I was involved in a pretty severe motor vehicle accident in January of 2024 where my vehicle had rolled multiple times. I was fortunate enough to leave the scene with little injury for how significant the accident was in which I am grateful for. After the accident I received medical attention and knew that it was going to be a battle dealing with everything from the medical bills, the loss of my vehicle and everything else that comes with a difficult experience like this. From the moment I was in contact with Matt Hardin Law I was being taken care of, every one who is apart of their team did the upmost to make sure I was well informed on what was going on and ensuring that I generally taken care of throughout the entire process. Mr. Mayfield and Ms.Alexeev answered every question or concern I had with no hesitation and i personally cannot thank them enough for what they were able to do for me and help me out with along with every member of their team.

There are so many choices for attorneys, but I can't stress enough how happy I am for choosing this firm. Matt and April handled my case with care and provided great communication throughout. It was so reassuring to have Matt Hardin Law (William Mayfield and April White) have my back on all my legal / medical matters after my wreck. I am so thankful for their support. They guided me through things, and just took things off my plate while I was healing and dealing with other things. I highly highly recommend working with them in your time of need. They are personal, caring, professional and honest. 100/10!

My family's experience with Brian Cummings was wonderful. My mother had a terrible experience with a doctor, involving a missed diagnosis that lead to a devastating terminal prognosis. Brian worked with us in our pursuit for justice. He was knowledgeable, thorough and kind. He spent as much time as we needed explaining the legal process and keeping us updated as it evolved. He was committed to helping my mom get the best possible settlement and it was very helpful to know he was taking care of the legal details so we could focus on taking care of my mom.

Rachel Upshaw of Miller Upshaw Family Law, PLLC is an outstanding attorney, whom I would strongly recommend without hesitation, to anyone who is searching for an incredibly knowledgeable, compassionate, trustworthy, and hardworking professional to legally represent them. Rachel gracefully supported me during my divorce process, which began as uncontested, but shifted into a contested divorce, along the way. Rachel was always responsive to my emails throughout my case, and I experienced her as patient and kind during each communication we had during my case. Additionally, I experienced Rachel’s legal guidance throughout my divorce as wise, responsive, and precise, while always keeping my best interest as her client front and center. Rachel had a balanced approach of being warm, while also being realistic and “telling it like it is,” regarding each detail of my case, which I deeply valued and appreciated, and helped me to wholeheartedly trust her as my counsel. Rachel also proactively communicated to me regarding any anticipated absences that she had, during my case, and she always let me know whom else from her office would be responding to my questions and/or handling time-sensitive tasks on her behalf, while she was out of the office. In the midst of my divorce, I also experienced Rachel as caring, thoughtful, and non-judgmental, which was important to me, given some of the more sensitive elements of my case. Furthermore, during our court appearances, for which Rachel was always prepared, it was very clear that Rachel is highly regarded and highly respected amongst her peers, as I observed her professional exchanges when we were at court. One of the aspects of Rachel’s approach as my attorney, that I appreciated the most, was her consistently showing up as a grounded anchor throughout my case, who, even in the face of some situations that I believe would’ve made the most calm person lose their composure–Rachel never wavered, and she was always a validating and grounded anchor during those situations. To note, while I most consistently experienced Rachel as cool, calm, and collected, Rachel was also very “tough” (meaning, to me, more overtly assertive) when the situation called for it, doing so without hesitation, and again, always with my best interest in mind. I grew to learn that this balanced approach from her fit my personality and my needs the best, in comparison to the approach of some other attorneys. During the mediation portion of my case, Rachel was very dedicated to ensuring that my hopes and wishes were consistently reflected and advocated for, throughout the process. Additionally, I am grateful for Rachel’s support, surrounding my ex-spouse and I ultimately reaching an agreement that was satisfactory to me, and the most desirable outcome possible, considering some of the more difficult (beyond her/our control) pieces of my case. Lastly, I want to give a positive “shout-out” to other members of the Miller Upshaw Family Law team who were involved with my case. Attorney Taylor Rippe assisted me with some portions of my case, particularly during times that Rachel was out of the office. My communications with Taylor were always pleasant and I experienced her as knowledgeable and committed to completing tasks related to my case, in a thoughtful and responsive manner. Additionally, Joellyn Kott, their Paralegal, is a true gem of a person, who always exuded warmth and compassion during each of our interactions, whether it was during a phone call or when I needed to stop by their office to handle something related to my case. Furthermore, Ethan Pylant, their Legal Assistant, was always very respectful and timely in his communications with me, regarding my case. Overall, I would (and actually already have!) highly recommend Rachel Upshaw to anyone who is seeking legal representation here in Middle Tennessee. Rachel will be there for you, from beginning to end, providing just, wise, warm, and professional counsel, every step of the way.

I have so much gratitude for Don. Not only was he kind, supportive, and knowledgeable; he made a heavy situation much less stressful. I would be facing grand jury and some serious time without his aid. My public defender had told me I had little to no chance walking from this. I am a severely disabled veteran. I had a surgical implant that was supposed to block pain, but after seven months it made my pain much worse. I live in Knoxville, TN. I contacted his father, Sidney, and he told me to call Chris in Memphis. Chris called me personally later in the day, even after his office was closed. He listened to my story, never cut me off, and after that, we decided together after he explained the letter of the law for medical malpractice that my case would not be able to win. He did not hang up, he listened to me about what happened to me in combat, and was like a close friend. He got me to hang on, as I have some upcoming appointments and procedures. He is a kind, down to earth, caring man. We spoke like we were old friends, and he thanked me for my service to our country (22 years as a Green Beret). He also told me that if I ever needed to just talk or vent, call him. He is an awesome individual who is not just out for money, he really cares about you. I am going to have a pain pump put in in about a month, and I am going to start travelling. I told him I would like to go through Memphis on my way to Louisiana, and I would really like to have lunch with him. He told me he would love to have lunch with me and hear some of my stories. I wish there were more people in the world like him. I would highly recommend him in Memphis, and his father Sidney in Knoxville. He really gave me the hope to hang on. Thank you Chris from the bottom of my heart. I will be in Memphis one day and I will call you ahead of time to fit lunch in to your schedule. God Bless you and your family. Thank you for treating me the way that you did. You are a rare breed nowadays, keep up the good work.

Christopher Gilreath is not dedicated to his clients. Chris informed me 3 years into my automobile accident that he could no longer represent me because "the opposing side is forcing me to withdraw as your attorney ". I really thought I heard him wrong, but he acknowledged that I heard him correctly. Be very aware of his promise to commit to you and represent you with vigor. He gave a very vague explanation that we disagreed on issues. I only heard and spoke with him twice and there wasn't any type of disagreement. I gave him full reign over negotiating my case. He was the attorney (I trusted him to be what he promised). BTW the defendants insurance company had already claimed 80% liability and had already repaired my truck.

This lawyer failed to protect me from the hands of my abusive husband. She failed in many areas and didn’t protect me from getting wrongfully charged with assault when I was the one assaulted. I was then harassed by the man for the next year without much I could do about it because he claimed I broke an oop by letting his kids contact him. I hired Mr. Woods to represent me against the State of Tennessee in a case involving wrongful termination she to military discrimination. Mr. Woods had no idea what he was doing. He filed the case in the wrong court (federal court) when it should have been filed in state court. Because he did this he caused me to miss my statute of limitations for filing on state court. I asked Mr. Woods for my full retainer back and he refused even though he wasted my money filing in the wrong venue. He was not even apologetic or remorseful. The least he could have done is return my retainer in full seeing as he wasted my money filing In the wrong court. I wouldn't not recommend him at all. My girlfriend was rear ended two years ago and suffered injuries and we hired Bart Durham to handle our case. It’s occurred to us that they have a “formula” for the maximum amount of money they are predicted to receive prior to settlement hearing. Our lawyer accidentally said “we can get you 20k” when the offer from the insurance company was 70k, so computed with my layman’s math (50k for the medical bills, and 20k to chop up) which reads to me as about 13k roughly. Where did the “20k” blurt out come from? How would he possibly have a predictive number like 7k more due to medical bills being negotiated? I’m convinced they have already been in contact with our medical billers and have a rough idea of how much they can chisel them out of. Essentially Bart Durham is the ones who have the leverage to determine how much we receive of the award, not the opposing insurance company. We opted for a trial but I highly doubt they will let it go that far. Maybe we tell them to goto hell and not get a dime.

What a Car Accident Lawyer Can Do for You

A car accident lawyer specializes in representing individuals who have been injured in motor vehicle accidents. These lawyers help victims secure compensation for medical expenses, lost wages, property damage, pain and suffering, and other losses resulting from a car crash. They also negotiate with insurance companies, investigate the cause of the accident, and, if necessary, represent clients in court to ensure they receive fair compensation.

If you've been injured in a car accident - whether as a driver, passenger, cyclist, or pedestrian - a car accident lawyer can help protect your rights, navigate the insurance claims process, and ensure you receive the compensation you're entitled to.

When Should I Hire a Car Accident Lawyer?

Consider hiring a car accident lawyer in several situations, especially when the accident results in injuries, property damage, or disputes with the insurance company. Key situations include:

  • Serious injuries: If you’ve suffered significant injuries, such as broken bones, spinal injuries, or traumatic brain injuries, a lawyer can help you seek compensation for medical expenses, future treatment, and pain and suffering.
  • Disputes with the insurance company: If your insurance claim has been denied or the insurance company offers an unreasonably low settlement, a lawyer can negotiate on your behalf to ensure you get fair compensation.
  • Liability disputes: If the other driver’s insurance company is disputing fault or claiming you were partially at fault, a lawyer can gather evidence to prove the other party’s negligence.
  • Wrongful death: If a loved one was killed in a car accident, a lawyer can help the family pursue a wrongful death claim to recover compensation for funeral expenses, loss of companionship, and other damages.
  • Uninsured or underinsured driver: If the at-fault driver lacks sufficient insurance coverage, a lawyer can help you explore other compensation options, such as filing a claim with your own insurance company.
  • Complex cases: Accidents involving multiple vehicles, commercial trucks, or complicated circumstances require legal expertise to manage complexities and hold all responsible parties accountable.

Hiring a lawyer early in the process can help ensure that your rights are protected and that you receive the full compensation you deserve.

What Does a Car Accident Lawyer Do?

A car accident lawyer provides various legal services to help injured individuals pursue compensation for their injuries and losses. Their responsibilities often include:

  • Investigating the accident: Gathering evidence like police reports, witness statements, photos, and video footage to determine how the accident occurred and who was at fault.
  • Filing insurance claims: Assisting clients in filing claims with their insurance company and the at-fault driver’s insurer to ensure all necessary documentation is submitted correctly.
  • Negotiating settlements: Working with insurance adjusters to secure fair compensation for medical bills, property damage, lost wages, and pain and suffering.
  • Calculating damages: Determining the full extent of your damages, including current and future medical expenses, rehabilitation costs, lost income, and non-economic damages like pain and suffering.
  • Handling medical bills: Coordinating with healthcare providers to ensure your medical bills are paid and helping you avoid financial hardship during the claims process.
  • Filing lawsuits: If the insurance company refuses a fair settlement, the lawyer can file a lawsuit and represent you in court.
  • Representing you in court: Presenting your case before a judge and jury, providing evidence and witness testimony to prove negligence and your right to compensation.

How Are Car Accident Lawyers Paid?

Most car accident lawyers work on a contingency fee basis, meaning they only get paid if they win or settle your case. The key aspects include:

  • Contingency fee: The lawyer’s fee is typically between 25% and 40% of the total settlement or award. You won't pay upfront fees; the lawyer's payment comes from the compensation they recover for you.
  • No fee if no recovery: If the lawyer doesn’t secure compensation for you, you generally don't owe any legal fees.
  • Case expenses: You may be responsible for certain costs related to your case, such as filing fees or expert witness fees. These are usually deducted from the settlement after the lawyer's fee is paid.

Discuss the fee structure during your initial consultation to understand how much you'll owe if your case is successful.

How Much Does a Car Accident Lawyer Cost?

The cost of hiring a car accident lawyer is generally based on the contingency fee arrangement. General estimates include:

  • Contingency fee percentage: Lawyers typically charge between 25% and 40% of the total settlement or award. For example, if you receive a $100,000 settlement and the lawyer's fee is 33%, the lawyer would receive $33,000, and you'd keep the remaining $67,000.
  • Case expenses: Additional costs such as court filing fees, expert witness costs, and administrative fees can range from $1,000 to $10,000 or more, depending on the case complexity.

Ensure you get a clear explanation of fees and expenses during your consultation.

Top Questions to Ask a Car Accident Lawyer

Before hiring a car accident lawyer, consider asking the following questions:

  1. What experience do you have with car accident cases?
Confirm the lawyer has handled cases similar to yours, especially involving serious injuries or complex liability issues.
  2. How do you charge for your services?
Understand the contingency fee percentage and any additional costs you may incur.
  3. What is the likelihood of success in my case?
Seek an honest assessment of your case's strengths and potential challenges.
  4. How long will the process take?
Get an estimate of the timeline for settling or taking the case to trial.
  5. Will you handle my case personally?
Ensure you know who will be managing your case and their level of involvement.
  6. What kind of compensation can I expect?
Ask about the types of damages you may be entitled to, including medical bills, lost wages, and pain and suffering.

How to Check the Credibility of a Car Accident Lawyer

To ensure you're hiring a reputable lawyer, take the following steps:

  • Check their bar status: Verify with your state bar association that the lawyer is licensed and in good standing.
  • Review their experience: Look for specialization in personal injury and car accident cases.
  • Read client reviews: Consult platforms like Avvo or Martindale-Hubbell for testimonials and ratings.
  • Ask for references: Request contact information of previous clients willing to discuss their experience.
  • Check professional affiliations: Membership in organizations like the American Association for Justice (AAJ) indicates a commitment to the field.

What Should I Prepare for My First Consultation?

To maximize the effectiveness of your initial meeting, bring the following:

  • Police report: A copy of the accident report filed by the police.
  • Medical records: Documentation of your injuries, treatments, and medical expenses.
  • Photos and videos: Any visual evidence from the accident scene and of your injuries.
  • Insurance information: Copies of your insurance policy and any correspondence with insurance companies.
  • Witness information: Contact details and statements from any witnesses.
  • List of questions: Prepared questions about your case and the legal process.

Being well-prepared helps the lawyer assess your case accurately and advise you on the best course of action.
