*Disappointing Experience with Roy Yang Law Office- Lack of Communication and Unprofessional Service* I'm extremely dissatisfied with Roy Yang's Law Office handling of my workers' compensation case. Despite hiring them 7 months ago, I've experienced chronic communication issues and unprofessional service. Key concerns: - *Ignored emails*: Multiple messages regarding my case have gone unanswered. - *Lack of preparation*: No one briefed me on what to expect for my recent QME (Qualified Medical Evaluation). - *Missed appointments*: A phone appointment was scheduled without notification, and I only discovered it by calling the firm. - *Unhelpful staff*: When I do reach someone, I'm made to feel like a burden or an inconvenience. Given my frustrating experience, I question the authenticity of positive reviews. I advise others to exercise caution when considering Roy Yang for legal representation.

I used Rick in 2017 to draft the MSA (Marital Settlement Agreement) in my uncontested divorce - specifically to assist with disclosures and filing. Unfortunately, he did such a terrible job the judge threw my entire MSA out in June of 2020 after 3 more years in court battling my ex-wife. In his final ruling the judge identified a number of inconsistencies specific to disclosures, so rather than boring you with my story I’ll let the judge’s words from his final ruling speak for themselves: 1. There is no evidence that he supplied a statement of all material facts as to assets and obligations, nor did it include his last two years income tax returns (Family Code Section 2105 b) 2. His schedule of assets and debts contains no statements for the various accounts identified therein. 3. The personal loan from Christopher’s mother, is identified as being incurred during the marriage with a balance of $XX,XXX; no promissory note was attached, although one existed (exhibit 7). 4. Because he did not provide a statement of all material facts as required under Section 2105 b 3 there are no factual contentions provided to wife that would allow her to ascertain if the credit card could be her separate liability. 5. The court looks with suspicion at the conflation of the preliminary and final declarations of disclosure, which was done in this case; especially here given the very short time frame from the filing of the petition to the presentation of the disclosures in full marital settlement agreement. Add to this, that the disclosure itself was woefully inadequate. 6. Based upon the evidence addressed herein, the court finds that Christopher’s declaration of disclosure, which he identified as his “final declaration of disclosure”, fails to comply with Section 2105e. The court would set aside the MASA and judgement based upon this failure alone. While I provided Rick with all of the documentation required it is apparent from the quotes above especially numbers 5 & 6 that said documentation was not included resulting in my disclosures being insufficient. Rick did not advise me on the incompleteness of my disclosures per our agreement and he also used a form in which my ex-wife adopted my disclosures. It was only later that I discovered this form is acceptable in Sacramento County, but Rick failed to make sure it would also be acceptable in Placer County and it wasn’t. As a result, I now need to pay my ex-wife money I do not have because I’ve spent all my money on attorney’s fees over the last 3 years to fight the motion to set aside my MSA which I thought was a solid case with solid disclosures. I asked Rick for his money back and gave him 30 days to do so before I wrote this review and filed an official complaint with the California State Bar and he refused. Not sure why he made that decision based on the information above, but either way spare yourself the frustration and find another attorney.

Fredrick (Rick) Cohen is a highly experienced family law attorney. He's been a licensed attorney for almost 30 years, and is also a Certified Family Law Specialist. He was referred to me by another family law attorney who thought that Mr. Cohen could better manage my difficult divorce against my ex-husband. My ex was relentless on almost every issue throughout the entire divorce proceeding. Mr. Cohen's profound knowledge of the law helped me survived this very stressful period of my life. He's a competent attorney with proven litigation skills in and out of the courtroom. (Unfortunately for me, my case went to trial so I got to witness Mr. Cohen's trial skills and abilities.) He can be an aggressive litigator when it is appropriate to do so, but will also advise you when he believes it is best to compromise on certain issues. He is mindful of your intentions and how you wish to settle your legal matter. He is honest and upfront, and will not sugar coat your matter if he believes otherwise. As such, he may come across at times as being unsympathetic, but it is his role to provide legal guidance, not therapy. I would recommend Rick Cohen if you are seeking a strong attorney to represent you on your family law matter.

I have used for my needs two separate occasions. He was the third one that I had tried to help my with a ex husband who felt he didn’t need to pay me 23 years of marriage. John took care of it quickly and represented me and got me my pride back and the money I needed to start my life over. Pat his assistant was always immediately on task when John was in court I felt supported and that he truly cared. The second time I remarried and sadly my new husband passed away after a few years. I needed papers from previous marriage I thought I would never need again and John answered the phone and took care of it immediately. I no longer lived in Sacramento and it was time sensitive. Again he cared he listened to me and helped me w my needs quickly! I recommend John Montero due to his professionalism and he got me results when the other two lawyers did nothing . Thank you! My life was forever changed due to him!

Evidently, I'm not the only person who had an unsatisfactory experience with Bobby Luna as a Small Claims judge. He did not review any of my evidence, nor did he speak to my witness who was on standby on Zoom. In summary, be prepared to appeal his decision if you have him as a judge in Small Claims court.

I have appreciated the offices of Bobby P Luna for four years and counting. Jennifer Holdener, Mackenzie, and reception have all been extremely patient with my needs and multiple cases that were far from normal in the eyes of us mere mortals. The bad reviews for Bobby and his office reflect a lack of understanding that the relationship between you, your lawyer and your case is a symbiotic dance where you provide the information and work together to create a case. There were times I was panicked and called and received no word back—and became upset—but these lawyers are constantly working for someone each day, so I would remember to be patient—that we have our day in court, not our day on the messaging system. I will continue to support Bobby P Luna and Jennifer with my recommendations and any new issues that may arise. I’ve been meaning to write this for a long time, and it took these one star reviews to get me to use my fingers and speak.

I definitely agree with everyone that rated him a one star. And he is trying to run for Superior Court Judge?! Thank God Sacramento saw through his bull. I went to this man several years back to get help with my divorce case. He told me he would definitely review my case and Get back with me, but I had a pretty clear cut case. He stated that he had to go to some type of attorney’s forum in Orange County and would review it when he returned. He told me to give him two weeks. Well, 3 1/2 weeks later, I kept calling with no response. Approximately 1.5 months later, I received a phone call from his office, not even him , stating that he would not be able to take my case due to it being too complex! Too complex?! Well, if he’s trying to run for a superior court judge that is as complex as it gets. Stay away from this person. I wouldn’t vote for him to run a boxcar race. Personally, I think he’s only an attorney based on the title and the prestige that it gives not based on anything that he earned or worked hard for and most certainly not his knowledge/expertise in the field. Look somewhere else for a competent attorney. I bet his premiums for his malpractice insurance are more than his net worth. Update: See his reply below?! He said I never was a client. Exactly! Because after holding all of my documents several weeks and then making a cowardice move of having your staff call me and tell me that my case was too complex to handle- you’re right. I never was a client. Now, I’m so glad that you did me that favor. It was years ago and you may have gotten better since you’re “practicing.” Oh and just because you teach somewhere means nothing. I can own a beauty salon and not know how to do hair or have a license to do so. And you have further buttressed my statements in my review just by saying that you don’t “normally” reply to reviews- shows a lack of maturity and an underlying soreness about your loss. Nahhhh, Sacramento made an excellent decision.

Ms. Snider is very knowledgeable, ethical, hard-working and tenacious. Her services are especially indispensable if the case is infected by evasiveness, dishonesty, or even outright fraud emanating from the opposing party. In my case, she obtained a much-needed modification of a particularly onerous spousal support obligation that had been negotiated by another attorney years earlier. She refused to tolerate evasive, incomplete, non-compliant discovery responses from the other party and mopped the courtroom floor with two different experienced Sacramento family law attorneys in the process. I am extremely grateful for Ms. Snider's efforts on my behalf, and I cannot recommend her highly enough.

Ms. Snider saved us from the pit of Hell and gave our family hope again. Our case was HIGHLY litigious, and we had to fight against corruption, fraud, cyberstalking, and other forms of severe harassment perpetrated by the abusive father, his corrupt attorney, and bribed "experts." Ms. Snider and her staff protected us, kept us informed, and kept her professional integrity while representing us brilliantly. She and her staff care and will go the extra mile to do what is right, not just what is convenient or what she's is paid to do.

I hired Mr Morrison with an amazing amount of evidence against my ex-husband proving he was an unstable and horrible father. (jail records, mental health records, etc). He did nothing to represent me or the case against him. He never responded to my calls, his assistant Michelle barely emailed me, would never inform me of things received from my exhusbands attorney. Now back at court, I represented myself and finally got the court to see what I had provided Mr. Morrison to do 5 years ago. Unbelievable.... my kids have suffered partly to the lack of care and concern he took for my case. Oh and when I asked for a copy of my case file, I got half a$$ copies with missing information and letters I never received. UNBELIEVABLE. My 8 year old could have done better.

I went to Lynette for help with custody of my son after his dad physically abused him. In the initial (free) phone call to review the events she stated we would request a restraining order and push for full custody. Once she receive my deposit and began charging me for every contact she sent several emails just to check in (I was charged for those check in emails), she spent 1.7 hours discussing the events (that we had gone over several times prior). During that phone call she kept acting confused about the explanation that my son's father threw a shovel at my son, pinned him to the ground and choked him. She did not follow up with the CPS report or Sheriff report. She claimed to have prepared all of the paperwork to submit to the court, but after 3 weeks of interaction she still had not submitted any paperwork to the court. The bill was just sent for $1400 for 2 phone calls and some check in emails. The end result is my son is still forced to go to a man's house that is physically abusive and the lawyer got paid. To add to the incompetence, the book keeper told me that I could pay with a credit card and the deposit would be sent back as a check. now I have a $1500 credit on a paid off credit card. Please do yourself a a favor and do not use this firm.

What a Child Custody Lawyer Can Do for You

A child custody lawyer specializes in helping parents navigate legal matters related to the custody and care of their children, particularly in the context of divorce, separation, or other family disputes. These lawyers assist with determining custody arrangements, drafting parenting plans, and advocating for your rights in court. They also help resolve disputes over physical custody (where the child lives), legal custody (who makes decisions for the child), visitation rights, and modifications to existing custody orders.

Whether you're going through a divorce or need to change an existing custody arrangement, a child custody lawyer can help you understand your rights and protect your child's best interests throughout the legal process.

When Should I Hire a Child Custody Lawyer?

You should consider hiring a child custody lawyer in several situations, especially when disputes arise or complex legal issues affect your parental rights. Some common reasons to hire a child custody lawyer include:

  • Divorce or separation: If you're going through a divorce or separation and need to establish custody and visitation arrangements, a lawyer can help ensure the custody order reflects your child's best interests.
  • Disputed custody cases: If you and the other parent cannot agree on custody or visitation terms, a lawyer can advocate for your rights in court and help you develop a strong case.
  • Modification of custody orders: If you need to change an existing custody arrangement due to changes in circumstances (e.g., relocation, changes in the child’s needs), a lawyer can help file a modification request.
  • Parental alienation: If the other parent is interfering with your relationship with your child, a lawyer can help address these issues through legal action.
  • Domestic violence or abuse: If there is a history of domestic violence or abuse, a lawyer can help protect you and your child by requesting restraining orders and advocating for appropriate custody arrangements.
  • Grandparent or third-party custody: If you are a grandparent or another relative seeking custody or visitation rights, a lawyer can guide you through the legal process.
  • Paternity disputes: In cases where paternity is in question, a lawyer can assist with establishing or challenging paternity, which may affect custody and visitation rights.

Hiring a lawyer early in the process can help protect your parental rights and ensure that the custody arrangement is in your child's best interests.

What Does a Child Custody Lawyer Do?

A child custody lawyer provides a variety of legal services to help parents resolve custody disputes and secure favorable custody arrangements for their children. Their responsibilities often include:

  • Filing custody petitions: Helping you file the necessary paperwork to request custody or visitation rights and ensuring all legal procedures are followed.
  • Negotiating custody agreements: Assisting in negotiating custody and visitation arrangements, often working toward a mutually beneficial parenting plan without going to court.
  • Representing you in court: If you and the other parent cannot agree on custody terms, representing you in court by presenting evidence and making legal arguments to support your case.
  • Drafting parenting plans: Helping you draft a comprehensive parenting plan that outlines the schedule for physical custody, decision-making responsibilities, and visitation.
  • Handling child support issues: Assisting with related issues such as child support, ensuring that financial obligations are properly calculated and enforced.
  • Modifying custody orders: Helping you request a modification from the court if you need to change an existing custody arrangement due to significant life changes.
  • Mediating custody disputes: Acting as a mediator to help both parents reach an agreement on custody and visitation without the need for litigation.

How Are Child Custody Lawyers Paid?

Child custody lawyers typically charge for their services based on the complexity of the case, the time involved, and the nature of the legal work. Common payment methods include:

  • Hourly rate: Most child custody lawyers charge by the hour, with rates ranging from $150 to $500 or more, depending on the lawyer's experience and location. The total cost depends on the time spent preparing documents, negotiating, and representing you in court.
  • Flat fee: For simple custody matters or uncontested custody agreements, some lawyers may offer a flat fee for specific services, such as drafting a parenting plan or filing a custody petition.
  • Retainer: Many lawyers require an upfront retainer fee, which is billed against as the lawyer works on your case. The amount varies based on the expected complexity and duration of the case.
  • Sliding scale or pro bono services: Some lawyers may offer reduced fees or pro bono (free) services for clients with limited financial means, particularly in cases involving domestic violence or other serious issues.

It’s important to discuss fees and payment arrangements with your lawyer during the initial consultation to understand how much you will be charged and what services are included.

How Much Does a Child Custody Lawyer Cost?

The cost of hiring a child custody lawyer depends on various factors, including the complexity of the case, whether it’s contested or uncontested, and the lawyer’s experience. General cost estimates include:

  • Uncontested custody cases: Legal fees may range from $1,500 to $5,000 or more, depending on the complexity of the paperwork and any negotiations.
  • Contested custody cases: Legal fees can range from $5,000 to $40,000 or more, depending on the complexity of the issues, the need for expert testimony, and the time spent in litigation.
  • Hourly rates: Lawyers typically charge between $150 and $500 per hour, with higher rates for more experienced attorneys or complex custody disputes.
  • Mediation services: If both parents agree to work through mediation, costs typically range from $1,000 to $5,000 or more for the mediation process.

Always ask for a clear cost estimate during your consultation to ensure that you understand the total legal fees and payment structure.

Top Questions to Ask a Child Custody Lawyer

Before hiring a child custody lawyer, it’s essential to ask the right questions to ensure they are the best fit for your case. Some key questions to ask include:

  1. What experience do you have with child custody cases?
Ensure the lawyer has experience handling cases similar to yours, especially if your case involves complex issues like domestic violence, relocation, or paternity disputes.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, offers flat fees for certain services, or requires a retainer, and ask for an estimate of the total cost.
  3. What is the likelihood of success in my case?
Ask for an honest assessment of your case, including potential challenges and expected outcomes.
  4. How long will the process take?
Inquire about the expected timeline from filing the petition to reaching an agreement or going to trial.
  5. Will you personally handle my case?
Ensure you know who will be managing your case and representing you in court.
  6. Can we pursue mediation or alternative dispute resolution?
Ask whether the lawyer recommends mediation or other forms of dispute resolution to avoid a lengthy court battle.

How to Check the Credibility of a Child Custody Lawyer

To ensure you are hiring a reputable child custody lawyer, follow these steps to verify their credentials and experience:

  • Verify their bar status: Check with your state bar association to confirm that the lawyer is licensed to practice and has no history of disciplinary actions.
  • Look for family law experience: Review the lawyer’s website or professional profile to ensure they specialize in family law and child custody cases.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to gauge the lawyer’s professionalism and success in child custody matters.
  • Ask for references: A credible lawyer should be able to provide references from past clients who have worked with them on custody cases.
  • Check for certifications: Look for lawyers who are board-certified in family law or have memberships in organizations like the American Academy of Matrimonial Lawyers (AAML) or local family law sections.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with a child custody lawyer, come prepared with relevant documents and information:

  • Court orders or existing custody agreements: Bring copies of any existing custody or visitation orders for the lawyer to review.
  • Communication with the other parent: Provide copies of emails, texts, or letters regarding custody, visitation, or disputes.
  • List of your child’s needs: Prepare a list of your child’s specific needs, such as medical care, education, and extracurricular activities.
  • Timeline of the case: Outline key events related to your custody case, including changes in living situations or parental involvement.
  • Questions for the lawyer: Write down any questions about the custody process, legal fees, and the lawyer’s strategy for your case.

By being well-prepared, you can help the lawyer assess your situation effectively and receive the best possible advice for protecting your rights and your child’s well-being.
