I called for a consult and not only did he act unprofessional and insulting over 20 minutes but he "threw" an outrageous fee - over 2,500.00 for chapter 7 just to deter me and insult even further. He clearly had no intention of helping me and was also clearly taking advantage of people using the stimulus money to help themselves. He was rude. I hope no one feels the way I did after 20 min.

Attorney Barilla was the best attorney I have ever hired. He took the time to listen to my concerns and communicated with me very well. He made sure to do everything he could to help me, going far above and beyond to help me. He was worth every bit of the money I spent to retain him in my custody case.

Stay far away from Norman Barilla as he will take your money and that is all. This attorney will tell you what you need to hear to gain your business and have his wife or secretary communicate on his behalf. This attorney took over 5k dollars from me and applied it nowhere. When I pressured Norman for answers he dropped me. Stand up guy.

I met with Mr. Bernstein to review my position prior to filing bankruptcy. As with some attorneys, he wanted paid to review my case, which was fine with me. What was so disappointing is the information he shared was very general in spite of forwarding two years of tax returns, a Balance Sheet and my company's P&L Statement. In addition, I had my personal Balance Sheet and Expenses lay out too. After an hour meeting, he charged me $700.00. Stating his rate is $495 / Hr. and it took him a half hour to review my material. In fact, he was not familiar with my information when we met and only explained general rules of bankruptcy while not being versed on the different limitations for 2013. As I listen to him ramble on and on, his conclusion was for me to contact another attorney because he did not do very many personal bankruptcies. I left in shock, to have paid such a large amount of money for such little value.

Do not use Seth P. Maltzman and his office… He does not care about you… He’s shown he just cares about himself… This guy is awful at communicating and handles himself very unprofessionally. All he wants is to do the bare minimum and throw you to the side to get to the next client. After my mother passed away, this man reached out to me about distributing a few hundred dollars from a small last bit of inheritance left from an estate account he managed. After confirming details, he issued a check. A week goes by and the check failed to deposit… it bounced… what does he have to say?… that the estate is no longer under his control, and that he would provide details of who to contact. So what does he do? He sends me an address of the remaining family member (which we already knew) but provides no contact information of whoever is managing the estate account. He actually doesn’t explain at all what’s happening, and then blocks my number after I ask why he acted the way he was. He reaches out to me first about a check, the check fails, and doesn’t finish what he started, and blocks me? How does that make sense? All over a few hundred dollars… Like I said, do not get your legal work done by Seth, he unpleasant to speak with, and really doesn’t care about helping you.

I found that his paralegal knew more about the law than did Mr Newman. Every question concerning my case he would put her on speaker phone with him present and she answered all my questions while he remained silent. When he did speak, he was in error and his paralegal corrected him. I would not use or recommend him going forward. Rates were good, but then again, if he isn't very good, than was it really reasonable?

Incompetent! This person has no business making legal decisions. She is unable to tell the difference between an abuser and a victim and she should know better given her background that she boasts on this site. She cant recognize a Narcissist when one is put in front of her face. For these reasons, she is incompetent. She lacks sound judgment and she abuses her discretion. I highly suggest that multiple Judicial agencies, colleagues, and individuals investigate her competency.

Carrie Elizabeth Worton is the lead counsel for my upcoming criminal case where the County of Bucks has chosen to protect a severe child abuser who works for Judge Alan Rubenstein. The same judge Alan Rubinstein, who the same courts appointed to my custody case and the child abuse in 2013, which is a conflict of interest brought on by the courts themselves. The County of Bucks, including the Commonwealth of Pennsylvania never investigating the multiple calls I've made on behalf of my son who was severely neglected, abused, and with severe emotional issues. The County of Bucks top officials covering for this woman who tried killing my son and got away with it have turned their sites on me fabricating a arrest that never happened, entrapment, false police reports by Yardley Borough Police Department, newly re-elected District Attorney Matt Weintraub and County commissioner Diane Ellis-Marsiglius all protecting a child abuser under their employ. My clean record of 51 years has now been irreversibly tarnished by elected officials not fit to serve and protect our community, our Commonwealth, or our Country. My multiple attempts to protect my son from a child abuser was covered up by the county. Ms Worton's name appears on my criminal case. The Commonwealth is going above and beyond trying to put me away instead of ever investigating the multiple phone calls to child services for my son who still needs an MRI and CAT scan when his own mother failed to provide our son immediate medical attention at 16 months old laying lifeless, near death. 14 years of me reporting to every agency & nobody has called me back to investigate my son's near death experience, but I have an upcoming court date for just trying to speak to my son! I look forward to meeting Ms. Worton in court soon!

When I walked in there was no receptionist and waited. Mr Sposto was in the phone and finally came out but forgot I had an appointment, I waited more. Then finally during my consultation (which he charged $75 and on the phone was told free) he told me I don't have a "smoking gun" to sue the former owner of our home and left. It made no sense because I had so much proof. I went to a different attorney. He said I had a case and we went to court and won! I was so disappointed I wasted my time and $75 with Ernie Sposto.

"Got our fee and forgot about the client attitude"is how I would describe this law firm. This firm dropped the ball completely on getting us payoffs for our mortgages. We instructed the lawyer to get 2 payoffs for 2 properties, they got us one payoff but failed to get the other and gave us a bunch of excuses why it wasn't their fault and this should come from Sertus - the service company handling the bankruptcy. After 30 days of waiting, we still don't have our payoff which is costing us at least $30 a day in interest along with a late fee. In all they have cost us an additional $1000 in expenses while we wait for our payoff. Every time we contacted the law firm, they gave us an excuse the lawyer was in court, I have never seen a lawyer spend so much time in court!! Furthermore, we never received a call from him to discuss why we had received what we requested. After contacting Sertus, we were told by Sertus that they hadn't received a payoff request for our 2nd property, but we were told by the lawyer's assistant that it was ordered. Sertus told us to ask the assistant 2 questions; when was the payoff ordered and what was the date. The lawyer's assistant couldn't answer these 2 questions. I would recommend using someone else, they are unresponsive, fail to communicate with their clients and are unwilling to get things done when they are needed.

i had the misfortune of hiring this person back in 1992/1993. He completed the paperwork & filed it, but didn't show up for my bankruptcy hearing (this was back before everyone had access to a cellphone) I had to sit through the days hearings while they kept pushing my hearing to a later and later time in the day. during breaks, I used a payphone to call his office & leave messages throughout the day. The following day he had not returned any of my calls so I left a message on the voice mails of every one of the other lawyers in his firm stating what had happened. The senior partner finally called me back & I explained my frustration & disappointment. he agreed to refund me a portion of the money I had paid. later that day Mr. Portman called me and said that he didn't show because I should have paid him more money. ( I paid the rate that was agreed upon at our initial meeting).

What a Bankruptcy Lawyer Can Do for You

A bankruptcy lawyer specializes in helping individuals and businesses manage overwhelming debt by filing for bankruptcy or exploring alternatives to bankruptcy. They guide clients through the complex legal process of discharging or restructuring debts, represent them in court, and work to protect assets such as homes and cars. Bankruptcy lawyers can also help stop creditor harassment, wage garnishment, and foreclosures through bankruptcy protections.

If you're facing financial hardship, a bankruptcy lawyer can help you decide whether filing for bankruptcy is the right option and assist you through the legal process.

When Should I Hire a Bankruptcy Lawyer?

You should consider hiring a bankruptcy lawyer in the following situations:

  • Unmanageable debt: If you're unable to pay your bills and debts are piling up, a lawyer can help you explore options such as Chapter 7 or Chapter 13 bankruptcy.
  • Foreclosure or repossession: If your home is at risk of foreclosure or your vehicle is in danger of being repossessed, a bankruptcy lawyer can help you use bankruptcy protections to prevent this and potentially reorganize your debts.
  • Wage garnishment: If your wages are being garnished, filing for bankruptcy can stop garnishments and allow you to regain control of your finances.
  • Creditor harassment: If creditors are constantly calling or sending collection notices, a bankruptcy lawyer can stop these actions by filing for bankruptcy, which enacts an automatic stay that halts collection activities.
  • Small business debt: If your business is struggling with debt and cannot meet financial obligations, a lawyer can help you file for Chapter 11 (reorganization) or Chapter 7 (liquidation) bankruptcy.
  • Medical debt or credit card debt: If you have large amounts of unsecured debt like medical bills or credit card balances, a bankruptcy lawyer can help you seek relief through Chapter 7 or Chapter 13 bankruptcy.

Hiring a bankruptcy lawyer early in the process can prevent further financial damage and help you choose the best legal option for debt relief.

What Does a Bankruptcy Lawyer Do?

A bankruptcy lawyer provides a range of services to help individuals and businesses handle their debts. Their responsibilities often include:

  • Evaluating your financial situation: Assessing your income, assets, debts, and expenses to determine if bankruptcy is the right option and which type of bankruptcy (Chapter 7, Chapter 13, or Chapter 11) best suits your situation.
  • Filing bankruptcy petitions: Preparing and filing the necessary documents to initiate your bankruptcy case, ensuring that all legal requirements are met.
  • Stopping creditor harassment: Once the bankruptcy case is filed, an automatic stay is enacted, which stops creditors from pursuing collection efforts. A lawyer ensures this protection is applied immediately.
  • Representing you in court: Representing you in court proceedings, including meetings with creditors and any hearings related to your case.
  • Negotiating with creditors: In Chapter 13 or Chapter 11 bankruptcies, negotiating a repayment plan that restructures your debts and allows you to manage payments more effectively.
  • Advising on asset protection: Guiding you on how to protect certain assets, such as your home or retirement savings, through available bankruptcy exemptions.
  • Explaining the impact on your credit: Informing you about how bankruptcy will affect your credit and advising on steps to rebuild your credit post-bankruptcy.

How Are Bankruptcy Lawyers Paid?

Bankruptcy lawyers typically charge for their services in different ways depending on the complexity of the case and the type of bankruptcy being filed. Common payment structures include:

  • Flat fee: Many bankruptcy lawyers charge a flat fee for handling Chapter 7 or Chapter 13 bankruptcy cases. This fee usually covers the entire process, from preparing and filing paperwork to representing you in court.
  • Hourly rate: For more complex cases, such as Chapter 11 bankruptcy (often used by businesses), some lawyers charge an hourly rate. Hourly rates typically range from $150 to $500 or more.
  • Retainer: In cases where ongoing legal services are required, such as in Chapter 11 bankruptcies or complex Chapter 13 cases, a lawyer may request a retainer, which is an upfront payment billed against as the lawyer works on the case.

It’s important to discuss fees with your lawyer upfront, as bankruptcy law requires lawyers to disclose all fees and ensure they are reasonable and fair.

How Much Does a Bankruptcy Lawyer Cost?

The cost of hiring a bankruptcy lawyer varies depending on the type of bankruptcy and the complexity of the case. General cost estimates include:

  • Chapter 7 bankruptcy: For individuals, legal fees usually range from $1,000 to $3,500. This flat fee generally covers the entire process.
  • Chapter 13 bankruptcy: For individuals filing Chapter 13, legal fees typically range from $2,500 to $6,000. This cost is higher because of the additional work required to create and manage the repayment plan.
  • Chapter 11 bankruptcy (for businesses): Chapter 11 bankruptcy is more complex and usually more expensive, with legal fees ranging from $10,000 to $50,000 or more, depending on the size of the business and the complexity of the debt restructuring.
  • Filing fees: In addition to legal fees, there are also court filing fees, which are $338 for Chapter 7 and $313 for Chapter 13 as of 2024.

Always ask for a detailed cost estimate during your consultation to understand what services are included and whether payment plans are available.

Top Questions to Ask a Bankruptcy Lawyer

Before hiring a bankruptcy lawyer, it’s important to ask key questions to ensure they have the experience and knowledge to handle your case effectively. Key questions to ask include:

  1. What experience do you have with bankruptcy cases?
Ensure the lawyer has experience handling cases similar to yours, whether it's Chapter 7, Chapter 13, or Chapter 11 bankruptcy.
  2. How do you charge for your services?
Clarify whether the lawyer charges a flat fee or hourly rate, and ask for a detailed breakdown of costs, including filing fees and additional expenses.
  3. Which type of bankruptcy is best for me?
Ask the lawyer to explain whether Chapter 7, Chapter 13, or Chapter 11 is the best option based on your financial situation and long-term goals.
  4. What debts can be discharged?
Ask which of your debts will be forgiven through bankruptcy and which debts (such as certain taxes or student loans) may not be dischargeable.
  5. How long will the process take?
Bankruptcy cases can take time to resolve, so ask the lawyer how long they expect the process to last, from filing to discharge.
  6. Will I be able to keep my assets?
Ask if you will be able to keep important assets, such as your home or car, and what exemptions might apply.
  7. What happens after bankruptcy?
Ask about the impact of bankruptcy on your credit score and what steps you can take to rebuild your credit after the bankruptcy is finalized.

How to Check the Credibility of a Bankruptcy Lawyer

To ensure you are hiring a reputable bankruptcy lawyer, follow these steps to verify their credentials and track record:

  • Verify their bar status: Check with your state bar association to confirm that the lawyer is licensed to practice law and has no history of disciplinary actions.
  • Look for bankruptcy experience: Review the lawyer’s website or professional profile to ensure they specialize in bankruptcy law and have successfully handled cases like yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and ability to handle bankruptcy cases.
  • Ask for references: A reputable lawyer should be able to provide references from past clients who have worked with them on bankruptcy matters.
  • Check for certifications or memberships: Look for lawyers who are members of organizations such as the National Association of Consumer Bankruptcy Attorneys (NACBA) or who have specialized bankruptcy law certifications.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with a bankruptcy lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • List of debts: Prepare a detailed list of all your debts, including credit cards, personal loans, medical bills, and any secured debts such as mortgages or car loans.
  • Income and expense records: Bring documents that show your current income, such as pay stubs or tax returns, and a list of your monthly expenses, including rent, utilities, and other essential costs.
  • Asset information: Provide information on any assets you own, such as your home, car, investments, or other valuable property.
  • Credit reports: If possible, bring copies of your credit reports to give the lawyer a clear view of your financial situation.
  • Questions for the lawyer: Prepare a list of questions you have about the bankruptcy process, the lawyer’s fees, and what to expect after filing for bankruptcy.

By preparing thoroughly for your consultation, you can help the lawyer assess your situation more effectively and provide the best possible legal advice tailored to your needs.
