I have had Fred and Sophia, his legal assistant, for the last 2 years for my case. They did a great job and answered all questions when I needed them to. After 2 years Fred won my case which as a father is very unheard in a custody case with the mother. He is a great attorney and I told him I will use him in the future if anything, which something will , come up with my ex-wife.

I absolutely recommend SM2 Legal and Shelby Anderson. I feel so lucky to have found Shelby to represent me for my prenuptial. She is incredibly skilled and empathetic. I needed a prenuptial agreement on a fast timeline, and she showed up for me immediately. What would’ve otherwise been a stressful undertaking for any couple about to get married, Shelby made us feel so seen, comfortable, safe, protected, and well guided throughout the experience. If you need a prenuptial agreement or family law matters, look no further!

Shelby was a true lifesaver! Although I wasn’t working with her during my divorce, I wish I had her from the beginning. Things would have gone so much smoother if I had. She was super knowledgeable, efficient, and always answered my questions and concerns promptly. I highly recommend her to anyone inArizona. Thanks, Shelby!

Shelby has been my attorney for many years. My case has been on and off throughout those years and anytime I made contact with Shelby about and issue she explained what the best course of action was and ensured I had full understanding of the possible outcomes. Shelby is always ready to move forward if necessary and such a reliable source of information. She truly takes care of everything for you! I would not have another lawyer!

Jamie represented my family for our adoption in Pinal County. It had been a rocky few years to get to that point, and when it came time for the adoption to happen, we were in the middle of the pandemic and our hearts were broken, that it was going to happen over the phone. She and her staff arranged to do the adoption via Zoom, and we got to see the Judge and her in person. It was very thoughtful, and meant a lot to our family! She provided us with a packet of forms, and realistic time frames for how to get things done after the adoption was final, and even help fix the mistakes the court made when they misplaced some of our paperwork. I would recommend her and her friendly staff to anyone looking for an ally in this difficult process!

(LONG POST, BUT WELL WORTH YOUR TIME) Jami was recommended to me by my Mother's estate attorney. I'd just traveled back to Des Moines for a class reunion, and received files from my ex-husband's business partner (who lived near us in Scottsdale part time.) These files not only proved he'd been embezzling from the company, but had also been using that money on "seeking arrangements dot com" to be a "Shuger Daddy" to many women around the country (at this point in our marriage, I didn't even like him much, but he knew because of my religion the ONLY way I'd ever divorce him would be infidelity--which I NEVER thought he'd commit...) So, after seeing the file (AKA: my get out of jail free card) and getting Jami's info, I called her from Iowa. I told her that what I was about to say was going to sound crazy, but it was probably only the tip of the iceberg. I'm not sure if she believed everything I was telling her, but as we both found out over the course over the next nearly 2 & a 1/2 years, I was right -- it was not only the tip of the iceberg, it wasn't even 5% of it. The divorce itself went very smoothly and quickly. However, to "punish me" for not getting back together with him after the divorce (I'd lied and said I HAD to divorce him to save face with my family--even though at this point he made my skin crawl), he decided to "get revenge" by fighting me for custody of our 4 children. While this probably would have been a "no brainer" for anyone else, my issue was with my oldest daughter; her birth-mother (my ex's 3rd wife) passed away shortly after my daughter's birth. And even though I'd raised her since before her 2nd birthday, I couldn't adopt her because the ONE thing I needed to complete the process, but didn't have, was my ex's tax returns (he'd never filed them for around 20 years.) This left me with absolutely NO way to adopt her, and absolutely NO legal rights to her whatsoever. Thus, a very LONG, ugly, and disgusting battle ensued (I've been diagnosed with PTSD), with the crescendo being a 2 & a 1/2 day trial. But by the end of that trial, I still have the VERY distinct impression that the judge could not STAND my ex. I could never gauge how he felt about me, but, man, he REALLY seemed to see what a scum my ex was! Regardless, the judge ended up granting me soul custody of all 4 of my kids, the OLDEST included (my ex was granted paid visitation every other weekend -- which, of course, he never took.) Granting me soul custody of my oldest was ABSOLUTELY unprecedented, and I don't think entirely legal in AZ, yet Jami made that happen. Granted, Judge Ryan also played a HUGE role in it all, but Jami was the person who methodically painted the pictures, both big and small, and put every piece of the puzzle into place for the judge. To say that Jami is an amazing lawyer doesn't even come close to describe her skill, talent, and expertise. However, there honestly aren't ANY words other than AMAZING that come close. I genuinely do not think a client could find a better lawyer than Jami Wilenchic. ANYWHERE.

I hired Jami Wilenchik for my complex child custody case and she was amazing! Jami was hired after I had started the process and before my trial and she caught up on everything and got me the outcome I wanted. Jami was very honest and to this day I still ask her questions as they come up. I would strongly recommend her if you want a winner in your corner.

I selected this law firm solely based on convenience and lack of research, my fault. Their staff is very friendly and pleasant to deal with; I will give them that. However, as my attorney, Brice was not a good fit for my case. My case involved one minor child. The goal was to have the ability to move out of state with my child. Brice had ample information and time to prepare a rock solid case on my behalf. Well, he did not do that. He went into court very unprepared, had a very sloppy and weak cross examination. He failed to mention very pertinent details involving my child and her father. Didn’t highlight the benefits for the move. I could go on and on, but ultimately I was highly disappointed with Brice’s service and out 30k. Do your research before selecting any firm!

I acquired Joe for family services. I was divorced already with a child. The other party kept refusing to do what was ordered by the judge so needless to say the outcome was beneficial for me. I did not only use Joe for the family circumstances. Without his expertise I can honestly say, I would have been given a harsher outcome. Comparing what I was sentenced to what it could have been it blows my mind. Thank you Joe!!

Mr Sherrill and his staff are incredible. My case was being drawn out by poor opposing counsel (who was subsequently disbarred for three years) but Gerry and Janet kept at it and eventually got me where I needed to be! Everything was done in a timely and professional manner. I could not have asked for anything more. Hire them.

Patience, organization, tenacity, and a depth of knowledge about every eventuality are mere features of the service provided over the years by Mr. Sherrill. Along With a delightful and knowledgeable support staff, Mr. Sherrill took on a case that had already been years in the making when he began with us. From family court to appeals court to juvenile court , Mr. Sherrill has seen us through some ridiculous times in dealing with a slippery and devious ex-husband. I feel confident in recommending he take on similar cases because he has the skill and temperament to solve any family court mess and he does it in a way that is reassuring for those who hire him. Always fair but fierce, he serves up justice with a twinkle in his eye. (We think he would make a wonderful judge someday.)

Mr, Sherrill was by far the best lawyer I could have asked for. He went above and beyound to help me with my case and make sure i fully understood what was going on. His intelligence and full knowledge of the law made it easy for him to be straight to the point and vocal with me so i never felt confused, worried, or left with tons of questions. He wasted no time in getting my case handled. Where as the laywer I had before kept going in circles, dragging it onand making me feel very worried about whats to come. But that wasnt the case when I let him go and got Mr. Sherrill on my side! after going in circles for months he took my case and had it handled and finished in weeks and i was very happy with the outcome. This is why he has been in the buisness for 29 years, he truly loves what he does, cares about his cilents, and will never beat around the bush! thats why I will always highly recommend him and say hes the best!

Attorney Karen Schoenau at Guymon Law has done a great job in my family case. Her knowledge, relationships, and abilities were all on display in my hotly contested matter. She has been responsive to email, phone and when needed, in-person meetings. I especially enjoy her hearing and trial abilities. Most attorneys are good at writing pleadings and negotiating issues but it takes a special lawyer who can win at hearings. Her support staff is helpful and friendly. I highly recommend her and her firm.

What a Child Custody Lawyer Can Do for You

A child custody lawyer specializes in helping parents navigate legal matters related to the custody and care of their children, particularly in the context of divorce, separation, or other family disputes. These lawyers assist with determining custody arrangements, drafting parenting plans, and advocating for your rights in court. They also help resolve disputes over physical custody (where the child lives), legal custody (who makes decisions for the child), visitation rights, and modifications to existing custody orders.

Whether you're going through a divorce or need to change an existing custody arrangement, a child custody lawyer can help you understand your rights and protect your child's best interests throughout the legal process.

When Should I Hire a Child Custody Lawyer?

You should consider hiring a child custody lawyer in several situations, especially when disputes arise or complex legal issues affect your parental rights. Some common reasons to hire a child custody lawyer include:

  • Divorce or separation: If you're going through a divorce or separation and need to establish custody and visitation arrangements, a lawyer can help ensure the custody order reflects your child's best interests.
  • Disputed custody cases: If you and the other parent cannot agree on custody or visitation terms, a lawyer can advocate for your rights in court and help you develop a strong case.
  • Modification of custody orders: If you need to change an existing custody arrangement due to changes in circumstances (e.g., relocation, changes in the child’s needs), a lawyer can help file a modification request.
  • Parental alienation: If the other parent is interfering with your relationship with your child, a lawyer can help address these issues through legal action.
  • Domestic violence or abuse: If there is a history of domestic violence or abuse, a lawyer can help protect you and your child by requesting restraining orders and advocating for appropriate custody arrangements.
  • Grandparent or third-party custody: If you are a grandparent or another relative seeking custody or visitation rights, a lawyer can guide you through the legal process.
  • Paternity disputes: In cases where paternity is in question, a lawyer can assist with establishing or challenging paternity, which may affect custody and visitation rights.

Hiring a lawyer early in the process can help protect your parental rights and ensure that the custody arrangement is in your child's best interests.

What Does a Child Custody Lawyer Do?

A child custody lawyer provides a variety of legal services to help parents resolve custody disputes and secure favorable custody arrangements for their children. Their responsibilities often include:

  • Filing custody petitions: Helping you file the necessary paperwork to request custody or visitation rights and ensuring all legal procedures are followed.
  • Negotiating custody agreements: Assisting in negotiating custody and visitation arrangements, often working toward a mutually beneficial parenting plan without going to court.
  • Representing you in court: If you and the other parent cannot agree on custody terms, representing you in court by presenting evidence and making legal arguments to support your case.
  • Drafting parenting plans: Helping you draft a comprehensive parenting plan that outlines the schedule for physical custody, decision-making responsibilities, and visitation.
  • Handling child support issues: Assisting with related issues such as child support, ensuring that financial obligations are properly calculated and enforced.
  • Modifying custody orders: Helping you request a modification from the court if you need to change an existing custody arrangement due to significant life changes.
  • Mediating custody disputes: Acting as a mediator to help both parents reach an agreement on custody and visitation without the need for litigation.

How Are Child Custody Lawyers Paid?

Child custody lawyers typically charge for their services based on the complexity of the case, the time involved, and the nature of the legal work. Common payment methods include:

  • Hourly rate: Most child custody lawyers charge by the hour, with rates ranging from $150 to $500 or more, depending on the lawyer's experience and location. The total cost depends on the time spent preparing documents, negotiating, and representing you in court.
  • Flat fee: For simple custody matters or uncontested custody agreements, some lawyers may offer a flat fee for specific services, such as drafting a parenting plan or filing a custody petition.
  • Retainer: Many lawyers require an upfront retainer fee, which is billed against as the lawyer works on your case. The amount varies based on the expected complexity and duration of the case.
  • Sliding scale or pro bono services: Some lawyers may offer reduced fees or pro bono (free) services for clients with limited financial means, particularly in cases involving domestic violence or other serious issues.

It’s important to discuss fees and payment arrangements with your lawyer during the initial consultation to understand how much you will be charged and what services are included.

How Much Does a Child Custody Lawyer Cost?

The cost of hiring a child custody lawyer depends on various factors, including the complexity of the case, whether it’s contested or uncontested, and the lawyer’s experience. General cost estimates include:

  • Uncontested custody cases: Legal fees may range from $1,500 to $5,000 or more, depending on the complexity of the paperwork and any negotiations.
  • Contested custody cases: Legal fees can range from $5,000 to $40,000 or more, depending on the complexity of the issues, the need for expert testimony, and the time spent in litigation.
  • Hourly rates: Lawyers typically charge between $150 and $500 per hour, with higher rates for more experienced attorneys or complex custody disputes.
  • Mediation services: If both parents agree to work through mediation, costs typically range from $1,000 to $5,000 or more for the mediation process.

Always ask for a clear cost estimate during your consultation to ensure that you understand the total legal fees and payment structure.

Top Questions to Ask a Child Custody Lawyer

Before hiring a child custody lawyer, it’s essential to ask the right questions to ensure they are the best fit for your case. Some key questions to ask include:

  1. What experience do you have with child custody cases?
Ensure the lawyer has experience handling cases similar to yours, especially if your case involves complex issues like domestic violence, relocation, or paternity disputes.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, offers flat fees for certain services, or requires a retainer, and ask for an estimate of the total cost.
  3. What is the likelihood of success in my case?
Ask for an honest assessment of your case, including potential challenges and expected outcomes.
  4. How long will the process take?
Inquire about the expected timeline from filing the petition to reaching an agreement or going to trial.
  5. Will you personally handle my case?
Ensure you know who will be managing your case and representing you in court.
  6. Can we pursue mediation or alternative dispute resolution?
Ask whether the lawyer recommends mediation or other forms of dispute resolution to avoid a lengthy court battle.

How to Check the Credibility of a Child Custody Lawyer

To ensure you are hiring a reputable child custody lawyer, follow these steps to verify their credentials and experience:

  • Verify their bar status: Check with your state bar association to confirm that the lawyer is licensed to practice and has no history of disciplinary actions.
  • Look for family law experience: Review the lawyer’s website or professional profile to ensure they specialize in family law and child custody cases.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to gauge the lawyer’s professionalism and success in child custody matters.
  • Ask for references: A credible lawyer should be able to provide references from past clients who have worked with them on custody cases.
  • Check for certifications: Look for lawyers who are board-certified in family law or have memberships in organizations like the American Academy of Matrimonial Lawyers (AAML) or local family law sections.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with a child custody lawyer, come prepared with relevant documents and information:

  • Court orders or existing custody agreements: Bring copies of any existing custody or visitation orders for the lawyer to review.
  • Communication with the other parent: Provide copies of emails, texts, or letters regarding custody, visitation, or disputes.
  • List of your child’s needs: Prepare a list of your child’s specific needs, such as medical care, education, and extracurricular activities.
  • Timeline of the case: Outline key events related to your custody case, including changes in living situations or parental involvement.
  • Questions for the lawyer: Write down any questions about the custody process, legal fees, and the lawyer’s strategy for your case.

By being well-prepared, you can help the lawyer assess your situation effectively and receive the best possible advice for protecting your rights and your child’s well-being.
