But MICHELLE took care of everything and made things so simple for me. By the time closing came, everything was in order and went through without a hitch. I hired Attorney Vaughn-Martel after a civil lawsuit was filed against me by an ex-girlfriend over ownership rights to a vehicle I had solely purchased during our 4+ year relationship. An injunction/ court order was filed against me stating that I was not allowed to sell the vehicle until the case was heard before a judge. I hired Vaughn-Martel in hopes that he'd be able to assist in getting the court order lifted as I was unable to afford payments on the vehicle and wanted to be able to sell it. After several months of negotiations between Vaughn-Martel and the plaintiff's attorney a Settlement Agreement was drafted by Vaughn-Martel's office and was forwarded to me for review and signature. I stated the Agreement was to my liking and was told that the Agreement would be sent out AS IS to the Plaintiff and then sent to me for signatures. Problems arose when I found out that after I had approved what I thought to be the FINAL draft of the Settlement Agreement that the Plaintiff's attorney asked that a few changes be made and Attorney Vaughn-Martel's office made these changes without my knowledge, consent or even a discussion of such. When I contacted Attorney Vaughn-Martel to indicate my disproval of such changes I was told that there was nothing they could do to change the Agreement back as the REVISED Agreement had already been mailed out to the Plaintiff for signature. I was beyond irate at this point. To make matters worse is the Plaintiff was never able to obtain financing in order to follow through on the terms of the Settlement Agreement by purchasing the vehicle to pay off my loan (which I couldn't afford to pay and faced repossession of) and to compensate me for monies she had stolen via check fraud / forgery. After the Plaintiff had breached the Agreement by not coming up with the funds within the allotted time frame as per Agreement terms, I was advised by Attorney Vaughn-Martel that selling the vehicle, paying off the loan and keeping the balance of the agreed upon sales amount for myself would be a "viable solution to complying with the agreement, getting rid of the car, and getting settlement funds, all in a way that protects my interests in the event I had to go in front of a judge." I followed my attorneys exact advice and I sold the vehicle 2 days prior to the date it was to be repossessed but only got what I owed. When I got in front of the judge though I was found in contempt of court for going against the imposed court order. Attorney Vaughn-Martel never once stated that he had advised me to do such nor did he defend me in any sense of the word. He never tried to state facts and in no way stood up for me. He seemed to have no idea what to say in court and came across as being completely unprepared, incompetent, unprofessional and unknowledgeable of how to defend a client. He let me hang out to dry and when I confronted him prior to the next hearing for my punishment in front of the judge he totally denied ever having advised me to go against the court order. I even showed him his own email to me stating his advice and he still insisted he never advised such. He then stated it would be in my best interest to allow the civil case against me along with my counterclaims against her for stolen monies be dismissed as per the Plaintiff's request or the judge could punish me by making me pay her money for selling the car. I felt as though I was being coerced into settling the case because my attorney didn't want to have to explain himself to the judge as to why he advised his client to go against a court order. Due to being in fear of what the judge might fine/punish me with and knowing I had no more money and no real counsel on my side to defend me I went against my rights and agreed to allow the case to be dismissed. I ended up with nothing more than destroyed credit & added debt due to racking up $7k in legal fees.....way more than Vaughn-Martel Law ever truly earned or deserved

I had Robert Graves as a attorney just over a decade ago and had disappointing results at best. I was able to get one charge dismissed out of two which is very common with first time offenders for a plea bargain and the DA might not been able to prove the that charge, however the other charge (misdemeanor) was continued without a finding for 4 years which I reluctantly accepted based mostly off of his recommendation and i guess he couldn't get me a decent plea deal. A 4 year cwof for a first time offender is unheard of in district court. There are more serious cases where defendants receives a year continued without a finding. In 10 years since I can’t find an instance of someone in district court receiving more than 2 years of probation whether pleading out or being found guilty. My parents hired another attorney to help based on his recommendation ( I guess he couldn't handle a district court case by himself) and the whole court case took over a year to settle due to delays so the whole experience In the criminal justice system took over 5 years in district court for a alleged nonviolent crime. I was better off with a public defender, I doubt anyone could do worse. I also wasn’t told that with cwofs defendants don’t necessarily have to admit to the police report , it is possible to just admit that there are sufficient facts without saying you actual did the crime. But most lawyers won’t tell their clients that so It’s hard to blame him for that and some judges won’t accept that. But it would have been nice if I was told. I admitted to a crime which will always be on my record and got 4 years of probation for something I should have gotten 1-2 years for. Aweful plea deal ( I remember judge Hinkle even gave a weird look when she heard the probation length of the plea agreement like she was surprised ) and disappointing representation.

I was referred to Attorney Riccio as one of the only dental malpractice attorneys in the area. For well over a week now I've left voicemails and sent emails and only received the most illegible emails in response, for example, the first email i sent I received a blank email in response, so i questioned this and got "please email me directly" as a response... the email I have been attempting to utilize for communication is the one listed on Mr. Riccio's website... so I started over with another email, explained thathat he had told me to email him directly and that email i was sending to was the one on his website, and he responds "that is fine"... so I explained my situation again and have yet yo hear back neither through email nor a return call after having left a voicemail over 2 weeks ago

I hired attorney Anthony G. Collins for DUI case , and I was extremely satisfied , not only did he return my phone calls in a timely manner , he was someone who truly cared about my case , he didn't just provide lip service . Unfortunately , I have had run ins with the law in the past , and have had other attorneys , there were none as caring and professional as Attorney Collins . The other Attorneys that I have dealt with have tried to convince me to plead to a lesser charge and avoid a trial , all the while still collecting their fee . Attorney Collins assured me that my case was winnable and listened to my input as to what was done in the case . Subsequently , we went to trial , and just as Attorney Collins predicted , we were awarded a not guilty verdict . Attorney Collins fought for me tooth and nail , and came away with the victory . Not only did I walk away a free man ( I was facing jail time as a repeat offender ) His fee was more than fair , and he actually gave me time to pay it as I was just getting back on my feet financially . I would recommend Attorney Collins to anyone looking for a fair , honest lawyer that will work hard for you , and not put you in the poor house .

I used him for a license suspension case due to my extensive driving record. I gave him $1000 and he didn't do anything. He said "we should postpone this so we get a different DA" about 3 times. One time he didn;t even show because he though it was on another date even though I called him the night b4. Also the last time he came to court he wanted to change it to another date for the 3rd time.... so I told him in front of the court room that I will no longer be using his services. (He was pissed off!!!) I warned him about this and pretended he never heard it. He never gave me back any money (like he said he would), never returned one of my 27 phone calls, and he never provided any type of legal advice those 3 times in court or 1 time out of court meeting. This lawyer took me on as a client and as I signed papers and became a client, I was fired almost immediately over being rear ended, as attorney Gately said the “state police report” stated I had passed a man (who hit me square in the middle of my rear bumper on the highway) and that my case “was complicated.” That was his excuse. That may have been a good excuse, MAYBE...except it’s entirely untrue. No police report exists, as I went to the state police and they were confused because no report with my name on that date or EVER is not in the computer? Why? Because the police never responded......he made up a bold faced lie thinking I was stupid. I was rear ended by a guy with a weapon, the police refused to respond l, this attorney took me on as a client and couldn’t a find simple insurance policy for the man that hit me. It took me two minutes with the same info I had that attorney Gately did and he, in at least a couple of weeks was unable to find that.....which made me question his ability as an attorney. If the fact that I was rear ended, dead center in the middle of my rear bumper......but he couldn’t handle my case? What gets me is how he told us “how hard it was for him to fire a client, which is extremely difficult.” Yet, he dropped me like a hot potato! I’d look elsewhere, but you come to your own decision.....I know what mine is.

At one point David told me I should get another attorney I replied by saying after three years you decide to say this. As of December 2013 I still have not yet received any money. they are still sending me on a goose chase after all these years they want me to settle for 12,500 they did not fight hard for me at all. every time I would call they would send me to voice mail or talk to their receptionist she to would lie for them. it also took me three years to go see a doctor for the other party. shame on them I do not care how many years they practice law not professional at all lack of communication I would stay away from this law firm. we are about to hit 2014 I still have not yet received any information please stay away from attorney that come to your house. these attorney makes it bad for the good guys.

What a Car Accident Lawyer Can Do for You

A car accident lawyer specializes in representing individuals who have been injured in motor vehicle accidents. These lawyers help victims secure compensation for medical expenses, lost wages, property damage, pain and suffering, and other losses resulting from a car crash. They also negotiate with insurance companies, investigate the cause of the accident, and, if necessary, represent clients in court to ensure they receive fair compensation.

If you've been injured in a car accident - whether as a driver, passenger, cyclist, or pedestrian - a car accident lawyer can help protect your rights, navigate the insurance claims process, and ensure you receive the compensation you're entitled to.

When Should I Hire a Car Accident Lawyer?

Consider hiring a car accident lawyer in several situations, especially when the accident results in injuries, property damage, or disputes with the insurance company. Key situations include:

  • Serious injuries: If you’ve suffered significant injuries, such as broken bones, spinal injuries, or traumatic brain injuries, a lawyer can help you seek compensation for medical expenses, future treatment, and pain and suffering.
  • Disputes with the insurance company: If your insurance claim has been denied or the insurance company offers an unreasonably low settlement, a lawyer can negotiate on your behalf to ensure you get fair compensation.
  • Liability disputes: If the other driver’s insurance company is disputing fault or claiming you were partially at fault, a lawyer can gather evidence to prove the other party’s negligence.
  • Wrongful death: If a loved one was killed in a car accident, a lawyer can help the family pursue a wrongful death claim to recover compensation for funeral expenses, loss of companionship, and other damages.
  • Uninsured or underinsured driver: If the at-fault driver lacks sufficient insurance coverage, a lawyer can help you explore other compensation options, such as filing a claim with your own insurance company.
  • Complex cases: Accidents involving multiple vehicles, commercial trucks, or complicated circumstances require legal expertise to manage complexities and hold all responsible parties accountable.

Hiring a lawyer early in the process can help ensure that your rights are protected and that you receive the full compensation you deserve.

What Does a Car Accident Lawyer Do?

A car accident lawyer provides various legal services to help injured individuals pursue compensation for their injuries and losses. Their responsibilities often include:

  • Investigating the accident: Gathering evidence like police reports, witness statements, photos, and video footage to determine how the accident occurred and who was at fault.
  • Filing insurance claims: Assisting clients in filing claims with their insurance company and the at-fault driver’s insurer to ensure all necessary documentation is submitted correctly.
  • Negotiating settlements: Working with insurance adjusters to secure fair compensation for medical bills, property damage, lost wages, and pain and suffering.
  • Calculating damages: Determining the full extent of your damages, including current and future medical expenses, rehabilitation costs, lost income, and non-economic damages like pain and suffering.
  • Handling medical bills: Coordinating with healthcare providers to ensure your medical bills are paid and helping you avoid financial hardship during the claims process.
  • Filing lawsuits: If the insurance company refuses a fair settlement, the lawyer can file a lawsuit and represent you in court.
  • Representing you in court: Presenting your case before a judge and jury, providing evidence and witness testimony to prove negligence and your right to compensation.

How Are Car Accident Lawyers Paid?

Most car accident lawyers work on a contingency fee basis, meaning they only get paid if they win or settle your case. The key aspects include:

  • Contingency fee: The lawyer’s fee is typically between 25% and 40% of the total settlement or award. You won't pay upfront fees; the lawyer's payment comes from the compensation they recover for you.
  • No fee if no recovery: If the lawyer doesn’t secure compensation for you, you generally don't owe any legal fees.
  • Case expenses: You may be responsible for certain costs related to your case, such as filing fees or expert witness fees. These are usually deducted from the settlement after the lawyer's fee is paid.

Discuss the fee structure during your initial consultation to understand how much you'll owe if your case is successful.

How Much Does a Car Accident Lawyer Cost?

The cost of hiring a car accident lawyer is generally based on the contingency fee arrangement. General estimates include:

  • Contingency fee percentage: Lawyers typically charge between 25% and 40% of the total settlement or award. For example, if you receive a $100,000 settlement and the lawyer's fee is 33%, the lawyer would receive $33,000, and you'd keep the remaining $67,000.
  • Case expenses: Additional costs such as court filing fees, expert witness costs, and administrative fees can range from $1,000 to $10,000 or more, depending on the case complexity.

Ensure you get a clear explanation of fees and expenses during your consultation.

Top Questions to Ask a Car Accident Lawyer

Before hiring a car accident lawyer, consider asking the following questions:

  1. What experience do you have with car accident cases?
Confirm the lawyer has handled cases similar to yours, especially involving serious injuries or complex liability issues.
  2. How do you charge for your services?
Understand the contingency fee percentage and any additional costs you may incur.
  3. What is the likelihood of success in my case?
Seek an honest assessment of your case's strengths and potential challenges.

How to Check the Credibility of a Car Accident Lawyer

To ensure you're hiring a reputable lawyer, take the following steps:

  • Check their bar status: Verify with your state bar association that the lawyer is licensed and in good standing.
  • Review their experience: Look for specialization in personal injury and car accident cases.
  • Read client reviews: Consult platforms like Avvo or Martindale-Hubbell for testimonials and ratings.
  • Ask for references: Request contact information of previous clients willing to discuss their experience.
  • Check professional affiliations: Membership in organizations like the American Association for Justice (AAJ) indicates a commitment to the field.

What Should I Prepare for My First Consultation?

To maximize the effectiveness of your initial meeting, bring the following:

  • Police report: A copy of the accident report filed by the police.
  • Medical records: Documentation of your injuries, treatments, and medical expenses.
  • Photos and videos: Any visual evidence from the accident scene and of your injuries.
  • Insurance information: Copies of your insurance policy and any correspondence with insurance companies.
  • Witness information: Contact details and statements from any witnesses.
  • List of questions: Prepared questions about your case and the legal process.

Being well-prepared helps the lawyer assess your case accurately and advise you on the best course of action.
